PubMatic filed a private antitrust lawsuit against Google on September 8, 2025, alleging that Google monopolized key open-web digital-advertising markets. The complaint seeks damages, possible treble damages, declaratory relief and injunctions. The case is now part of multidistrict litigation in the U.S. District Court for the Southern District of New York, where it remains in pretrial proceedings.
What PubMatic filed
PubMatic, Inc. originally sued Google LLC in the U.S. District Court for the Eastern District of Virginia (case No. 1:25-cv-01482). The company alleges that Google used control over several parts of the advertising-technology stack to exclude independent competitors and harm PubMatic’s growth, revenue and market position.
The original complaint sought monetary damages, potentially trebled under U.S. antitrust law, plus declaratory and injunctive relief. PubMatic also demanded a jury trial. The later consolidated proceedings identify Alphabet Inc. and Google LLC as defendants. The complaint and amended complaint are available from PubMatic and the company’s amended filing.
The ad-tech markets at issue
PubMatic’s allegations concern open-web display advertising rather than every Google advertising product. In simplified form, the market works through several connected layers:

- Publisher ad server: Software a website publisher uses to manage available ad space and decide which ad is served.
- Ad exchange: A marketplace where buyers and sellers transact individual advertising impressions.
- Supply-side platform (SSP): Technology that helps publishers offer inventory to potential buyers.
- Demand-side platform (DSP): Technology advertisers and agencies use to buy that inventory.
- Open-web display advertising: Display ads on independent websites and other publisher environments, excluding much of Google’s owned-and-operated inventory.
The complaint specifically identifies the publisher ad-server and ad-exchange markets for open-web display advertising. PubMatic says Google’s presence across multiple layers gave it opportunities to favor its own services over independent exchanges and SSPs.
What PubMatic alleges
These are allegations in PubMatic’s private case, not final findings against Google. According to the complaint, Google:
- acquired and maintained monopoly power in relevant ad-tech markets;
- tied or conditioned access among parts of its advertising stack;
- favored its AdX exchange in auctions;
- used control of publisher ad-serving software to steer transactions toward AdX;
- imposed auction rules or other policies that limited independent exchanges and SSPs; and
- used market data and vertical integration to disadvantage rivals.
PubMatic claims the practices constrained its ability to compete and reduced its growth, revenue and market share. Google has not been found liable to PubMatic in this private action.

How the case relates to the DOJ litigation
The U.S. Department of Justice and a coalition of states brought a separate government case, United States v. Google LLC, No. 1:23-cv-00108, in the Eastern District of Virginia. In April 2025, Judge Leonie Brinkema found that Google had willfully engaged in anticompetitive conduct to acquire and maintain monopoly power in the publisher ad-server and ad-exchange markets for open-web display advertising. PubMatic still must establish that it suffered legally recoverable antitrust injury, that Google’s conduct caused the injury, the amount of damages and its entitlement to any injunction. The government case and the private case also seek different outcomes: public enforcement remedies on one track and compensation, plus possible private relief, on the other.

PubMatic says potential awardable damages, after possible trebling, could reach billions of dollars. That figure is the company’s litigation estimate; no amount has been validated or awarded by a court, and PubMatic has not set a final dollar demand.

Where the lawsuit stands as of August 18, 2026
The Judicial Panel on Multidistrict Litigation transferred the action to the Southern District of New York on December 18, 2025, for coordinated pretrial proceedings in In re Google Digital Advertising Antitrust Litigation, No. 1:21-md-3010. PubMatic and other competitors filed consolidated amended pleadings in early 2026.

The latest publicly available docket information located for this article was retrieved June 26, 2026. It showed no ruling on Google’s motion to dismiss. The current SDNY record is No. 1:25-cv-10819, within the MDL. The docket groups PubMatic with competitor actions involving companies including OpenX, Magnite, Index Exchange, Kargo, Equativ, Sharethrough, Sovrn and TRUSTX.
What the motion to dismiss means
A motion to dismiss tests whether the complaint, assuming its well-pleaded facts are true for that stage, states legally sufficient claims. It is not a trial and does not decide whether PubMatic’s allegations are true. The briefing schedule confirms that Google asked the court to dismiss the consolidated competitor complaints, but the docket summary alone does not establish that any of Google’s arguments will succeed.

If the case survives, the parties move through fact discovery, expert analysis and damages calculations. The court could later consider summary judgment. Settlement discussions can occur at any point; a trial would require the claims to survive those earlier stages.

PubMatic says normal customer operations and integrations continue and that the lawsuit does not immediately interrupt transactions. A private complaint therefore does not by itself change how publishers sell inventory or how advertisers buy it.

- which ad servers and exchanges publishers can use;
- auction rules, fees and revenue shares;
- interoperability between independent platforms;
- access to bidding and transaction data; and
- the transparency and competitive choices available to buyers and sellers.
Those consequences depend on later rulings or negotiated remedies. The lawsuit does not automatically break up Google, pay publishers, or guarantee PubMatic compensation.
Bottom line
PubMatic’s lawsuit is a real private antitrust action filed in 2025 and now proceeding in the Southern District of New York’s Google ad-tech MDL. It builds on important DOJ findings about Google’s conduct in specific open-web ad-tech markets, but PubMatic still has to prove its own injury, causation and damages. As of the latest docket information available, the case was awaiting a ruling on Google’s motion to dismiss and was scheduled for discovery through 2027.
