Microsoft’s $242 Million Cortana Patent Verdict: What the Jury Decided

On May 10, 2024, a federal jury in Delaware found Microsoft liable for infringing an IPA Technologies patent through specific Cortana software and awarded IPA $242 million. That was a jury award—not, by itself, proof that Microsoft paid the money or that the amount became a final judgment. Microsoft challenged the verdict and said it planned to appeal.

What the jury decided

The case was IPA Technologies Inc. v. Microsoft Corporation, in the U.S. District Court for the District of Delaware. IPA sued in January 2018. At trial, the dispute centered on U.S. Patent No. 7,069,560, known as the ’560 patent. The jury found infringement and rejected Microsoft’s invalidity arguments, then awarded IPA $242 million. The court’s case page and the announcement by IPA’s attorneys identify the case and verdict.

“Awarded” matters: a jury verdict is distinct from a final judgment, and a judgment is distinct from proof of payment. Microsoft denied infringement and challenged the result. The available record described here does not establish that Microsoft ultimately paid the full $242 million, so the verdict should not be presented as a confirmed payment.

What the patent covered—and which Cortana systems were at issue

The ’560 patent concerned software architecture for cooperative task completion by flexible, autonomous electronic agents. In practical terms, the dispute was about how software components could work together to handle tasks and user requests—not simply about recognizing spoken words. The district court’s April 25, 2024 opinion describes the accused Cortana implementations and systems.

The court identified two Cortana software iterations, called the Legacy Architecture and the Cortex Architecture. The accused systems included Cortana embedded on Windows 10 client devices and Microsoft server systems that processed Cortana requests. The verdict concerned the particular architectures and patent claims litigated; it does not establish that every product carrying the Cortana name, or every Microsoft voice-assistant product, infringed.

How the case narrowed before trial

  • On April 25, 2024, the court granted Microsoft summary judgment of non-infringement on the asserted claims of a separate patent, U.S. Patent No. 6,851,115, commonly called the ’115 patent.
  • In an April 29, 2024 order, the court identified claims 50, 53, and 54 of the ’560 patent as the only remaining asserted claims.
  • The ’560 patent claims went to the jury, which returned its verdict on May 10.

Why Siri came up in a Cortana case

The patent portfolio had a development history connected to SRI International and technology later associated with Siri; IPA acquired the portfolio in 2016. Siri’s commercial success arose in arguments about whether that success was connected to the patent claims. In its April 29 order, the court declined to bar IPA from making that argument.

That connection does not mean Microsoft was sued for copying Apple’s Siri, or that the jury found Cortana copied Siri. The case was about whether the specific Cortana systems infringed the asserted patent claims. The court’s order addresses the Siri-related argument.

What the $242 million figure does—and does not—tell you

The amount was the jury’s damages award based on IPA’s trial case. It should not be recast as a recurring royalty, statutory penalty, or confirmed cash payment: those descriptions are not established by the verdict information summarized here. Microsoft disputed infringement and challenged the damages presentation, including the expert testimony behind it. Bloomberg Law reported on Microsoft’s post-trial effort to overturn or reduce the award.

For readers assessing the financial significance, the careful distinction is between the headline verdict and the eventual amount, if any, Microsoft was required to pay after post-trial motions, appeal, or other resolution. The patent had expired before the verdict

Contemporary reporting said the ’560 patent expired in January 2019, more than five years before the verdict. Expiration generally ends the patent owner’s ability to claim damages for infringement occurring after expiration; it does not necessarily erase a claim for infringement while the patent was in force. The jury’s 2024 decision therefore concerned alleged historical conduct, not a new patent right created by the verdict. Reuters reported the expiration date and Microsoft’s stated position after the verdict.

Does the verdict affect Cortana users?

The case was a dispute between IPA and Microsoft over historical software architectures. The sources cited here do not indicate that the verdict required Cortana users to pay anything or change their Windows installations. It also does not establish that the lawsuit caused any Cortana product-support decision.

What happened after the verdict?

Microsoft sought post-trial relief and said it intended to appeal. A jury verdict alone does not settle what happened afterward: the final amount can depend on the court’s judgment and any later proceedings.
