Yes, the case was real—but the original BIRA-led proceeding is not the action currently moving forward. BIRA Trading Ltd filed a proposed opt-out collective claim in the Competition Appeal Tribunal on 6 June 2024, alleging that Amazon used confidential third-party seller data and manipulated its “Buy Box” to favour Amazon Retail. The retailers’ claimed damages were reported initially at £1 billion; later BIRA material referred to £1.3 billion. Neither figure is an award.
In January 2025, the Tribunal selected a competing collective action led by Professor Andreas Stephan to control the overlapping litigation and stayed BIRA’s claim. Stephan’s action later obtained certification, and the case tracker reports that Amazon’s appeal was refused in February 2026. No final finding of liability or compensation award has been established.
What BIRA filed in June 2024
BIRA Trading Ltd, associated with the British Independent Retailers Association, brought the proposed proceedings under the Competition Act 1998 in London’s Competition Appeal Tribunal. It sought to represent approximately 35,000 retailers that sold new products through Amazon’s UK marketplace.
The announcement described a claim of about £1 billion in damages. BIRA’s later claim information used a £1.3 billion figure. These are changing estimates of aggregate loss claimed on behalf of the proposed class, not money awarded by a court, placed in escrow or guaranteed to be distributed equally among sellers.

The proposed action was an opt-out collective proceeding. If certified, people within the defined class would generally be included unless they opted out, subject to the Tribunal’s final class definition and orders.

What the retailers alleged
Use of non-public seller data
BIRA alleged that Amazon used information generated by independent merchants—such as sales, prices, inventory, demand and commercial performance—to guide Amazon Retail’s decisions. The pleaded theory included deciding which categories to enter, which products or features to copy, how to price competing goods and which customers or market segments to target.
Those are allegations, not established findings. A seller’s information being available to Amazon’s systems does not by itself prove unlawful use; the case would have to establish what data was used, how it was used and whether that conduct infringed competition law.
Buy Box self-preferencing
The Buy Box is the prominent featured offer displayed on an Amazon product page. Several sellers can offer the same product, but the featured offer is the most visible route to “Add to Basket” and can materially affect conversion.

BIRA alleged that Amazon manipulated Buy Box selection to steer sales to Amazon’s own retail operation or otherwise disadvantage third-party merchants. The legal question is not whether Amazon operated a Buy Box, but whether its criteria or implementation unlawfully favoured Amazon Retail or particular seller arrangements.
Who the proposed class covered
BIRA’s eligibility page described the following proposed boundaries. They are not a guarantee that an individual business will ultimately qualify or recover money.

Using Amazon’s marketplace does not establish that a retailer competed directly with an Amazon-owned product, suffered a Buy Box disadvantage or can prove a compensable loss. The final class, if any, can differ from the class proposed in the original filing.

BIRA’s position was that Amazon’s reach makes it difficult for small businesses to avoid the platform. The commercial tension is straightforward:
- Reach: Amazon provides access to a large pool of online shoppers without requiring a small retailer to build equivalent traffic from scratch.
- Platform dependence: Sellers operate under Amazon’s ranking, fulfilment, fee, advertising, data and account-health rules.
- Dual role: Amazon is both marketplace host and direct retailer, creating the possibility—alleged by BIRA—of a conflict between operating the platform and competing on it.
- Switching costs: Replacing Amazon traffic with an independent website, search advertising or another marketplace can require substantial investment and time.
BIRA also said Amazon charged members a “non-negotiable 30% commission” on every product sold. That is BIRA’s description, not a universal fee applying to every UK transaction: actual seller costs can vary with category, referral fees, fulfilment, storage, advertising and other services.

Amazon’s response
Contemporary reporting said Amazon had not seen the complaint when first contacted and considered the claim baseless. Amazon also emphasised the importance of independent sellers to its business. A denial is not a determination of the facts; the allegations would need to be tested through the collective-proceedings process.

Regulatory scrutiny is separate from the damages claim
The Competition and Markets Authority opened an investigation in 2022 into whether Amazon gave its own retail operation, or sellers using Amazon logistics, an unfair advantage over other third-party sellers. The European Commission examined related marketplace concerns. Amazon made commitments concerning Buy Box access, use of marketplace data and seller delivery arrangements; The Guardian reported that the UK investigation closed after those commitments.
Regulatory commitments can change conduct going forward. They do not automatically prove the allegations in a private damages action, compensate past losses or establish that every seller was affected in the same way.
Why BIRA stopped controlling the overlapping case
Professor Andreas Stephan brought a competing proposed collective action concerning substantially overlapping allegations. When competing representatives seek to run essentially the same litigation, the Tribunal conducts a carriage dispute: it chooses which proposed action should control the proceedings so defendants are not required to defend duplicate cases covering the same conduct.

In a judgment dated 20 January 2025, the Competition Appeal Tribunal selected Stephan’s action and stayed BIRA’s claim. The judgment records both proposed representatives and their allegations of an abuse of dominance in the UK marketplace. Read the Tribunal’s carriage judgment.

- The case update and legal-proceedings tracker report that Amazon’s appeal was refused in February 2026.
- BIRA’s original claim remains the stayed, non-selected proceeding on the information publicly described by BIRA.
- No verified final damages award or finding that Amazon is liable has been reported.

Liability
The active action must establish that Amazon held a dominant position and that the alleged data practices or Buy Box conduct amounted to an unlawful abuse under the applicable competition-law framework, including the relevant pre-2021 EU-law provisions referred to in the claim.
Causation and loss
Even if a breach is proved, claimants must show that it caused compensable loss. The analysis may differ by product, seller, fulfilment model, advertising spend, margins, exposure to Amazon Retail and Buy Box performance. Some sellers may argue that Amazon’s traffic, fulfilment or customer services produced benefits that must be accounted for.

Class definition and damages methodology
The Tribunal may refine who is included and how individual losses are assessed. It would be unsafe to divide £1 billion by 35,000: the headline is an aggregate claim valuation, not a promised equal payment.
Practical guidance for potentially affected sellers
A retailer that may fall within BIRA’s proposed period should preserve records, without assuming that preservation proves entitlement:
- Amazon settlement, order, refund and return reports.
- SKU, listing, pricing and inventory histories.
- Buy Box or Featured Offer records, where available.
- Advertising, fulfilment and storage invoices.
- Messages about listing suppression, pricing, account health or fulfilment.
- Evidence of Amazon Retail or Amazon-branded competing products.
- Company incorporation, domicile and historical-account records.
Participation in any registration process does not by itself establish inclusion in the active Stephan proceeding. Sellers should rely on the current Tribunal record and the appointed representative’s instructions rather than assume that BIRA’s original process controls the litigation.
What this headline does—and does not—mean
“Independent UK retailers sue Amazon for £1 billion over data misuse” describes a genuine 2024 filing and its allegations. It does not mean Amazon has been found to have stolen data, that every seller is eligible, that BIRA still leads the active case, or that £1 billion has been won. The live procedural vehicle is the certified Stephan-led action, while the legal merits, class composition, causation and damages remain to be determined.
