No Tax on Tips? What Trump’s Promise Means Under Federal Tax Law

Federal law allows eligible workers to deduct up to $25,000 in qualified tips annually for tax years 2025–2028. Occupation, income, filing, and reporting rules apply.

“No taxes on tips” is not a blanket exemption. Federal law enacted a temporary deduction for qualifying tips on tax returns for 2025 through 2028. Eligible workers may deduct up to $25,000 a year, but occupation, income, filing, reporting, and other rules apply. The deduction can reduce federal income tax; it does not guarantee that a worker owes no tax or gets a particular refund.

What “no tax on tips” means

The One Big Beautiful Bill Act, Public Law 119-21, created a federal income-tax deduction for qualified tips received in tax years beginning after December 31, 2024, and before January 1, 2029. The first returns to claim it are 2025 federal income-tax returns.

A deduction reduces the income subject to tax; it is not a tax credit that directly subtracts a set amount from a tax bill. The law therefore does not make every tip tax-free, eliminate every tax a worker may owe, or promise a refund. The size of any benefit depends on the taxpayer’s circumstances and tax liability.

Who may qualify for the deduction?

The IRS lists more than 70 qualifying tipped occupations in its [IRS taxpayer overview] and April 2026 [final-regulation announcement]. A worker should check the list and final rules for their specific job rather than assume that any job involving tips qualifies.

Tips that may count

The IRS describes qualified tips as voluntary cash or charged tips received from customers, including tips allocated through tip sharing. The worker must be in a qualifying occupation and meet the reporting rules. Whether a payment counts depends on the law and regulations, not simply on whether someone calls it a tip.

Income, filing, and self-employment limits

  • The maximum annual deduction is $25,000.
  • The deduction phases out when modified adjusted gross income exceeds $150,000, or $300,000 for married taxpayers filing jointly.
  • A married taxpayer must file jointly to claim the deduction, and a valid Social Security number is required.
  • For a self-employed worker, the deduction cannot exceed net income, before this deduction, from the business where the tips were earned.

These are federal rules. State tax treatment may differ; the available guidance does not establish how every state conforms to the federal change.

How to claim it on a 2025 return

  1. Check eligibility. Confirm that your occupation and tips meet the IRS requirements, and review the applicable income, filing-status, Social Security number, and self-employment limits.
  2. Gather supporting records. For 2025, W-2s and several 1099 forms were not changed to report qualified tips separately. IRS [Notice 2025-69] provides transition guidance on determining and documenting the amount. Records may include earnings statements, receipts, point-of-sale reports, daily tip logs, and third-party settlement records. Keep support for both the amount and why the tips qualify.
  3. Meet the reporting requirement. Tips must be reported through an eligible information return or reported by the taxpayer on Form 4137.
  4. Complete Schedule 1-A. Claim the deduction on Schedule 1-A attached to Form 1040, 1040-SR, or 1040-NR. It is available whether you itemize or take the standard deduction. Follow the current [IRS Schedule 1-A guidance] and applicable form instructions.

If you already filed a 2025 return, the IRS says you may amend it to claim or change the deduction by following its [amended-return guidance] for Form 1040-X.

Pros and cons to weigh

Potential advantage Limit or trade-off
Qualifying workers may reduce the income subject to federal income tax. It is a deduction, not a dollar-for-dollar credit, so its value depends on taxable income and tax liability. Someone with little or no federal income-tax liability may get little or no additional benefit.
Both standard-deduction filers and itemizers may claim it. Occupation, tip, reporting, income, filing-status, and other requirements limit who qualifies.
The IRS list covers a broad range of tipped occupations. A job is not eligible merely because workers receive tips; consult the occupation list and final regulations for the specific role.
The deduction can apply to qualifying tips earned in each covered tax year. It is capped at $25,000 annually, phases out above the stated income thresholds, and is scheduled to end after tax year 2028.
Workers who meet the requirements can claim it on a federal return. For 2025, relevant information forms did not all separately identify qualified tips, making good records important when determining and supporting the amount.

The law’s broader fiscal effect is separate from any individual worker’s savings. The Joint Committee on Taxation estimated a federal revenue reduction of about $30.8 billion over fiscal years 2026–2029, as reported by the Tax Policy Center in August 2026. That estimate is not a forecast of an individual’s benefit.

What the law does—and does not—settle

The IRS issued final regulations in April 2026 to implement the deduction. IRS Chief Executive Officer Frank J. Bisignano said in the announcement: “Given the wide variety of workers who receive tips, these final regulations help implement an important tax benefit for American workers.” For a particular return, the controlling statute, current IRS forms and instructions, final regulations, and the taxpayer’s records govern.
