Yes—there is a real federal lawsuit over T-Mobile’s alleged price increases on older plans marketed with its “Un-contract” or price-protection promise. Oddo et al. v. T-Mobile USA, Inc., No. 2:24-cv-07719, was filed on July 12, 2024. The case was transferred from New Jersey to the Western District of Washington in August 2025.
The filing is only a proposed class action. As of August 18, 2026, no verified settlement, final judgment, class certification, or customer payout had been established in the sources available for this article. Eligibility and possible remedies depend on the exact plan, enrollment date, account history, historical advertising and terms, and any arbitration agreement.
What happened to T-Mobile customers?
Customers on older wireless plans reportedly received notices in May or June 2024 that their monthly charges would increase, commonly by $5 per line. The amount was not necessarily identical for every account; discounts, free lines, promotions, taxes, fees and later billing changes could produce different results.
The controversy centers on whether T-Mobile could raise the recurring rate for customers who believed they had a price guarantee. The proposed complaint identifies T-Mobile ONE, Simple Choice, Magenta, Magenta MAX, Magenta 55+, Magenta Amplified and Magenta Military plans among the plans at issue.

What did the Un-contract promise say?
When T-Mobile launched the Un-contract in 2015, it described a commitment that a customer’s price would not go up while the customer remained on a qualifying plan, while allowing the price to go down. The launch announcement said qualifying Simple Choice customers could keep their plans for as long as they remained customers. T-Mobile’s 2015 announcement is the company’s original public description.
The lawsuit alleges that later marketing, including T-Mobile ONE materials, conveyed a lifetime or continuing price lock. T-Mobile disputes that interpretation through the position reflected in its current FAQ.
T-Mobile’s current explanation
T-Mobile’s current Price Lock FAQ says qualifying wireless accounts activated before April 28, 2022 received the “Un-contract Promise.” It describes the remedy as payment of the customer’s final month of recurring service charges if T-Mobile raises prices and the customer leaves because of the increase after notifying T-Mobile within 60 days.

The FAQ distinguishes that program from later offerings:
| Program | Accounts or plans described by T-Mobile | Current description |
|---|---|---|
| Un-contract Promise | Qualifying accounts activated before April 28, 2022 | Final-month recurring service-charge payment if the customer leaves after a qualifying increase and follows the stated notice procedure |
| Original Price Lock | Qualifying accounts activated April 28, 2022 through January 17, 2024 | Separate terms and eligibility rules |
| Last Month Price Lock | Eligible plans activated or switched to January 18, 2024 through April 22, 2025 | Separate final-month protection described in the FAQ |
| Five-Year Price Guarantee | Eligible Experience plans beginning April 23, 2025 | Five-year guarantee under current plan terms |
The present FAQ is evidence of T-Mobile’s current position; it does not by itself decide what the company promised in 2015, 2017 or when a particular customer enrolled. The legal dispute turns on the language and context applicable to each customer, including advertisements, plan documents, account terms, notices and state law.
What lawsuit was filed?
Christopher Oddo, Harry Hyaduck Sr., Larry Kahhan and Gerald Dwyer v. T-Mobile USA, Inc. was filed in the U.S. District Court for the District of New Jersey on July 12, 2024. The complaint alleges breach of contract, breach of the implied covenant of good faith and fair dealing, unjust enrichment and violations of consumer-protection laws.
Those are plaintiffs’ allegations, not findings that T-Mobile violated the law. The proposed class seeks to cover customers whose legacy plans were subject to the alleged price increases despite Un-contract or similar price-protection representations. The complaint and contemporaneous coverage describe the 2024 notices and commonly reported $5-per-line increases, but do not establish one uniform increase for every account.

- It does not certify a class or establish compensation.
As of August 18, 2026, no verified settlement, final judgment, class-certification order or payout was established in the available sources. Check the Western District of Washington docket for later filings before relying on any online claim that the case was won or settled.
Could your account be affected?
You may have a fact pattern similar to the lawsuit if several of these circumstances apply:
- You had T-Mobile ONE, Simple Choice, Magenta, Magenta MAX, Magenta 55+, Magenta Amplified or Magenta Military service.
- Your account was activated before the relevant price-protection cutoff or was covered by historical promotional language.
- You received a May or June 2024 price-increase notice or another notice referring to a recurring rate change.
- The increase affected the recurring talk, text or data plan charge rather than only an excluded item.
- You did not accept a new plan or agreement that changed the applicable terms.
- You can identify whether you opted out of T-Mobile’s arbitration provision.
A higher total bill is not automatically a protected-rate increase. T-Mobile’s current FAQ excludes or treats separately taxes and fees, per-use charges, third-party services, device or equipment charges, some add-ons, limited-time promotions, discounts and bill credits. Compare the recurring rate-plan line item before and after the change.

What customers can do now
Preserve the account record
- Record the original enrollment date, exact plan name and rate-plan code.
- Save welcome emails, order confirmations, plan documents and historical advertising.
- Download bills from immediately before and after the increase.
- Save the price-increase email or text message.
- Keep account-history records showing migrations, plan changes, merged accounts or lost discounts.
- Retain customer-service chats and any arbitration opt-out confirmation.
- Note when you learned of the increase and, if applicable, when you canceled or switched carriers.
Ask T-Mobile for its position in writing
Ask which price-protection program T-Mobile says applies to your account, what recurring charge changed and which terms govern. If you seek the current Un-contract final-month remedy, T-Mobile’s FAQ says to notify the company within 60 days after the increase and leave because of that increase. That is T-Mobile’s stated procedure, not a court-imposed deadline for every possible legal claim.
Do not change plans casually
T-Mobile says switching plans ends the old plan’s price promotion and that you may not be able to return and restore it. Review the consequences for free lines, discounts, device credits and other benefits before accepting a migration or canceling service.
Review arbitration before filing
Consumer terms generally include individual arbitration and a class-action waiver. The applicable agreement and any valid opt-out can determine whether a customer may pursue a court claim, an individual arbitration or neither. For limitation-period and arbitration questions, consider advice from a consumer-rights attorney.
Class action, arbitration and attorney investigation are different
| Route | What it means | Does it automatically include every affected customer? |
|---|---|---|
| Proposed class action | A court case asking to represent a defined group | No. A class must be certified, and the customer must fit the certified definition. |
| Certified class | A court-approved group represented in the litigation | Only customers who meet the court-approved class definition are included. |
| Individual arbitration | A private dispute under the customer’s contract | No. It is the individual claimant’s case. |
| Mass arbitration | Coordinated individual arbitration demands involving similar facts | No. Each demand remains an individual matter. |
| Attorney investigation | Lawyers collect information to evaluate possible claims | No. An intake form does not make someone a named plaintiff or class member. |
ClassAction.org’s separate investigation describes possible mass-arbitration intake. It is not proof that a court-certified class exists and is not the same proceeding as Oddo.

- Whether the transferred lawsuit will proceed past motions or be certified as a class action.
- Whether arbitration provisions will limit claims by particular customers.
- Whether T-Mobile will settle or a court will award damages.
- Whether later price increases belong to the same legal dispute as the 2024 notices.
- Whether an individual state-law limitations period has expired.
The practical answer is evidence-driven: identify the exact recurring charge, preserve the historical promise and account documents, determine which terms and dispute-resolution clause apply, and verify the federal docket rather than assuming that a signup page or social-media post represents a court result.
