Google’s Supreme Court Appeal Ends, Leaving Play Store Competition Order in Place

Google’s Supreme Court appeal ended without a merits ruling, leaving the lower-court Play Store competition order in place. Several U.S. implementation programs are already active.

Google’s Supreme Court appeal did not end with a ruling on the merits. On March 9, 2026, the Court dismissed Google’s petition after Google and Epic Games jointly asked to end it. The lower-court injunction requiring changes to Google Play was left in place, and Google says several U.S. programs to implement those changes are now active.

What happened at the Supreme Court?

The Supreme Court did not decide whether Google violated antitrust law or issue an opinion ordering Google to open Play. The Court dismissed Google’s petition under Rule 46, a procedural end to the appeal rather than a decision resolving its legal arguments. The lower-court judgment and injunction therefore remain operative. The case history appears on the Supreme Court docket for Google LLC v. Epic Games, No. 25-521.

  1. The Ninth Circuit affirmed the relevant judgment and injunction on July 31, 2025.
  2. Google filed its petition asking the Supreme Court to review the case on October 27, 2025.
  3. Google and Epic jointly stipulated to dismissal on March 5, 2026.
  4. The Supreme Court dismissed the petition on March 9, 2026.

That distinction matters: a merits opinion would have resolved legal questions and created a Supreme Court ruling on them. A dismissal leaves the lower-court order in place without such an opinion.

What does the injunction require?

The injunction concerns specific parts of Google Play’s distribution and payment systems. Google’s petition describes requirements that include opening access to Play’s app catalog for competing stores, providing a way to distribute rival stores through Play, allowing developers to link to external sites for downloads and payments, and not requiring exclusive use of Google Play Billing in covered circumstances. The measures are described in Google’s Supreme Court petition.

“Open the Play Store” is shorthand, not a description of an unrestricted marketplace. It does not mean every store automatically appears in Play, that every store or app must be accepted without review, or that Google Play is going away. Nor does it establish that users will see a new storefront immediately. Eligibility, security, and implementation still shape how the programs work.

What Google has implemented in the United States

Google’s U.S. developer policy page says the relevant programs became effective July 22, 2026. The implementation is not one change: catalog access, store distribution, and alternative payments are distinct measures.

Measure What it does Status and scope
Play Catalog Access Allows third-party U.S. Android app stores to sign up for access to Play app listings. Available from July 22, 2026. A listing being accessible does not by itself mean the app is downloadable from that store.
Third-party App Store on Play Program Provides an onboarding route for third-party app-distribution platforms and stores seeking distribution through Play. Onboarding began July 15, 2026; the program became effective July 22, 2026. Eligibility and program rules apply.
Alternative billing and external-content links Enables qualifying developers to use alternative payment or external-link options under Google’s policies. Reporting and applicable service fees for covered U.S. activity begin October 1, 2026.

These dates and program descriptions come from Google Play’s U.S. developer policy update. Google says U.S. app listings were made available to qualifying third-party stores unless developers opted out; the stated opt-out date was July 22, 2026. Google also says that developers using covered alternative billing or external-content-link programs will have reporting and service-fee obligations beginning October 1, 2026.

What Android users may notice

Rival stores could become easier to discover or install, and developers may have more choices for distribution and payment. That could mean more storefront options, including stores focused on games. It does not guarantee lower prices: a developer or store might pass on savings, keep them, or use them to compete in other ways.

More storefront choice also means users may encounter different rules for refunds, privacy, parental controls, moderation, and app support. Installing from another store can involve additional prompts, account requirements, or compatibility limits. Google argued in its Supreme Court petition that broader catalog access and rival-store distribution could expose users to malicious, deceptive, or pirated content. That is Google’s stated concern, not a Supreme Court finding that the injunction is unsafe.

What developers should check

The order and Google’s programs do not create a blanket exemption from Play policies. Developers should assess four separate issues before changing how they distribute or monetize an app:

  • Distribution: Whether the app’s listing can be made available to qualifying third-party U.S. stores, and whether those stores will actually distribute it.
  • Payments: Which alternative billing or external-link option applies to the developer’s product and region.
  • Fees and reporting: Which transactions, downloads, or other covered activity must be reported and what service fees apply from October 1, 2026.
  • Opt-out and eligibility: Whether the developer opted out of listing availability by the July 22, 2026 date, and whether each store and app meets the applicable program requirements.

Multiple storefronts can bring additional submission, compliance, customer-support, refund, tax, and subscription-reconciliation work. They may create more distribution options, but there is no guarantee that a rival store will deliver meaningful user demand. Google’s policy update is the relevant place to verify current program terms, geographic coverage, reporting steps, and fee schedules.

What the settlement changes—and what remains unsettled

Google and Epic announced a settlement on March 4, 2026, and asked the district court to enter a revised modified injunction. That settlement is separate from the earlier injunction: the injunction is the basis for the specified interoperability obligations, while the settlement addresses changes to payment, fee, and implementation terms. Google’s policy page says existing policies and programs remain in effect while it publishes additional changes. The request for a revised injunction should not be mistaken for a Supreme Court ruling or for proof that every implementation detail is permanently settled.

The case’s practical scope is broader than Epic simply getting its own store. The lower-court remedy concerns Google’s treatment of developers and competing stores across the Android app-store ecosystem. At the same time, the documented programs discussed here are framed around the United States; they should not be assumed to apply identically in other countries or on every Android device. Manufacturers may operate their own stores, and Android as an operating system is broader than Google Play.

Google’s case and Apple’s case are separate

Apple was not a party to Google’s Supreme Court petition. In the separate case Apple Inc. v. Epic Games, No. 25-1311, the Supreme Court granted Apple’s petition in part on June 30, 2026, on a limited question, and the case remains in briefing. The different procedural outcomes are shown on the Apple docket and the Google docket.

What to watch next

The next practical test is whether qualifying rival stores become meaningfully discoverable and usable, not merely whether a catalog listing or enrollment channel exists. An Android Central report describes concerns raised in proceedings before Judge Donato about how easily users can find rival stores. Developers should also watch Google’s policy updates and the October 1, 2026 start of reporting and applicable service fees for covered programs. The district court’s consideration of the requested revised injunction will help clarify how the settlement fits with the existing order.
