Identify the court or agency, creditor, levying officer, amount, date of service and response deadline; then ask your bank what funds are frozen and contact the officer or court named on the notice about the filing process. If any money may be protected, file the correct claim promptly and keep proof of submission. Deadlines and procedures depend on your state and the type of debt.
What should you do first?
- Read every page of the notice. Record the issuing court or agency, creditor, levying officer, amount being collected, service date and stated deadline. Do not assume the notice is a routine private-creditor collection: some government agencies have separate authority to collect certain debts.
- Call the bank. Ask how much is frozen, whether any money has already been sent out, and what information the bank received about the levy. The bank can explain its hold and the documents it received, but it cannot decide your legal exemption claim.
- Contact the officer or court listed on the notice. Ask where and how to file the applicable exemption claim or objection, what forms are required, and how the deadline is calculated. Follow the instructions for the jurisdiction and case shown on your notice.
- Preserve your records. Keep the notice, bank statements, deposit history, benefit award letters and any other documents showing where the money came from. Save copies of every form and proof of when and how you filed it.
If the source of the funds, debt type or deadline is unclear, seek help from a consumer-law attorney or legal aid provider rather than waiting for the bank to resolve the issue.
How does a bank levy work?
In the California court process, a bank levy is carried out under a writ served on the bank. The bank freezes funds, reviews deposits for protected money and reports its findings to the levying officer. Funds not identified as exempt may be sent to that officer, who holds them during the applicable response period. A timely exemption claim can lead to the return of protected money; if the creditor contests the claim, the court may schedule a hearing.
California Courts describes its bank levy as a one-time action against the money in an account when the levy is served; another attempt requires another levy. That description is specific to California’s procedure and should not be assumed to apply in another state.

Can money in the account be exempt?
Possibly. Federal and state law protect or limit collection from some wages, benefits and money held in bank accounts, but the rules depend on the source of the money, the applicable law and the kind of debt. California Courts lists Social Security and Supplemental Security Income (SSI) as examples of protected income. A benefit deposit does not automatically make every dollar in the account exempt: other deposits, the balance and the debt involved can matter.
CFPB and U.S. Treasury guidance describes a federal rule that generally preserves up to two months of qualifying, directly deposited federal benefits in covered accounts. The rule has conditions and exceptions, including for certain government debts and child support. Do not treat the entire balance of every account that receives benefits as immune from collection.

What deadline and filing process apply?
There is no single deadline or form established here for every U.S. bank levy. The deadline can depend on the state, the court or agency, the type of proceeding and how the notice was served. Use the instructions on your notice and the current official instructions for your court; do not apply a deadline from another state.
California: Claim of Exemption
California Courts instructs recipients to submit a Claim of Exemption and a financial statement to the levying officer named on the Notice of Levy. The claim identifies the legal basis for exemption; the financial statement describes the person’s circumstances. California’s guide gives a deadline of 15 days after service, or 20 days if the notice was served by mail. These are California instructions, not nationwide deadlines. If the creditor disputes the claim, the court may set a hearing; keep your records and attend if one is scheduled.

New Jersey: a separate objection process
New Jersey Courts describes an objection process for cases in its Special Civil Part. That is a different procedural path from California’s Claim of Exemption process. What records should support an exemption claim?
Gather the evidence that connects the money in the account to the protection you are claiming. Depending on your situation, useful records may include bank statements showing deposits, benefit award or payment records, and documents showing other sources of funds. California’s court guidance calls for explaining your legal basis on the claim and your financial circumstances in the financial statement. Keep the submitted forms and filing confirmation together with those records.
When should you get legal help?
Contact a consumer-law attorney or legal aid if you cannot tell which deadline applies, the account contains mixed sources of money, the debt may fall under a government collection exception, or the creditor challenges your claim. CFPB identifies state-based legal aid as a resource. The bank can clarify the hold; the court or levying officer can explain where and how to submit forms.
