Microsoft and the Cloud Infrastructure Services Providers in Europe (CISPE) reached a private settlement on July 11, 2024, resolving CISPE’s European Commission complaint on agreed terms. The complaint alleged that Microsoft licensing made it harder or more expensive for independent cloud providers to host Windows and SQL Server than for Azure. The settlement offered eligible European providers new licensing and technical options, but it was not an EU finding of wrongdoing and did not give every cloud provider Azure-equivalent terms.
Implementation then changed. CISPE’s monitoring reported in May 2025 that the original Azure Local product approach had not delivered the full planned feature set. On July 18, 2025, Microsoft and CISPE announced a follow-on arrangement using the CSP-Hoster channel for qualified members, including pay-as-you-go Windows Server and SQL Server. The result is a significant, monitored concession for some European providers—not a universal end to Microsoft cloud-competition concerns.
What CISPE alleged about Microsoft licensing
CISPE represents European cloud infrastructure providers. It argued that Microsoft’s licensing and pricing rules disadvantaged clouds competing with Azure. In its complaint, CISPE said customers running Microsoft software on independent infrastructure could face higher costs, virtualization restrictions and less choice.
CISPE also published an advocacy claim that restrictions on multi-session Microsoft software outside Azure could force a provider to use 32 virtual machines instead of four for an equivalent user base. That figure comes from CISPE’s submission, not an independent regulatory finding. The competition theory was a possible “raising rivals’ costs” effect: Microsoft could use its position in operating-system and database software to make competing cloud infrastructure less attractive while favouring Azure. The settlement did not decide that theory as a matter of EU law.
How the dispute developed

What Microsoft promised in 2024
The 2024 memorandum focused on an enhanced Azure Stack HCI product for European hosters, later discussed in ECCO material under the Azure Local name. The intended remedy included:
- multi-tenant operation for independent providers;
- Windows 11 multi-session virtual desktop infrastructure;
- support for Microsoft workloads on providers’ own European infrastructure;
- pay-as-you-go SQL Server licensing; and
- free Extended Security Updates.
The plan was meant to help providers offer local or sovereign services while retaining Microsoft workload compatibility. Microsoft also agreed to contribute a lump sum toward CISPE’s litigation and campaign costs; the public announcement does not establish a precise amount.

ECCO’s second report later said the initial product approach did not provide the full planned feature set and that the parties were moving to existing programmes or other commercially equivalent solutions. That qualification matters: the original Azure Stack HCI promise should not be described as a complete, successful product launch. See the May 2025 ECCO report.
What the July 2025 agreement changed
The follow-on agreement shifted the centre of gravity from a new product to licensing and channel access. Qualified CISPE members could offer Microsoft software through the CSP-Hoster programme on a pay-as-you-go basis. CISPE’s announcement specifically named Windows Server and SQL Server, with pricing intended to be comparable to Azure.
“Comparable to Azure” is not a promise of identical prices, margins, support or technical capability. A provider’s infrastructure, staffing, storage, networking, backup and egress charges can make the total bill very different from an Azure quote.
CISPE also described stronger customer-privacy protections, including no requirement under the arrangement to share customer details with Microsoft. Buyers should still read the provider’s current contracts to see what information is processed for billing, telemetry, security, support and compliance.

The announcement identified Microsoft 365 Local as a possible sovereignty option if it became generally available through CSP. That wording is conditional; it does not establish universal availability. Read the July 2025 CISPE announcement for the stated scope.
Who benefits—and who does not
Eligible independent European providers
Benefits depend on CISPE membership, Microsoft eligibility rules and actual CSP-Hoster participation. Membership alone does not prove that a provider has activated every concession or sells every covered product.
Customers of participating providers
Customers may gain another route to Windows Server and SQL Server, potentially improving price competition and supporting locally operated services. The settlement does not automatically make every European provider cheaper or more sovereign.
Hyperscalers excluded from the terms
CISPE’s 2024 announcement said AWS was excluded from negotiations and that AWS, Google Cloud and Alibaba Cloud would neither benefit from nor be bound by that agreement. The 2025 arrangement also retained exclusions for hyperscale providers Microsoft designates as “Listed Providers.” These terms were designed primarily to strengthen independent European providers, not Microsoft’s largest global rivals.

What ECCO does—and what it does not do
The European Cloud Competition Observatory is an oversight mechanism connected with the settlement. Microsoft participates alongside European cloud and customer representatives, while CISPE describes ECCO as independently governed. Its functions include monitoring compliance, assessing progress, publishing reports and examining wider licensing practices. See the launch announcement and ECCO’s overview.
ECCO reports are not EU enforcement decisions. CISPE’s allegations, ECCO’s assessments and a European Commission finding must be kept separate. The Commission did not fine Microsoft or rule in the settlement that Microsoft infringed EU competition law.

The settlement resolved CISPE’s specific complaint on agreed terms, but broader issues remain. ECCO’s later reporting said the arrangement did not cover new bundling strategies or the integration of artificial-intelligence capabilities with productivity software and cloud services. The initial technical remedy was also incomplete and had to transition to alternative solutions.
The most accurate description is therefore “a settled phase with monitored remedies.” It is not evidence that all Microsoft licensing restrictions disappeared, that all cloud competitors receive equal treatment, or that future competition questions cannot lead to further scrutiny. The October 2025 ECCO report sets out those remaining concerns.

What European customers should verify before switching
A customer should request written answers from the proposed provider rather than rely on the phrase “CISPE settlement.” Check:
- Eligibility: Is the provider a qualified CISPE member and an active CSP-Hoster participant?
- Product coverage: Which Windows Server and SQL Server editions, versions and add-ons are included? Does the offer cover the required VDI, Microsoft 365 or security features?
- Workload economics: Compare Microsoft licensing with compute, storage, networking, backup, support, migration and egress charges.
- Sovereignty: Where are data, metadata, encryption keys, support access and administrative operations located?
- Portability: Can licenses and workloads move to Azure, another European provider or on-premises infrastructure?
- Service quality: What availability commitments, support hours, incident history and Microsoft escalation path apply?
- Contract protection: Review price-change rights, renewal terms, audit provisions, termination assistance and data-export deadlines.
- Privacy: Identify exactly what customer, billing, telemetry and support information Microsoft receives.
Do not confuse Azure Local with ordinary Azure public-cloud hosting. Microsoft’s Azure Local pricing page notes that pricing varies by agreement, region, currency and purchase date: Azure Local pricing.
What providers should assess
A provider considering the programme needs more than a qualifying membership. It should model Microsoft licence costs, hardware, operations, support, compliance and expected utilisation. Pay-as-you-go can reduce commitment risk but may cost more than committed licensing for stable workloads. Technical integration and certification can also increase costs, while reliance on Microsoft may strengthen the provider’s offer and increase strategic dependence on the company it competes with.
Microsoft says CSP price lists and offers are updated through Partner Center. License-based price lists are updated monthly, while usage-based prices can change more frequently. Providers and buyers should therefore use current Partner Center data or an authorised partner quote, not an old settlement announcement. See CSP documents and CSP pricing and offers.

The practical verdict
Microsoft’s agreements with CISPE created a meaningful route for eligible European cloud providers to sell Windows Server and SQL Server under more flexible, usage-based terms, with sovereignty and privacy features that can matter to public-sector and regulated buyers. The remedy also showed its limits: the first product plan was incomplete, participation is conditional, hyperscalers are excluded, and the arrangement does not settle broader bundling or AI-related competition questions.
For procurement teams, the decision is commercial rather than rhetorical. A provider must prove eligibility, product coverage, total-cost savings, operational maturity and actual data-control protections. For policymakers and competitors, the settlement is evidence of negotiated concessions—not a definitive ruling that the underlying market problem has disappeared.
