His filing did not ask the justices to permanently invalidate the law, approve a specific buyer, or give him unilateral power to cancel it.
The request came three days before the Court was scheduled to hear the constitutional challenge and less than a month before the law’s January 19, 2025 effective date. Trump took office on January 20, creating the narrow timing window he wanted the Court to preserve.
What Trump actually asked the Court to do
Trump filed an amicus curiae brief—literally, a “friend of the court” filing—listed on the docket as being “in support of neither party.” He was not a litigant in TikTok Inc. v. Garland and was not replacing the Biden administration or TikTok’s lawyers.
His requested remedy was a pause or delay in the law’s operation. Trump said that, after taking office, he could pursue a negotiated political resolution addressing national-security concerns while keeping TikTok available to Americans. The brief described his political mandate and negotiating ability, but it did not present a completed transaction, identify a purchaser, or establish authority to repeal the statute.

Delay is different from invalidation

Why the January dates mattered
The law’s restrictions were scheduled to take effect on January 19, 2025. Trump’s inauguration was January 20. His filing therefore asked the Court to preserve the status quo for long enough for the incoming administration to act.
A pause would not have eliminated the underlying requirement. TikTok would still need a legally qualifying divestiture or another valid legal or political outcome. Without that, the statutory restrictions could still prevent U.S. app stores and hosting services from supporting the application.
The law behind the dispute
The Protecting Americans from Foreign Adversary Controlled Applications Act was enacted as Division H of 2024 national-security legislation. It generally prohibits U.S. app stores and internet-hosting services from supporting a covered application controlled by a foreign adversary unless its owner completes a “qualified divestiture.”

For TikTok, that meant a transaction severing ByteDance’s ability to control and operate the application and ending specified operational ties. A nominal, partial or cosmetic ownership change would not necessarily satisfy the statute. TikTok was expressly covered because of its relationship with ByteDance.

“Ban” is shorthand. The law did not necessarily order every account to be deleted. Instead, it restricted the app-store distribution, hosting and support services needed to keep TikTok operating in the U.S. Without a qualifying divestiture, that structure could effectively remove the app from the American market.
What the Supreme Court case was about
The principal case was TikTok Inc. v. Garland, No. 24-656, consolidated with Firebaugh v. Garland, No. 24-657, brought by TikTok, ByteDance and U.S. creators. The Court granted review on December 18, 2024, expedited the proceedings and scheduled oral argument for January 10, 2025. The question presented was whether the Act violated the First Amendment as applied to the petitioners. The government’s position
The Biden administration defended the law as a national-security measure. It argued that ByteDance’s Chinese ownership and control created risks involving access to user data and the possibility of influence or manipulation. The government’s theory was that Congress regulated the platform’s ownership and operation, rather than suppressing users because of what they wanted to say.

TikTok’s and creators’ position
TikTok, ByteDance and the creator petitioners argued that forcing a divestiture or cutting off the services required to distribute and operate TikTok would effectively shut the platform in the United States. They said that consequence would suppress speech, communication, commerce and political expression for users and creators.
The dispute therefore involved two different interests: the government’s claimed authority to address foreign-control risks and the practical speech consequences of removing a major communications platform. Litigation materials cited more than 170 million American users, a figure reported in the Constitution Annotated.

Trump’s position
Trump argued that the Court should hold off while he tried to resolve the matter “through political means” after taking office. His brief presented negotiation as a way to address security concerns without taking TikTok away from American users. That was an argument for time and executive-policy flexibility, not a judicial finding that the law was invalid.

Trump attempted to ban or restrict TikTok during his first administration. By late 2024, he opposed the congressional divest-or-restrict law and had become a prominent TikTok user during his presidential campaign.
That chronology is documented. The explanation for the reversal is less settled. Coverage pointed to TikTok’s popularity among younger voters, the platform’s political reach, and relationships involving TikTok-linked investors and Republican networks. Those are reported political interpretations, not proof that any particular donor, meeting or business interest caused the change. The contemporary account from The Verge describes the filing and the reversal; Reuters and The New York Times also discussed the political context.
Could a president save TikTok alone?
Not simply by declaring the law cancelled. Congress enacted the statute, and a president generally cannot erase it unilaterally. A durable solution could have required one or more of these paths:

- A qualifying divestiture that removed ByteDance’s control and met the statutory conditions.
- Congressional repeal or amendment.
- A judicial ruling invalidating the law.
- A legally supportable extension or enforcement decision within the statute’s terms.
- A transaction followed by the presidential certifications required by the law.
The CRS analysis of the statute explains the divestiture framework in LSB11127. Even if the Court had granted a pause, TikTok would still have faced the underlying statutory requirement. Trump’s brief was not a presidential order and, when filed, he had not yet taken office.
What happened after the filing
The Supreme Court did not simply grant Trump’s request and turn the matter over to his administration. It heard argument on January 10, 2025, and on January 17 rejected the First Amendment challenge to the divestiture law. The Congressional Research Service summarizes that decision in LSB11261.
That outcome matters because Trump’s filing itself did not rescue TikTok, authorize a sale or win the constitutional case. It asked the justices to preserve time for a possible negotiated solution; the Court ultimately upheld the law against the challenge before it.
The Bottom Line
Trump was asking the Supreme Court to preserve time and leverage for an incoming administration—not to give him unilateral power to erase Congress’s TikTok law. His December 27, 2024 brief sought a pause for negotiations, and the Supreme Court later rejected the First Amendment challenge on January 17, 2025.
