Razer Wins US$6.5 Million Judgment Against Capgemini Over Data Leak

Razer (Asia-Pacific) Pte Ltd won a Singapore High Court judgment requiring IT consultant Capgemini Singapore Pte Ltd to pay US$6,518,738.81 after a misconfigured server exposed non-public customer information. The December 9, 2022 award covered lost Razer.com profits and specified legal, forensic and bug-bounty expenses; it was a civil commercial judgment, not a criminal case, regulatory fine or payment to affected customers.

What the Singapore court decided

In Razer (Asia-Pacific) Pte Ltd v Capgemini Singapore Pte Ltd, Suit No. 1233 of 2020, the General Division of the High Court of Singapore found Capgemini liable for breach of contract and, alternatively, negligence. The merits judgment, [2022] SGHC 310, was issued on December 9, 2022.

The case concerned the commercial relationship between Razer and its IT vendor, including contractual and data-processing obligations. It was not a prosecution for hacking, a class action brought for customers, or a claim under which the court awarded compensation directly to people whose information was exposed.

How the customer-data exposure came to light

The judgment describes a server-file misconfiguration that left a Razer database or related Kibana application publicly accessible without authentication. The information at issue included non-public customer details, email addresses and order information. The evidence does not justify saying that payment-card data, passwords or encryption keys were definitely exposed, or that every exposed record was downloaded.

Security researcher Bob Diachenko contacted Razer on August 19, 2020, to report an unprotected database instance. The incident became public around September 10, 2020, after a LinkedIn article disclosed it. Those dates mark different stages: the initial report to Razer, later public disclosure, and, more than two years afterward, the court’s judgment.

What the US$6.5 million award covered

The court’s listed damages total US$6,518,738.81. The largest item was lost profit from Razer.com sales; the remaining items were specific incident-response expenses.

Contemporary coverage rounded the award to US$6.5 million and reported it as approximately S$8.7 million at the time; that Singapore-dollar amount is a conversion, not a separate fixed figure in the judgment. The judgment awarded damages—it does not by itself establish that Razer had already collected the money. The component amounts and findings appear in the judgment text; The Straits Times’ contemporaneous report gives the rounded Singapore-dollar conversion.

How the lost-profit figure was calculated

The court accepted Razer’s expert-calculated lost-profit evidence for a period from September 10 through December 31, 2020. The calculation attributed US$3,159,224 to gaming systems and US$2,976,888 to non-gaming systems or gaming peripherals, using Razer’s stated profit margins. The judgment noted that Razer’s revenue had returned to the “but-for” level by February 2021.

This was not a count of customers shown individually to have left because of the leak. It was a damages calculation based on the evidence and loss period accepted in this case. A company seeking similar lost-profit damages would need to establish causation and support its figures, rather than assume that sales changes after a security incident are automatically recoverable.

What Razer claimed but did not recover

The final award did not include the nominal amounts Razer sought for an alleged loss connected with rejection of a digital-bank licence application or for management and staff time diverted to the incident. The court therefore did not accept every claimed consequence as an item of recoverable damages.

Contemporary reporting said Razer had sued for nearly S$10 million, or at least approximately US$7 million. That was the broader claim, not the amount awarded. The judgment’s listed components sum to US$6,518,738.81.

Why the ruling matters to companies that outsource IT

The decision shows how a security failure can become a substantial commercial claim when contractual duties, the vendor’s role, causation and documented losses are all relevant. Capgemini was not held liable simply because it was an IT company associated with an incident: the court examined the obligations and evidence in this particular relationship. The ruling does not make every consultant or cloud provider automatically liable for every data breach.

It also illustrates that breach-related damages can be primarily business losses rather than regulatory penalties or consumer payouts. Here, lost e-commerce profits made up most of the award, while legal, forensic and vulnerability-reporting expenses accounted for the balance.

Practical controls for businesses using IT vendors

The case is a useful prompt to make security responsibilities and evidence requirements explicit before an incident occurs. Companies can review the following areas:

  • Configuration ownership: Assign responsibility for server, database and application access controls, including who reviews changes and how those reviews are recorded.
  • Exposure detection: Monitor for publicly accessible data stores and establish a process to determine quickly what was exposed and for how long.
  • Vulnerability reporting: Maintain a monitored disclosure channel and ensure that reports reaching the wrong team or address are routed promptly to security staff.
  • Vendor contracts: Specify incident notification, investigation cooperation, audit rights, access to forensic evidence and responsibility for security tasks. Define the vendor’s role for each relevant jurisdiction rather than relying on a generic label.
  • Loss documentation: Keep incident-related legal, regulatory, forensic and remediation costs distinct, and preserve the sales and margin data needed to substantiate any lost-profit claim.

Related costs decision and limits of the available record

A later decision, [2023] SGHC 195, dated July 19, 2023, dealt with costs and the specificity required for a claim for indemnity costs. It was a procedural costs ruling, not a new decision changing the merits award.

The judgment discussed here is the Singapore High Court’s December 2022 ruling. The available materials do not establish a later appellate decision overturning or materially changing it, nor do they establish whether the award was fully paid. They also do not establish a precise affected-customer count.
