Is ZTE Banned in the US? What Consumers and Businesses Need to Know

ZTE telecommunications equipment faces major U.S. restrictions, but that does not automatically make every ZTE phone illegal to own. The answer depends on product category, model, and use.

No—not as a blanket ban on every ZTE-branded device or every private owner. The United States does, however, impose major restrictions on ZTE telecommunications equipment: it is on the FCC Covered List, new covered equipment generally cannot receive FCC authorization, and federal procurement and federally supported networks face significant limits. A particular ZTE or nubia phone must be assessed by model and intended use; the rules for network infrastructure are not identical to the rules for a consumer’s existing handset.

What does “banned” mean for ZTE?

“Banned” can refer to several different government actions, and they do not all have the same effect. The important distinction is between restrictions on telecommunications equipment and federal programs, on one hand, and a blanket rule forbidding consumers to own every device carrying the ZTE name, on the other.

How the 2016–2018 ZTE case unfolded

2016: Entity List restrictions

In March 2016, the Commerce Department’s Bureau of Industry and Security (BIS) added ZTE to the Entity List. That action created licensing requirements for exports, reexports, and transfers involving controlled U.S.-origin goods, technology, and software. 2017: Settlement

April 2018: Denial order activated

On April 15, 2018, BIS activated a suspended denial order after finding that ZTE had not complied with required representations concerning employee discipline and related matters. The order cut ZTE off from U.S.-origin goods and technology for the denial period. BIS enforcement summary

July 2018: Denial order terminated

The Commerce Department later terminated the denial order after ZTE completed required conditions, including payment of the final penalty and other compliance measures. That ended the 2018 denial action; it did not prevent later agencies from imposing separate restrictions. Commerce Department order

What restrictions followed the 2018 case?

Federal procurement and contractor rules

Section 889 of the National Defense Authorization Act for Fiscal Year 2019 and related acquisition rules restrict federal procurement involving certain telecommunications and video-surveillance equipment and services from ZTE and other covered companies. Contractor obligations can also apply where covered equipment is used as a substantial or essential component of a system, with exceptions and waivers governed by the applicable rules. This is not the same as a law making every private consumer purchase unlawful. A household buying a phone, a business deploying network equipment, a contractor supplying a federal system, and an agency purchasing equipment can face different rules. FCC designation and Covered List

The FCC designated ZTE as a covered company on June 30, 2020. ZTE telecommunications equipment and related services carry a Covered List date of March 12, 2021; the FCC’s current list continues to identify equipment produced or provided by ZTE Corporation, including telecommunications or video-surveillance services provided by the company or using such equipment. Covered List status is a regulatory trigger, not a standalone statement that every privately owned product must be confiscated. Its consequences include restrictions on FCC authorization of new covered equipment, limits on certain federal support and communications-supply-chain programs, and obligations that can affect eligible providers.

Secure Equipment Act and new FCC authorizations

The Secure Equipment Act of 2021 directed the FCC to prevent authorization of equipment identified as posing an unacceptable national-security risk. In November 2022, the FCC finalized rules preventing authorization of new covered communications equipment from companies including ZTE. Current U.S. status by product and use

Routers, modems, and home-network devices The Covered List concerns ZTE telecommunications equipment, but the sources do not establish identical treatment for every consumer networking product. Previously purchased devices No blanket consumer deactivation or surrender requirement for every older ZTE phone is established by the cited official sources. Separate legal possession from whether the device still works on a carrier network and receives security support.

What the FCC’s 2026 action changes

Older explanations often describe the FCC rules only as a bar on new authorizations. In June 2026, the FCC addressed importation and marketing of certain previously authorized covered communications equipment that had been added to the Covered List in 2024 or earlier. This means prior authorization is not necessarily a complete safe harbor for every product. That action should not be read as proof that every old consumer device is automatically unlawful. Nor should a consumer or business infer that older authorization alone settles the question. For a specific device or deployment, identify the model and applicable FCC rule rather than relying on a general label such as “old ZTE equipment.”

Can you buy or keep using a ZTE phone?

For an existing phone

The reviewed official sources do not establish a general requirement that private owners deactivate or surrender all previously purchased ZTE handsets. Legal possession is different from reliable day-to-day use: a carrier may not support a model, security updates may have ended, and repairs or replacement parts may be difficult to obtain.

Before buying a phone or router

  1. Get the exact model number. Do not rely on a listing that says only “ZTE,” “nubia,” or “U.S. version.”
  2. Check the FCC ID and authorization. Ask the seller for the FCC ID and verify that the product has appropriate U.S. authorization and is not affected by a restriction relevant to its category or authorization history.
  3. Confirm carrier compatibility. Check the intended carrier’s current compatibility tool and verify supported LTE and 5G bands, VoLTE, and emergency-calling support. Carrier approval is separate from federal legal status.
  4. Verify region and software. Establish whether the model is intended for the United States, the global market, or China; regional versions can differ in software and network support.
  5. Read warranty and update terms. Confirm who provides U.S. repairs, whether the warranty applies to an imported model, and what software support is promised.
  6. Assess the seller and return policy. A marketplace listing is not proof of authorization, compatibility, authenticity, or support. Prefer an identifiable authorized seller and a meaningful return period.

What businesses and network operators should evaluate

For a business network, the issue is not simply whether a product can be found for sale. Review the equipment’s FCC status alongside funding, contract, security, and support requirements before buying or continuing to deploy it.

  • Check whether the specific equipment or service falls within the FCC Covered List description.
  • Assess federal funding and Universal Service Fund eligibility implications.
  • Review Section 889 and contract flow-down requirements, including whether covered equipment is a substantial or essential component.
  • Determine whether a 2026 import or marketing restriction, transition provision, or exception applies to the model.
  • Evaluate patching, vendor support, replacement plans, and any removal obligations.
  • Obtain legal and procurement review for federal, defense, or federally supported deployments.

An installed device does not necessarily face the same immediate treatment as new equipment being imported or marketed. Continued use can nevertheless raise separate funding, contract-compliance, support, security, and replacement questions.

Common claims that need qualification

  • “The 2018 ban was lifted, so ZTE has no U.S. restrictions.” The Commerce Department denial order was terminated, but later FCC and federal procurement restrictions are separate measures.
  • “The Covered List means consumers cannot own ZTE.” Covered List consequences operate through defined regulatory mechanisms; the cited sources do not establish a universal consumer confiscation rule.
  • “If it is sold online, it is legal and compatible.” Online availability does not prove FCC authorization, lawful import or marketing, carrier acceptance, warranty coverage, or update support.
  • “All ZTE products are treated alike.” Telecom infrastructure, handsets, routers, and services may fall under different rules; the model and product classification matter.
  • “A nubia store will ship it, so it will work in the U.S.” Shipping does not guarantee carrier compatibility or settle the FCC status of a particular model.
