Yes. The former $800 de minimis rule no longer gives covered small imports a general duty-free pass, whether they come from Shein, Temu, or another retailer. That does not mean every order has the same tariff or that a shopper will always see a separate charge at delivery: the amount and collection process depend on the merchandise, its origin, how it ships, and current customs rules.
What changed about the $800 rule?
For years, qualifying shipments valued at $800 or less could generally enter the United States without duties under the de minimis exemption. That is no longer a general protection for covered shipments. Executive Order 14388 says the exemption does not apply to covered articles “regardless of value, country of origin, mode of transportation, or method of entry.” The order took effect for goods entered for consumption on or after 12:01 a.m. Eastern Standard Time on February 24, 2026. The rule is not aimed only at Shein or Temu, and a retailer’s name does not establish where an item was made. The relevant country of origin is that of the merchandise itself. The order directs covered nonpostal shipments to be entered and assessed applicable duties, taxes, fees, and other charges.
How does the rule apply to postal and courier shipments?

CBP’s rule, published June 24, 2026, established an indefinite suspension of de minimis treatment for mail shipments and a new postal informal entry process effective July 24, 2026. The new process allows applicable duties to be collected through postal entry. Read CBP’s rule.

In February, the administration announced a temporary 10% ad valorem import surcharge for 150 days. That was a temporary policy parameter, not a universal, ongoing postal rate: the executive order tied the interim postal duty arrangement to the surcharge’s end or the start of the new postal entry process, whichever came first. Because CBP’s process took effect July 24, do not use the earlier 10% interim postal figure to estimate a current mailed order. See the White House fact sheet.
Courier and other nonpostal shipments
For nonpostal shipments, the February order calls for an appropriate Automated Commercial Environment entry filed by a qualified party. CBP explains that low-value nonpostal shipments had used entry type 11; the new postal process is distinct from that nonpostal entry route. The carrier, seller, or another qualified party may handle the required entry, but who collects a charge from a particular shopper depends on the order and shipping terms. How much could a Shein or Temu order cost in duties?
There is no single rate that can be applied to every small online order. The amount depends on factors including the item’s tariff classification, its country of origin, the shipping channel, and any applicable exceptions or other duties. The USITC’s 2026 HTS Revision 4 is the current tariff schedule reference identified here, but the retailer name or order total alone is not enough to calculate a specific parcel’s charge.
Nor does the policy establish a universal checkout practice for Shein or Temu. Check the order’s checkout details and shipping terms to see whether any import costs are included or may be collected separately. For a parcel already in transit or a precise estimate, check current CBP guidance and the carrier’s shipment-specific information.

Are any goods exempt?
Some statutory exclusions and product-category exceptions remain, but they are limited and do not create a general apparel exemption. The executive order excludes articles covered by 50 U.S.C. 1702(b). The White House fact sheet also lists categories excluded from the separate temporary surcharge, including certain minerals, energy products, agricultural goods, pharmaceuticals, electronics, vehicles, aerospace products, informational materials such as books, donations, and accompanied baggage. These surcharge exclusions should not be mistaken for a broad exemption from the de minimis suspension; whether an exception applies depends on the specific legal provision and goods.

- Item and origin: Look for the actual product and its country of origin; do not infer origin from the retailer’s name.
- Shipping method: Determine whether the parcel will arrive by international mail or a courier/nonpostal route, since the entry processes differ.
- Order terms: Review checkout and shipping information for any disclosed import charges and who may collect them.
- Current guidance: Confirm shipment-specific details with the carrier and consult CBP and the current tariff schedule, since import rules and rates can change.
CBP’s help page titled “What happens if my mailed goods require duty?” may describe an earlier postal process, so use the newer June 2026 rule for the process effective July 24, 2026.
