Short answer: The Supreme Court upheld the federal TikTok divest-or-restriction law on January 17, 2025. The justices did not order an immediate shutdown. TikTok briefly went offline, the executive branch delayed enforcement while negotiating a transaction, and a U.S.-controlled joint venture reportedly completed the divestiture on January 22, 2026. The ruling still matters: it upheld Congress’s legal mechanism and left future ownership, security and enforcement disputes possible.
What the Supreme Court actually decided
In TikTok Inc. v. Garland, the Court upheld the Protecting Americans from Foreign Adversary Controlled Applications Act as applied to TikTok and the other challengers. The opinion rejected TikTok’s First Amendment challenge to the law’s restrictions. Read the Supreme Court opinion.
The Court did not hold that TikTok videos are unlawful, that users lose speech rights, or that social-media platforms have no First Amendment interests. It accepted that the law affected speech, but concluded that the challenged provisions did not burden substantially more speech than necessary to advance the government’s stated national-security interests.
Those interests concerned the combination of foreign-adversary control, access to U.S. user data and the possibility of influence over a widely used recommendation platform. The ruling was tied to this statute, this record and these asserted risks—not a blanket authorization to ban any foreign-owned application.

Was TikTok banned?
The most accurate answer depends on which event you mean:

So “the Supreme Court banned TikTok” is wrong shorthand. The Court upheld the legal pathway that could have forced a shutdown or restricted the service unless ownership and control changed.
Why the app went dark and came back
The statute’s validity and its immediate enforcement were separate questions. After the brief January 2025 outage, President Donald Trump’s January 20 executive order directed the attorney general not to enforce the law for 75 days while the administration assessed the situation and negotiated. Later orders extended the delay while a divestiture was pursued, including the September order describing the administration’s approach. The June Federal Register order and September White House order document those extensions.

This created an unusual legal and political situation: the Supreme Court had upheld the statute, but the executive branch chose not to impose its penalties immediately. What counted as a “qualified divestiture”
A qualifying transaction had to be more than renaming a U.S. subsidiary or selling office equipment. The statutory concept was intended to remove the application from foreign-adversary control and prevent a continuing operational relationship that preserved the security concerns behind the law.
In September 2025, the White House described a proposed U.S.-based joint venture with these features:
- American investors would hold a majority of the venture.
- ByteDance would hold less than 20 percent.
- ByteDance would have one seat on a seven-member board and no seat on the security committee.
- Oracle would provide security infrastructure and monitoring.
- U.S. data and operational controls would be separated from ByteDance.
- The structure would also cover Lemon8, CapCut and related applications operated by the venture.

What happened to TikTok’s recommendation algorithm?
The algorithm is central to both TikTok’s value and the security debate. A genuine divestiture therefore had to address recommendation systems, software updates, data access, cybersecurity and the relationship between the U.S. service and ByteDance—not just stock ownership.
The Justice Department’s July 2026 Office of Legal Counsel opinion says the TikTok U.S. Data Security Joint Venture operates independently of ByteDance, is majority-owned by American investors and revised its recommendation algorithm and cybersecurity program. The opinion is at justice.gov.
That does not prove that every line of recommendation technology was newly created or that no ByteDance technology remains anywhere in the system. The White House described U.S. control, while outside reporting described the arrangement in somewhat different terms. The defensible conclusion is that algorithmic governance and security controls were part of the restructuring; the exact technical ownership and development arrangements require careful qualification.
What ordinary users may notice
The legal transaction does not answer every product question. Users should distinguish visible service availability from behind-the-scenes ownership and compliance.

- Downloads and updates: A service can remain usable for people who already installed it even if app-store distribution or updates are restricted. Web access, app-store access and hosting are technically different.
- Accounts and features: Login, messaging, creator tools, advertising, payments and shopping can be governed by separate systems and contracts.
- Privacy and terms: Check the current privacy policy, terms of service and data-storage notices rather than assuming they are unchanged.
- Recommendations: New ownership does not automatically mean every user receives a completely new feed.
- Travel: Availability can vary with location, app-store region, account settings and network conditions.
The White House said the contemplated venture included Lemon8 and CapCut as well as TikTok. Inclusion in the transaction does not, by itself, establish identical policies or user experiences across those apps.
What creators and small businesses should do
Creators, merchants and advertisers faced continuity risk long before the ownership question was settled. A continuing app is not a guarantee that followers, drafts, analytics, shopping data or monetization history can be moved elsewhere.
Protect the work you already created
- Keep original, unwatermarked copies of important videos and maintain an organized archive.
- Record key analytics, campaign details, invoices and payout information outside the platform.
- Do not assume drafts, comments, direct messages or audience graphs are exportable.
Own a way to reach your audience
- Maintain an email list, website or other channel you control.
- Republish priority work on more than one short-video service where appropriate.
- Separate revenue you control—such as direct sales or a customer list—from revenue dependent on TikTok’s advertising, commerce or payment systems.
Audit business dependencies
- Check whether current advertising, commerce and payment programs operate under the U.S. joint venture and what contracts say about interruptions.
- Keep a backup source of customer acquisition so a policy, app-store or payment change does not stop sales.
Does the ruling affect other apps?
The law applies to other applications that meet its statutory definition of a foreign-adversary-controlled application. The September 2025 White House material specifically identified Lemon8 and CapCut as part of the contemplated structure.
The broader precedent is narrower than “the government can ban any foreign app.” Future measures would still have to fit the statute or new legislation, and future cases could test how national-security rationales apply to different ownership structures, technologies and records.

What about federal employees and contractors?
Consumer availability and government-device rules are not the same thing. In July 2026, the Justice Department concluded that the joint-venture version of TikTok was not prohibited by the No TikTok on Government Devices Act because ByteDance no longer held controlling ownership and the venture operated independently.
Federal acquisition rules effective March 13, 2026 still define and restrict “ByteDance covered applications” on federal and certain contractor information technology. Contractors must apply the current definitions and contract clauses, including FAR Subpart 4.22 and FAR 52.204-27. A consumer can use an app while a particular agency, contract or device policy still prohibits it.

What could still change
- Compliance disputes: Regulators or courts could examine whether the venture continues to satisfy the statute’s control and operational requirements.
- Algorithmic oversight: The extent of ByteDance technology, personnel or licensing relationships may remain contested.
- Privacy and competition scrutiny: A new ownership structure does not eliminate separate privacy, antitrust or consumer-protection questions.
- Future administrations: Enforcement priorities can change, but a president cannot simply erase the Supreme Court’s ruling without new litigation, legislation or a different qualifying transaction.
- Other platforms: Congress may use similar national-security theories elsewhere, but each application would depend on its statutory definition and factual record.

Did the Supreme Court order TikTok to shut down?
