On February 26, 2026, C.C. Gong, a Menlo Ventures principal and major Suno investor, wrote that she had shifted most of her listening from Spotify to Suno. She later deleted the post. The statement could be cited to challenge Suno’s argument that AI-generated music does not replace existing music, but it is not a court finding, and the available reporting identifies no ruling that gives the post decisive weight. The reason Gong deleted it has not been established.
What Gong said—and what is known about the deletion
Gong said she was tired of Spotify repeatedly recommending the same music and had “personally shifted most of my listening to Suno.” She also argued that wider access to music creation would produce an “infinite” catalog and let listeners find music tailored to them, rather than competing only for mainstream hits.
The post was later deleted. The available facts do not establish why Gong removed it, whether Suno or anyone else asked her to do so, or whether the deletion reflected a change in her views. The deletion alone should not be treated as evidence of pressure or an admission about the lawsuit.
Why the post could matter in Suno’s copyright cases
A central issue in the litigation is whether Suno’s generated music substitutes for copyrighted music used to train its models or competes with licensed music. Suno’s fair-use and market arguments, as described in reporting and court materials, include the position that generated outputs do not substitute for the music used in training or compete with it in the relevant way.

Gong’s post offers an apparent counterexample: she described moving much of her listening from a licensed streaming service to Suno. Composer and Fairly Trained leader Ed Newton-Rex predicted, “This tweet, from Suno’s lead investor, will surely be used in court one day.” That is a commentator’s prediction, not a finding by a judge.
The post is potentially relevant because it describes a listener choosing Suno instead of Spotify for much of her listening. But one investor’s account of her own habits does not establish how typical that behavior is, whether Suno’s outputs displaced particular recordings, or whether the relevant legal market has been harmed. Nor does it by itself establish that Suno infringed copyright or that its fair-use defense fails. No ruling identified in the available reporting assigns the post decisive evidentiary weight.

Where the lawsuit stands
UMG Recordings, Inc. v. Suno is pending in the U.S. District Court for the District of Massachusetts. The case concerns allegations about Suno’s use of copyrighted recordings to train its models, along with fair-use, market-effects, discovery, and other disputed issues. Other copyright disputes and negotiations have also involved Suno.
Those claims remain part of an active legal dispute. The existence of a lawsuit, a party’s argument, or an investor’s public comment is not the same as a court ruling on infringement, fair use, or market substitution.

What Suno has said about its scale and financing
The company’s reported scale helps explain why questions about licensing, competition, and the music market matter commercially. These figures were reported in 2026 and should be understood as company announcements or press reports, not independently verified financial statements.
| Reported figure | Attribution and qualification |
|---|---|
| Two million paid subscribers | Suno figure reported in 2026 from CEO Mikey Shulman’s public announcement. |
| $300 million in annual recurring revenue | Suno figure reported in 2026 from the same CEO announcement; the reported figure is annual recurring revenue, not a statement of audited annual revenue. |
| $400 million Series D at a $5.4 billion valuation | Reported by TechCrunch in 2026. |
These figures indicate reported adoption, recurring-revenue scale, and investor interest. They do not settle whether Suno’s product replaces listening on streaming services, whether training was lawful, or how courts will assess the company’s defenses.

What changed in Suno’s training-data position
On September 9, 2026, TechCrunch reported that Suno said its v6 model was trained on licensed music and not on the data used for earlier models. That is a company statement about the later model’s training provenance, not an independent judicial finding.
The distinction matters: a claim about v6 does not, by itself, resolve allegations concerning earlier models or determine the outcome of pending claims. Training-data provenance and whether generated outputs substitute for existing music are related business and legal questions, but they are not the same question.
