Temu’s De Minimis Advantage Has Been Shut Down in the U.S.—What It Means for Shoppers

The U.S. ended duty-free de minimis treatment for covered imports, pressuring Temu’s cross-border model. Here’s what the policy changes—and what it does not prove about Temu prices.

The customs rule that helped make some low-cost cross-border shopping possible in the United States is no longer available for covered imports. A broad suspension took effect on February 24, 2026, and a federal trade court upheld the authority behind it on August 13. That puts pressure on Temu’s direct-from-overseas model, but it does not mean Temu has shut down—and the available evidence does not show how much the change has affected its current prices or sales.

What was Temu’s “key to success”?

The phrase refers to the U.S. de minimis customs exemption, not an app feature or a particular product. Before the change, qualifying shipments valued at $800 or less could generally enter the United States without duties under that provision. The $800 figure describes the former rule; it is not a current duty-free allowance for covered imports. The U.S. Court of International Trade recounts that threshold in its August 13, 2026 opinion.

That treatment offered a low-cost route for some small parcels shipped directly from overseas. Removing it can increase the cost or administrative burden of importing goods, putting pressure on retailers whose prices rely on direct cross-border fulfillment. It does not establish what Temu’s actual costs or prices are today.

What changed in U.S. customs policy?

Executive Order 14388, dated February 20, 2026, continued the suspension of duty-free de minimis treatment for covered shipments. It says the exemption “shall not apply to any shipment of articles not covered by 50 U.S.C. 1702(b), regardless of value, country of origin, mode of transportation, or method of entry.” The order applies to goods entered for consumption on or after 12:01 a.m. Eastern Standard Time on February 24, 2026. There was a transition provision for international postal shipments: they were to follow a specified duty process until U.S. Customs and Border Protection’s new entry process became effective. So the effective date did not necessarily mean that every shipping channel began paying or processing duties in precisely the same way.

The court ruling and the next statutory change

On August 13, 2026, the U.S. Court of International Trade concluded that the president’s authority under the International Emergency Economic Powers Act to nullify or void a “privilege” supported rescission of the exemption in the case before it. The opinion is a significant ruling on that authority, but it is case-specific; later litigation or implementation changes remain possible. The court also recounted that Congress enacted a statutory repeal of the exemption effective July 1, 2027. These are distinct legal developments, not a reason to assume every operational detail is settled.

Why did Temu shift away from shipping from China?

In May 2025, following an earlier China-specific policy change, Temu told CBS News that it was moving U.S. sales toward local fulfillment. The company said: “Temu’s pricing for U.S. consumers remains unchanged as the platform transitions to a local fulfillment model. All sales in the U.S. are now handled by locally based sellers, with orders fulfilled from within the country.” CBS also reported that Temu’s U.S. site displayed products identified as “local,” meaning stocked in domestic warehouses, and that the company was recruiting U.S. sellers. This was a dated company statement and a reported shift in sourcing and fulfillment. It does not prove that every item was locally sourced, that all cross-border shipping permanently ended, or that the company’s current prices are unchanged. The 2026 suspension broadens the policy change beyond the earlier China-specific episode.

Could Temu prices go up?

They could face pressure, but the available sources do not establish a specific price increase or show how much of any added cost Temu would pass on to shoppers. Duties, customs entry requirements, and a move to different sourcing or fulfillment can change the economics of an imported product. A retailer might absorb costs, adjust prices, change suppliers, or combine approaches; the cited material does not say which Temu currently uses for particular products.

Axios described the end of de minimis as disrupting a business model that helped Temu and Shein sell ultra-cheap goods, and reported supply-chain changes. That is useful context for the mechanism, not a measurement of Temu’s realized costs, margins, or profitability. See Axios’s August 13, 2026 coverage.

For shoppers, the practical point is to check the item’s price and delivery terms at checkout rather than infer a company-wide increase from the policy change. The available evidence does not quantify Temu’s post-change U.S. prices, order volume, share of locally fulfilled orders, tariff pass-through, or sales impact.

How to compare online marketplace offers

A displayed price alone may not tell you where an item ships from or what to expect after purchase. When comparing a Temu listing with another retailer’s offer, check the details that determine the full shopping experience:

  • Inventory location: Is the item already stocked in the destination country, or will it cross a border?
  • Import costs: Does the checkout total include applicable duties and fees, or could charges be handled separately?
  • Delivery and returns: What delivery window is shown, and where must a return be sent?
  • Seller identity: Who is the seller, and what information and support does the marketplace provide?
  • Product controls: What safety, compliance, and listing checks apply to the item?

The sources available here do not provide a controlled, like-for-like comparison of Temu with Amazon, Shein, or domestic retailers, so they cannot support a ranking of those platforms on price or safety.

Separate scrutiny of Temu’s marketplace practices

Two enforcement actions concern different issues from U.S. customs duties and should not be treated as consequences of the de minimis suspension.

U.S. seller-disclosure settlement

In September 2025, the U.S. Department of Justice announced that a federal court had entered a stipulated order resolving allegations that Temu had not sufficiently disclosed identifying information for some high-volume third-party sellers and had not consistently provided required reporting mechanisms. Temu agreed to a $2 million civil penalty and forward-looking compliance measures. This was a settlement of allegations, not a customs penalty. See the DOJ announcement.

European Union Digital Services Act fine

In May 2026, the European Commission announced a €200 million fine under the Digital Services Act, saying Temu had failed diligently to identify, analyse, and assess systemic risks involving illegal products and related consumer harm in the EU. The Commission said evidence from its investigation indicated consumers were very likely to encounter illegal items on the platform. This EU enforcement action is separate from U.S. import policy.
