The Senate passed the TikTok divestiture measure on April 23, 2024, by a 79–18 vote. It was not the earlier standalone TikTok bill: the provision was attached to H.R. 815, a broader foreign-aid and national-security package. President Joe Biden signed the package on April 24, creating a 270-day deadline for ByteDance to complete a legally qualifying divestiture, with a possible one-time 90-day extension.
The law did not make it a crime for users to keep or view TikTok. Instead, it threatened restrictions on app-store distribution, updates, maintenance and hosting if ByteDance remained in control. The Supreme Court upheld the law on January 17, 2025, while later executive actions delayed enforcement and described a proposed U.S.-controlled joint venture whose final legal status requires separate confirmation.

What exactly did the Senate pass?
The Senate approved the TikTok provision as part of H.R. 815, a package that also provided aid for Ukraine, Israel and other U.S. allies. The measure became the Protecting Americans from Foreign Adversary Controlled Applications Act. It was different from H.R. 7521, the earlier House bill that had proposed a shorter divestiture period for TikTok.
The Senate vote was 79–18 on April 23, 2024. Biden signed the package the following day. That distinction matters: Congress did not simply pass a free-standing, immediate TikTok ban. It enacted a conditional mechanism tied to ownership and control of the application.
Was TikTok banned immediately?
No. The statute created a sell-or-face-restrictions structure. It made it unlawful for covered companies to support a covered application in the United States unless there was a “qualified divestiture.” The relevant restrictions include:
- Distribution through an app store or other application marketplace;
- Internet hosting that enables the application to operate or be distributed;
- Maintenance and updates for the application.
Those restrictions could eventually make TikTok disappear from U.S. app stores and become unreliable or unavailable as hosting and updates stopped. But the law did not make ordinary possession or viewing of the app a crime. The operative text is in 15 U.S.C. chapter 123.
Why existing users and new users could have different experiences
A person who already had TikTok installed could temporarily retain access even if an app store stopped offering new downloads. Over time, however, the inability to receive updates or obtain hosting support could affect functionality. New users could lose the ability to download the app in the first place.
What were ByteDance’s deadlines?

What would count as a qualifying sale?
The law required more than putting TikTok in a new U.S. corporate shell. A qualifying divestiture had to remove control of the application from a foreign adversary and end prohibited operational relationships with the former owner.
Ownership and control
The former foreign-adversary owner could not retain control over the U.S. application. A transaction that left ByteDance with meaningful control could fail the statutory test even if a U.S. investor appeared on the ownership documents.
The recommendation algorithm
The statute treated operational cooperation involving TikTok’s recommendation algorithm as central. A buyer would need a legally acceptable way to operate recommendation technology without prohibited continuing control or cooperation from ByteDance.

Data-sharing and operational ties
The arrangement also had to address data-sharing relationships and other operational links. That is why a sale of trademarks, servers or a U.S. subsidiary alone would not necessarily satisfy the law.
Why did Congress target TikTok?
Lawmakers and executive-branch officials framed the measure as a national-security response to foreign-adversary control of a major communications platform. Their stated concerns included potential access to U.S. user data, influence over recommendations, pressure that Chinese authorities might exert on ByteDance, and covert foreign influence through the platform.

Those are government and congressional rationales, not findings that every allegation was independently proven in the public record. TikTok and ByteDance denied that the company posed the claimed security threat and argued that the law burdened users’ speech and expressive activity. What did TikTok, ByteDance and users argue in court?
- The law effectively singled out TikTok;
- It burdened the speech and expression of millions of users;
- A forced divestiture could be impractical without transferring or recreating ByteDance’s recommendation technology;
- The government’s national-security justification was not sufficiently connected to the restrictions imposed;
- The statute violated the First Amendment.

What did the Supreme Court decide?
On January 17, 2025, the Supreme Court upheld the law against TikTok, ByteDance and user challengers in the case before it. The Court characterized the statute as addressing foreign-adversary control of the platform rather than directly regulating the subject matter of users’ speech. The opinion is available as TikTok Inc. v. Garland; the case history is in the Court’s docket.
That decision upheld this statute against the claims presented. It should not be read as deciding every possible future constitutional dispute involving a later transaction, a different enforcement action or a different party.

The legal rule and its practical enforcement did not move in lockstep. After the effective date, the executive branch issued several actions delaying enforcement, including actions on January 20, April 4, June 19 and September 16, 2025. The September 2025 proposed structure
Executive Order 14352, published September 30, 2025, described a proposed U.S.-based joint venture. Under the framework described there, U.S. persons would hold majority ownership and control, while ByteDance and its affiliates would hold less than 20%. The order said the structure was intended to eliminate foreign-adversary control and restrict prohibited relationships involving the algorithm and data.
A proposed framework is not the same as a confirmed closing or a statutory certification. As of the latest official material identified for this article, readers should verify separately whether the transaction formally closed, whether the president made the required qualified-divestiture determination, whether ByteDance retained any algorithmic or operational relationship, whether enforcement delays continued after December 16, 2025, and whether Congress or a later administration changed the law. It is therefore not accurate to state without current official confirmation that TikTok was definitively sold or that the law was permanently canceled.
What this means for users, creators and small businesses
Users
Users were not the entities directly targeted by the statute. App stores, marketplaces and hosting providers faced the direct restrictions. Nevertheless, users could be affected through blocked downloads, missing updates, degraded service or a loss of hosting support.
Creators
A creator whose audience, sponsorships or income depended on TikTok faced platform-concentration risk even while enforcement was delayed. Maintaining contact points and publishing channels elsewhere can reduce the damage from a sudden loss of access, without assuming that any particular alternative platform will reproduce TikTok’s audience or monetization.
Advertisers and small businesses
Businesses relying on TikTok campaigns, storefront links or creator partnerships should treat legal and enforcement developments separately from ordinary advertising performance. Keep copies of creative assets, customer contacts and transaction records outside the platform, and make sure campaigns can be paused or redirected if distribution or hosting rules change.

The phrase is shorthand for a law that uses app-store and hosting restrictions to pressure a divestiture. It does not describe an instant criminal prohibition on users, and it does not mean that any ownership change automatically qualifies. The algorithm, data-sharing arrangements and continuing operational control are part of the legal question.
The Bottom Line
The Senate’s April 23, 2024 vote created a conditional divestiture law, not an immediate user ban. ByteDance received 270 days, potentially extended by 90 days, to complete a sale that removed foreign-adversary control and prohibited operational ties. The Supreme Court upheld the law, while later executive actions delayed enforcement and described a proposed U.S.-controlled structure whose final status must be confirmed from current official records.
