To apply for a P-3 visa, a U.S. employer or sponsoring organization first files a petition with USCIS for an artist or entertainer taking part in a culturally unique program. After the petition is approved, a beneficiary applying from abroad generally completes Form DS-160 and follows the interview and payment instructions of the U.S. embassy or consulate handling the application. The evidence must establish the cultural uniqueness of the work and the planned events, and the petition must include a labor-organization consultation.
Who files a P-3 petition?
The U.S. employer or sponsoring organization files the petition; the artist or entertainer does not self-petition. P-3 is a temporary classification for an artist or entertainer coming individually, as part of a group, or as an integral part of a group performance to perform, teach, or coach under a culturally unique commercial or noncommercial program. The program may develop, interpret, represent, coach, or teach a unique or traditional ethnic, folk, cultural, musical, theatrical, or artistic presentation, and the event must further understanding or development of the art form. These requirements appear in 8 CFR 214.2.
Essential support personnel are not included automatically in the principal artist’s P-3 petition; the regulation requires a separate petition for them. The artist’s spouse and unmarried minor children may qualify for P-4 status while accompanying or following to join, but P-4 status does not authorize them to work unless they are separately granted employment authorization.
What evidence is required for a P-3 visa?
Build the petition around the regulatory criteria for cultural uniqueness, authenticity, and the specific events. “Culturally unique” means “a style of artistic expression, methodology, or medium which is unique to a particular country, nation, society, class, ethnicity, religion, tribe, or other group of persons.” The definition and evidentiary criteria are in 8 CFR 214.2.

- Show authenticity and skill. Include affidavits, testimonials, or letters from recognized experts attesting to the authenticity of the artist’s or group’s skills. Explain each expert’s credentials and how the expert knows the relevant art form.
- Alternatively, provide published corroboration. The regulation permits documentation that the performance is culturally unique, such as reviews in newspapers, journals, or other published materials. This is an alternative form of evidence for cultural uniqueness; it does not remove the need to document the planned program and events.
- Connect the evidence to each event. Provide event descriptions and an itinerary, and show how all planned performances or presentations will themselves be culturally unique. A general artist biography alone may not establish the character of the scheduled events.
- Include the labor-organization consultation. Consultation with an appropriate labor organization is required for P-3 petitions involving culturally unique programs. A favorable advisory opinion should evaluate the cultural uniqueness of the skills, state whether the events are cultural in nature, and address whether the event or activity is appropriate for P-3 classification. If the organization has no objection, the regulation allows it to submit a letter of no objection in lieu of an advisory opinion.
These are the regulation’s evidentiary criteria, not a guarantee that a particular submission will be sufficient.
How do I apply for a P-3 visa?
There are two stages: the U.S. petitioner’s USCIS petition and, for a beneficiary applying abroad, the visa application and interview process. The petition must be approved before the beneficiary applies for a P visa or seeks admission in P-3 status.

USCIS’s employment-based nonimmigrant reference guide identifies Form I-129 and P-3 filing procedures. Check USCIS’s current official form and fee information before filing because the current edition, filing method, address, and charges can change.
What forms do I need for a P-3 visa?
- Form I-129 for the petition stage: The U.S. petitioner files the prescribed P petition. Confirm the current I-129 edition, any required supplements, filing address, fee, and available filing method directly with USCIS before submitting it.
- Form DS-160 for an applicant applying abroad: The beneficiary completes and submits the nonimmigrant visa application electronically. The Department of State instructs applicants to retain the barcode confirmation page; its instructions do not require printing the full application. See the DS-160 instructions.
The DS-160 is not a substitute for the employer’s petition. A beneficiary who is not applying for a visa abroad may have a different process for seeking admission; follow the applicable USCIS and Department of State instructions for the individual circumstances.

Do I apply for a P-3 visa before or after Form I-129 approval?
The beneficiary applying abroad ordinarily submits the DS-160 and proceeds with the visa application after the petition has been approved. The petition is the prerequisite; it is not the visa itself. The petitioner may file no more than one year before the actual need for the services, under the timing rule in 8 CFR 214.2.
How do I arrange the interview and choose a consular post?
After completing the DS-160, the applicant schedules the interview directly and follows the selected embassy or consulate’s instructions for paying the fee and providing supporting documents. Post-specific procedures differ, so use the instructions for the post handling the application rather than assuming payment or document rules are identical everywhere. The Department of State’s DS-160 page directs applicants to schedule the interview and check the relevant post’s instructions.

The Department of State lists a $205 nonimmigrant visa application processing fee for petition-based categories, including P visas, in the fee schedule accessed in 2026. This fee is nonrefundable and separate from the USCIS petition fee. A visa issuance fee may also depend on the applicant’s nationality. Check the current Department of State fee schedule and the applicable reciprocity table and post instructions before paying.

The current USCIS petition-side total is not stated here. Do not rely on an older I-129 fee: verify the applicable USCIS fee and any additional charges directly with USCIS immediately before filing.
How long can P-3 status cover the program?
Under 8 CFR 214.2, a P-3 petition may cover the period needed to complete the event or activity, up to one year. One-year extensions may be authorized to continue or complete the same event or activity. The petition’s filing window is also limited to no more than one year before the actual need for the services.
