To challenge an Indian service-tax demand concerning residential construction, first establish whether you have a show-cause notice or a final order, then test each allegation against the tax period, the actual contract and work, the limitation grounds, and a period-wise calculation. The service-tax regime is historical: do not apply current GST rules to an earlier period. Whether a particular owner, developer, builder, or contractor is liable depends on the documents and facts of that demand.
Start by identifying the document, noticee and tax period
The person who received a flat is not necessarily the person named as liable in the demand. Check the noticee’s exact name and role: homeowner, contractor engaged by a developer, or developer contracting with buyers. The legal analysis can differ with that relationship, as can the work and consideration the department says were taxable.
Make a record of the project, service recipient, taxable-service category, statutory provisions, amount claimed, and every tax period stated. Also distinguish a notice proposing a demand from an order that has already decided it. A show-cause notice calls for a response to the proposed allegations; a final order may call for an appeal. Do not treat them as interchangeable.
Build a service-and-deadline record
Record when and how the document was actually served, not only the date printed on it. Preserve the envelope, email headers, portal download record or other evidence of service, along with annexures and any hearing correspondence. Note each stated reply or appeal deadline and promptly verify the rule applicable to the authority, order date and tax period. The appropriate appeal forum and deadline cannot be determined from the description “service-tax demand” alone.

Is the construction a service or a works contract?
Compare the category used in the demand with what the parties agreed to supply. One central issue is whether the transaction was a service simpliciter or an indivisible composite works contract involving both services and transfer of property in goods. The Supreme Court has considered the statutory works-contract service regime introduced from 1 June 2007 and its valuation framework. That framework may be relevant, but it does not automatically decide a different agreement, activity or tax period. Read the applicable statutory text and amendments alongside the actual contract and the judgment.
For residential-complex demands, identify who engaged whom, what work was done, and whether the department’s theory concerns construction for a developer or construction by a developer for buyers. Examine any reliance on a statutory explanation concerning developers and whether it was in force for the period in question. A tribunal decision involving another project can help identify the issues, but its result is fact-specific rather than a rule for every residential development.

These are questions for testing the department’s theory, not conclusions about liability. A works-contract argument may affect classification and valuation, but it does not by itself dispose of separate allegations in the notice.
Can a service-tax demand for a flat be time-barred?
Limitation may be a substantial ground, but it must be calculated using the statutory version that governed the demand period. CBIC summarizes Section 73 as providing a one-year ordinary notice period and an extended period of up to five years where non-payment or short-payment is attributable to specified conduct: fraud, collusion, wilful misstatement, suppression of facts, or contravention with intent to evade. These are legal periods in CBIC’s summary, not a universal deadline calculation for every historical demand.

Check the relevant-date rule, amendments applicable to each period, notice service date and any applicable exclusion, such as a court stay. If the notice invokes the extended period, identify the precise conduct it alleges, the fact said to have been concealed or misstated, and how the notice connects that conduct to the required intent under the applicable law. A bare assertion that the department already knew, or that there was no suppression, is not a substitute for evidence.
Returns, registrations, invoices, contract disclosures, prior audits, correspondence and earlier notices can help establish what information was disclosed and when. Match those records to the specific periods and allegations rather than making a general limitation objection.

Reconstruct the demand amount period by period
Do not respond only with a general disagreement about the tax category. Reconcile the department’s computation against the agreements, invoices, receipts, payments and tax records for each period. Keep a working table with one row per period and record the demand’s category and gross amount, contract consideration, amounts attributed to goods where relevant, tax already paid, credits claimed and the resulting difference. Attach or identify a source document for every adjustment.
If the transaction is said to be a works contract, check whether the valuation method available for that contract and period was used. The Supreme Court’s works-contract decision discusses the statutory valuation framework and amendments; use the version relevant to the period rather than assuming one method applies to all years or contracts.

Separate a CENVAT-credit allegation from the service-tax calculation if the notice raises both. A construction-sector dispute such as the Jyoti Limited order illustrates that a credit issue can be raised alongside a service-tax demand; it does not establish the facts or outcome for a homeowner’s case. Identify the rule, supporting records and calculation for each credit allegation independently.
How to reply to a service-tax show-cause notice for construction
Organize the reply so the decision-maker can trace each response to the notice’s allegation and the evidence supporting it. Address the factual basis, applicable legal classification, limitation and calculation separately where the notice raises them. If relied-upon documents are missing, identify the material needed and request it in writing; preserve a copy of the request and proof of delivery.
- Prepare an allegation list. Quote or identify each allegation, provision, tax period and amount from the notice.
- Set out the chronology. Include the contract and work dates, relevant payments, return and tax-payment dates, department correspondence, and the notice’s service date.
- Answer each allegation with evidence. Point to the specific agreement clause, invoice, ledger, return, challan, project record or correspondence that supports the response.
- Show the calculation. Provide the period-wise reconciliation and explain each difference from the department’s figure.
- Request missing relied-upon material if needed. Identify the documents and explain why they matter to a particular allegation.
- File by the stated deadline and retain proof. Keep the complete submitted reply, attachments, acknowledgement and any subsequent communication.
If an order has already been passed, promptly establish which appeal provision, forum, form, deposit or payment requirement and time limit applied on the date it was communicated. Those mechanics depend on the order, authority, procedural posture and statutory version; do not rely on a deadline copied from a different service-tax matter.
Documents to assemble
- The notice, annexures and proof of service; any adjudication order and hearing record.
- Contracts, amendments, scope-of-work documents and related project approvals.
- Invoices, receipts, payment ledgers and records distinguishing goods and services where relevant.
- Service-tax returns, challans, accounting ledgers and any CENVAT-credit records implicated by the notice.
- Completion records and other project documents relevant to when and what work was performed.
- Prior audits, department correspondence, earlier notices and disclosures that may bear on the facts alleged.
- A period-wise computation that ties every claimed adjustment to its supporting record.
Preserve originals and note missing documents. The response is strongest when the legal objection and the supporting record line up allegation by allegation, rather than relying on a broad assertion that residential construction is exempt or taxable.

India’s service-tax regime is historical, while GST belongs to a later tax framework. A GST rule or later tax treatment should not be applied backward to determine a service-tax liability for an earlier period. Identify the exact dates and provisions in the demand before using any later guidance or case.
