How to Personalize Marketing With First-Party Data and Customer Intent

Use customer-provided information and relevant behavior to make marketing useful: define a purpose, explain the data use, check legal and channel requirements, and honor preferences across systems.

Personalize marketing by using information customers knowingly share and relevant behavior they exhibit to address a clear need—not by collecting every available data point. Start with a specific purpose, explain how data shapes messages, use an appropriate legal basis and channel permission, and make it easy to object or opt out. First-party data is not automatically fair to use: expectations, sensitivity, profiling risks and the path from collection to activation all matter.

What first-party data and customer intent mean

First-party data is information an organization collects through its direct relationship with a person—for example, product preferences they provide or interactions with the organization’s own site. Customer intent is an indication of what someone may need or be considering, inferred from that information or behavior. A recent visit to a product page may suggest interest; it does not prove a purchase decision or grant permission to contact someone through any channel.

Keep direct collection distinct from data enrichment and platform matching. Information from a broker, or a customer list uploaded so a platform can match people to accounts, involves additional parties and expectations. A field’s usefulness does not by itself justify collecting or activating it.

Build a personalization workflow

1. Define the customer need and the minimum useful signal

Write down what need the campaign addresses, which people it is for, and which signals are necessary. For example, a customer who asks for information about a particular product could receive relevant details about that product. Avoid gathering more data simply because it is available. The UK Information Commissioner’s Office (ICO) recommends planning what information is needed and why.

2. Map each signal from collection to message

For every data field, record where it came from, what the person was told, which segment or inference uses it, and what message and channel it informs. This map helps distinguish data collected directly from broker enrichment or a platform audience upload, and makes it possible to identify where a preference or objection must be applied.

3. Explain the use in plain language

Tell people that their information will be used for direct marketing and describe how personalization works. The ICO offers this example: “We use your purchase history to tell you about offers and products we think you may be interested in.” Its guidance states, “You must tell people that you want to collect and use their information for direct marketing purposes.” A vague privacy notice may not give people a clear picture of what is analyzed or how it affects the marketing they receive.

4. Check the legal basis and the channel separately

Consent and legitimate interests are possible data-protection lawful bases for direct marketing, but the right choice depends on the specific activity and circumstances. A lawful basis under data-protection law is not a substitute for checking rules that apply to the channel. In the UK, the Privacy and Electronic Communications Regulations (PECR) may separately require consent for electronic mail marketing or for storing or accessing information on a device. Check current rules for the relevant jurisdiction, channel and technology rather than assuming one permission covers everything.

5. Make preferences effective across systems

Offer a clear, practical way to unsubscribe or object, and ensure that the choice reaches the systems and platforms used to activate campaigns. The ICO says people have an absolute right to object to direct marketing at any time, including profiling related to it. A preference that is recorded in one database but ignored by an email tool or audience platform is not an effective choice.

6. Review inferences and outcomes

Check whether inferences are accurate and proportionate, whether a segment could create unjustified exclusion or reinforce stereotypes, and whether the resulting message is useful rather than surprising. If profiling uses special-category data, the ICO guidance says explicit consent is likely to be required. Consider the risk and sensitivity of an inference, not just whether the original data was collected directly.

Choose an approach that fits the signal and the relationship

There is no universally best personalization method. Compare approaches by looking at the source of data and what a person would reasonably expect; the purpose and necessity of the signal; the lawful basis and any separate channel permission; the degree and sensitivity of inference; the risk of harm or exclusion; the transparency and control offered; and whether objections can be carried through every activation system.

The ICO’s guidance warns against treating public availability as permission: using personal information found publicly can still be unexpected and restricted. Silently adding contact details from another source is likely unfair in most cases. The organization using third-party data remains responsible for its processing; a vendor’s assurance alone does not establish that the data is suitable.

Use platform audiences transparently

Custom-audience advertising commonly involves uploading a customer list so a social platform can match it to its users. Lookalike targeting uses an existing audience to find people with similar characteristics. These methods add a data-sharing and matching step; explain that use, assess fairness and the legal basis, and account for both organizations’ roles.

The ICO cites a 2021 Which? finding that 79% of those questioned were unaware that a social media platform matches profiles to customer lists uploaded by organizations. This is a dated awareness finding, not a current or universal measure of consumer awareness. It underlines why an audience upload should not be treated as an invisible technical detail.

What to verify before using broker data

  • Provenance and age: Establish where and when the information was collected.
  • Collection context and notice: Check what people were told and whether the proposed marketing use fits those expectations.
  • Permission evidence: Review records supporting any claimed consent and whether its scope covers the intended use.
  • Preference screening: Confirm how suppression or preference lists are checked and kept current.
  • Rights handling: Understand how objections and other relevant requests reach your organization and any activation partners.

If a provider cannot substantiate these points, do not assume that its data is appropriate to use. The UK ICO guidance is not universal legal advice; requirements can differ by jurisdiction, channel and the particular processing involved.
