Short answer: Google already appealed Epic Games’ Android app-store case. On July 31, 2025, the Ninth Circuit upheld the verdict and the main parts of the injunction requiring Google Play to accommodate rival app stores, alternative billing and developer communications in the covered U.S. market. By August 2026, the live dispute had shifted to settlement approval, enforcement and whether users can actually find competing stores.
The case began after Google removed Fortnite from Play in August 2020, but the remedies address the broader economics of Android app distribution and in-app payments. Google and Epic announced a settlement agreement on March 4, 2026, and asked the district court to enter a revised injunction; Google’s developer notice does not by itself establish that every proposed term had received final approval.
What the headline refers to
This is the Epic Games v. Google antitrust litigation, not a new standalone case about rival stores. Epic sued in August 2020 after Fortnite was removed from Google Play. A jury found Google liable on Epic’s principal Play Store claims in December 2023. Judge James Donato entered a permanent injunction in October 2024, and Google appealed.
On July 31, 2025, the U.S. Court of Appeals for the Ninth Circuit affirmed the verdict and injunction. The appellate decision is available at the court’s opinion. Google then pursued further relief, including Supreme Court review. The Supreme Court docket identifies Google’s petition as No. 25-521, but the disposition should be checked directly at the docket page; the available record does not establish that the petition was granted or denied.

What the Ninth Circuit upheld
The injunction is designed to reduce Google Play’s control over both sides of the Android app market: developers and apps on one side, and users on the other. Its principal requirements include:
- Alternative billing: in the covered U.S. context, Google cannot require Play-distributed apps to use Google Play Billing or prohibit other in-app payment systems.
- Developer steering: developers may communicate with users about alternative purchasing options, prices and distribution channels, subject to applicable program rules.
- Catalog access: qualifying third-party Android app stores must be able to obtain access to the Google Play app catalog.
- Rival-store distribution: Google cannot prohibit distribution of third-party Android app stores through Google Play.
- Anti-preference rules: Google cannot provide certain benefits to developers, distributors, device makers or carriers in exchange for giving Play preferential treatment.
- Security safeguards: Google may impose reasonable privacy and security requirements and charge a reasonable fee tied to actual costs.
The Ninth Circuit rejected Google’s argument that the injunction was impermissibly vague because details such as metadata, refresh frequency and eligibility still needed to be worked out. It also rejected the claim that Epic’s market definition was barred by the separate Apple litigation. Why Google appealed
Google argued that compelled access for competitors could weaken Android’s security model and expose users to apps it would not approve for Play. It said forcing distribution of rival stores could create privacy, fraud and technical risks, reduce innovation and degrade the user experience. Google also challenged the trial’s market definition, the treatment of the jury verdict and the requirement to provide competitors access to Play’s catalog and user base.

The Ninth Circuit nonetheless concluded that the catalog-access and rival-store provisions directly addressed the competitive harm found at trial. The decision preserves Google Play; it does not order Android to replace its default store or make every distribution platform identical.

What changed in 2026
Google’s U.S. programs
Google’s current developer update says that, beginning July 22, 2026, third-party U.S. Android app stores could enroll in Play Catalog Access and Third-party App Store on Play. Unless a Play developer opted out, its listing could be made available to participating rival stores. The notice specifically discusses mobile and tablet form factors and does not establish a worldwide rollout. Details are in Google’s policy update.
Catalog access is not the same as automatic approval or independent distribution. A listing may contain metadata while the rival store still lacks the app binary, the developer’s permission, compatible Google Play Services, or the ability to process purchases and updates. Developers may also have to accept each store’s terms and comply with its fraud, signing, refund, subscription and support systems.

The settlement and modified injunction
Google says it and Epic entered a new settlement agreement on March 4, 2026 and asked the district court to enter a revised modified injunction. Reporting later described withdrawal of a joint request to modify the original injunction, allowing implementation to proceed; that account is reported by Ars Technica. The district court still controls implementation and enforcement, so a settlement announcement should not be treated as proof that every obligation has ended.
Why implementation is now the central fight
At an August 2026 court appearance, Judge Donato reportedly criticized the way Play users locate rival stores. Coverage described searches such as “store for apps” failing to produce an obvious competing-store result and questioned the usefulness of an “Are you looking for?” interstitial that can add warnings or extra steps. The report says the judge directed Google to make changes within approximately one week. These are implementation allegations and directions reported by Android Central, not a new Ninth Circuit ruling.

The practical issue is whether Google can satisfy the order on paper while making discovery commercially ineffective. A rival store can be enrolled yet remain difficult to find, available only in the United States, incomplete, or subject to device and account restrictions. Google may still apply reasonable security checks, but those checks must be comparable to measures used for ordinary third-party apps rather than a disguised exclusion.

What Android users may notice
- More opportunities to discover or install participating rival storefronts through Play.
- Additional app catalogs, promotions and payment choices.
- Different refund, parental-control, privacy, age-rating and account practices from store to store.
- More than one update or subscription path for an app, depending on where it was obtained.
The injunction does not make Google Play disappear, guarantee that every app is listed everywhere, remove malware screening, or let users install anything without warnings or device controls. A store’s participation also does not guarantee that its catalog, binaries, subscriptions or Google Play Services dependencies will match Play’s version.

Google’s notice says developers who had not opted out by July 22, 2026 could have their listings supplied to participating third-party U.S. stores. That is a catalog and listing mechanism, not a surrender of every distribution decision. Developers should distinguish:
- Listing metadata: title, description, graphics and other catalog information.
- Catalog discovery: whether a rival store can show that an app exists.
- Download processing: which store delivers the binary and handles updates.
- Independent distribution: whether the developer separately authorizes that store and accepts its commercial terms.
Google also says that, beginning October 1, 2026, developers using covered external-link or alternative-billing programs must report transactions and successful downloads and pay applicable service fees. The amount depends on the relevant program, transaction, developer category, geography and date; “alternative billing” does not mean zero fees. Developers should also plan for reconciliation of refunds, subscriptions, fraud controls, customer support and app signing across stores.

What app-store operators and device makers should expect
Operators such as Epic Games Store, Aptoide, Amazon Appstore, Samsung Galaxy Store and F-Droid illustrate different catalogs and security models, but none is automatically guaranteed a full replacement role. Each must meet Google’s enrollment, technical and security requirements, and users may see different behavior on Pixel, Samsung, enterprise-managed or parental-control devices. The cited implementation is U.S.-focused; it should not be generalized to Android worldwide.
Device manufacturers and carriers remain relevant because the injunction’s anti-preference rules address arrangements that give Play preferential treatment. The materials cited here do not establish identical behavior across phones, tablets, Android TV, Chromebooks or Android Automotive, so those form factors require separate verification.

What happens next
- The district court will continue supervising compliance and any modified-injunction terms.
- Google must implement discovery and enrollment processes without using security requirements as a pretext for exclusion.
- Developers and stores will decide whether participation produces enough users and revenue to justify operational costs.
- The Supreme Court posture remains tied to petition No. 25-521 and should be described only after checking the current docket.
- On October 1, 2026, affected developers must follow Google’s stated transaction-reporting and fee rules for covered programs.
Bottom line
Google’s Ninth Circuit appeal of the Epic Android app-store ruling is over: the court upheld remedies for rival-store distribution, catalog access, developer steering and alternative billing. The injunction does not abolish Google Play or make every app store equal. Its real economic effect will depend on whether users can find competing stores, whether developers remain opted in, how complete rival catalogs become, and how security, billing and service fees work in practice.
