Rolling Stone owner Penske Media sues Google over AI summaries

Penske Media’s lawsuit argues that Google uses search dominance to obtain publisher content for AI Overviews and AI Mode. Here is what the antitrust case alleges, what Google says and where it stands.

Penske Media Corporation (PMC) and affiliated publishers sued Google LLC and Alphabet Inc. on September 12, 2025, alleging that Google uses journalism in AI Overviews and AI Mode while exploiting its dominant search position to pressure publishers into permitting that use. Google denies the allegations and says its AI features improve Search and help users discover more websites.

The case, Penske Media Corporation et al. v. Google LLC et al., No. 1:25-cv-03192, is pending in the U.S. District Court for the District of Columbia before Judge Amit P. Mehta. The latest publicly indexed docket entry located here is Google’s March 5, 2026 reply supporting dismissal of PMC’s amended complaint; no merits ruling or final disposition was identified in that docket material.

Who brought the lawsuit?

PMC is the parent company associated with Rolling Stone and other media brands. The original filing named PMC and these publishing entities as plaintiffs:

What are AI Overviews and AI Mode?

AI Overviews

AI Overviews place an automatically generated summary above or alongside conventional search results. They can include links, but the summary may answer an informational question before a user visits a source.

AI Mode

AI Mode provides a more expansive, conversational response to a query. Penske’s complaint describes both products as drawing on information from publisher articles and alleges that Google can satisfy a user’s information need on its own results page.

Those are allegations, not a finding that every generated answer reproduces protected expression or omits links. The complaint’s broader point is that summarizing or paraphrasing reporting may reduce the need to click through, while the material is also used to improve or train Google’s AI systems.

  1. Publishers allow Google to crawl and index their pages.
  2. Google displays links in response to queries.
  3. Users visit publisher sites, where visits can produce advertising, subscriptions, affiliate-commerce and repeat-audience revenue.
  4. Google benefits from a broad index and search advertising.

The complaint argues that AI answers change that arrangement by using indexed material to answer questions directly in Google’s interface. This is PMC’s economic and competitive framing, not an adjudicated description of the internet’s legal rules.

The alleged coercion and antitrust theory

Penske’s central theory is that publishers cannot meaningfully refuse AI use while remaining visible in Google Search. The complaint alleges that Google controls a dominant general-search distribution channel and conditions, or effectively pressures, continued indexing and visibility on making content available for AI-related uses.

Under that theory, blocking Google’s access could cost a publisher substantial search traffic. The choice would therefore resemble an ultimatum—permit the use or risk losing access to the dominant search ecosystem—rather than a voluntary license negotiation.

That is an antitrust theory involving alleged tying, monopolization and exclusionary conduct. It asks whether Google is using power in search to obtain participation in a separate generative-AI product, not simply whether an individual summary is accurate or whether a particular passage infringes copyright.

What harm does Penske allege?

The complaint says AI-generated answers can reduce the visits on which publishers depend for:

  • Display-ad impressions;
  • Subscription conversions;
  • Affiliate-commerce revenue, including links in product-review coverage;
  • Audience growth and repeat readership; and
  • Funding for original reporting.

Penske connects declines in traffic and revenue to the rollout of AI Overviews. That remains an allegation. Traffic can also change because of search-algorithm updates, seasonality, social and direct traffic, audience behavior, brand changes, device mix, geography and query type. The publicly available materials do not establish a specific percentage loss caused by AI Overviews.

Is this a copyright lawsuit?

Not primarily. The original complaint lists Sherman Act claims involving restraint of trade, monopolization and attempted monopolization, plus a common-law unjust-enrichment claim. It discusses Google’s alleged copying, republication and AI-training use of publisher material as facts supporting the competitive theory, but it does not appear to plead a standalone copyright-infringement count.

That distinction matters. The case is not simply “Rolling Stone says Google stole its articles.” PMC alleges that Google’s use of publisher content in AI products is part of an unlawful strategy tied to Google’s search position. Because PMC filed an amended complaint on December 4, 2025, the amended pleading is operative; the original complaint’s counts should not automatically be treated as the final set of claims.

Examples described in the complaint

The complaint gives examples involving material from Rolling Stone, The Hollywood Reporter, Deadline and other PMC publications. It alleges that Google’s answer formats can present information from those articles in a way that makes the original visit less necessary and that source links may be less prominent or require additional interaction.

These examples are allegations about particular presentations and queries. An AI Overview may cite several sources, and a link can appear even when a user receives a substantial answer before clicking. Effects can therefore differ by article, query, device, location and search position.

Google’s response

A Google spokesperson told TechCrunch that AI Overviews make Search more useful, send traffic to a broader range of sites and create new discovery opportunities. Google also said it sends billions of clicks to websites across the web and intends to defend the case.

In its January 12, 2026 motion to dismiss the amended complaint, Google argued—according to available legal coverage—that PMC is recasting a lawful refusal-to-deal or product-improvement dispute as an antitrust violation and has not pleaded legally sufficient claims. Google sought dismissal with prejudice. A motion to dismiss tests the adequacy of the pleadings; it does not establish that Google’s factual account is correct. Procedural timeline

Date Event

December 5, 2025 The court denied the first dismissal motion as moot because the amended complaint became operative.

March 5, 2026 Google filed its reply.

The docket material located for this article ends with the March 5 reply. It does not show a dismissal, settlement or merits decision. Later filings should be checked in the court’s current docket or PACER before treating that date as the complete status.

Why the case matters beyond PMC

  • Search and AI boundaries: A ruling could address whether ordinary indexing and generative-answer use are legally separable products.
  • Publisher control: The case tests whether an opt-out is meaningful if refusing AI access risks search visibility.
  • Digital publishing economics: Direct answers may improve convenience but reduce the referral value that supports advertising, subscriptions and affiliate commerce.
  • Licensing negotiations: The litigation could influence future deals between AI companies and media organizations.
  • Market definition: The court may have to consider whether the relevant market is general search, search referrals, digital advertising, AI answers or an overlap among them.
  • Remedies: If PMC ultimately prevails, possible remedies could include an opt-out mechanism, separation of indexing from AI use, licensing requirements, behavioral restrictions or damages. The lawsuit itself does not predict which, if any, remedy would be ordered.

What the lawsuit does not establish

  • No court has found Google liable.
  • The filing does not automatically establish copyright infringement.
  • It does not show that every AI Overview reduces traffic or that every answer lacks attribution.
  • It does not prove that reported traffic declines were caused specifically by AI Overviews rather than other changes.
  • It does not mean Rolling Stone alone sued; PMC and numerous affiliated corporate publishers are plaintiffs.

The Bottom Line

Penske’s case is an antitrust challenge to the way Google allegedly combines search dominance with AI answer products. Its outcome will turn on market power, the practical ability to refuse AI use, competitive harm and causation—not simply on whether Google’s summaries contain publisher information.
