Yes, the investigation was real—but it is not ongoing. TechCrunch and Reuters reported that the U.S. Department of Labor’s Wage and Hour Division examined Scale AI’s compliance with the Fair Labor Standards Act (FLSA), including questions about pay, working conditions and contractor classification. The reports say the investigation was closed or dropped on May 9, 2025. They do not establish a public DOL finding that Scale AI violated the law, nor a formal ruling clearing the company.
What happened, in brief
TechCrunch first reported the investigation on March 6, 2025, citing an inquiry that had been active by at least August 2024. Scale AI acknowledged the investigation and said it had begun nearly a year earlier, under the Biden administration, according to Reuters. The reported subject was labor-law compliance—not AI safety.
On May 9, 2025, TechCrunch and Reuters reported that the DOL had closed or dropped the investigation. Scale AI said it was pleased with the development. The reports did not identify a DOL fine, back-pay order, court judgment or public merits determination against Scale AI.
Accordingly, the accurate current description is that the DOL investigated Scale AI and the reported probe ended in 2025. Writing that “Scale AI is being investigated” without a date is outdated.

TechCrunch’s March 6 report and Reuters’ initial account describe the investigation and Scale AI’s response. The closure was reported by TechCrunch and Reuters.

What the DOL was reportedly examining
The Wage and Hour Division enforces major parts of the FLSA. The reported Scale AI inquiry concerned whether the company and related arrangements complied with requirements involving:
- minimum wage;
- overtime pay;
- time and payroll recordkeeping; and
- whether workers labeled independent contractors were legally employees.
The public reports do not provide a detailed DOL investigative report or a finding that any particular practice violated the FLSA. It is therefore more accurate to say the agency reportedly examined these issues than to state that Scale AI committed wage theft or misclassification.

Why contractor classification mattered
Scale AI’s business uses people to label data, rank outputs and evaluate material used to develop AI systems. Those workers may interact with Scale AI directly or through platforms and staffing partners such as Outlier, Remotasks, Upwork or HireArt. The existence of a contractor agreement or a 1099 tax form does not, by itself, decide FLSA status.
Under the DOL’s Fact Sheet 13, the central question is economic reality: is the worker economically dependent on the business, or operating an independent business? Relevant considerations include:
- the nature and degree of the company’s control;
- the worker’s opportunity for profit or loss;
- the skill required;
- the relationship’s permanence;
- whether the work is integrated into the company’s production process; and
- the worker’s investment compared with the company’s investment.
These factors are evaluated together. A federal FLSA analysis also is not automatically the same as a state-law test, such as California’s ABC test. The legal result can depend on the worker’s location, the contracting entity and the actual working arrangement.
The DOL investigation was not the same as private lawsuits
Former Scale AI workers separately brought private claims described in reporting as involving alleged underpayment, misclassification, missing benefits or protections, and disputes over compensation for essential AI-training work. A private complaint is not a DOL finding. It follows a different procedure, may involve different parties and can continue even when an agency inquiry ends.
Earlier reporting, including coverage of overseas workers and working conditions, provides context for scrutiny of the industry’s labor model. It does not establish the scope or result of the U.S. DOL investigation. The March TechCrunch report discusses that broader context at its original article.

What “closed” means—and what it does not mean
It means: Based on the May 9, 2025 reports, the reported DOL investigation was no longer active.
It does not necessarily mean: A court ruled on every worker claim, every contractor was correctly classified, all allegations were disproved, or no private case could proceed.

The reviewed reports identify no publicly reported DOL penalty, judgment or merits finding against Scale AI. They also do not provide a public closing memorandum explaining why the inquiry ended. “Closed” or “dropped” is therefore the supportable description; “cleared,” “vindicated” or “exonerated” goes further than the available reporting.

Anyone who believes they were underpaid or misclassified can preserve evidence and obtain advice without assuming a claim will succeed. Useful steps include:
- Save records: Keep contracts, onboarding documents, pay statements, task histories, time logs, qualification or training records, messages and screenshots of rejected work or changing rates.
- Identify the parties: Note which company issued payment, controlled access to tasks and set performance rules. An intermediary may not be the same entity as the alleged employer.
- Document the reality of the work: Record scheduling requirements, supervision, restrictions on working elsewhere, permanence and who supplied equipment or software.
- Check the applicable law: Federal FLSA rules and state wage-and-hour tests can differ. Work location and the contract’s structure may matter.
- Seek qualified help: Contact a DOL Wage and Hour Division office or an employment lawyer. The DOL’s classification resources are at its misclassification page and Fact Sheet 13.
Filing a complaint does not guarantee an investigation, back pay or a particular outcome. Deadlines can apply, so delaying while records disappear can weaken a potential claim.

Bottom line for readers checking the headline
The U.S. Department of Labor did investigate Scale AI over reported FLSA issues involving pay, working conditions and worker classification. Reuters and TechCrunch reported that the investigation was closed on May 9, 2025. That closure is not a public ruling that Scale AI violated the law, and it is not a blanket judicial clearance of every worker allegation or private lawsuit.
