On 26 August 2025, the Landgericht Frankfurt am Main ruled that Apple’s advertising of the Apple Watch as a “CO2-neutral product” was misleading under Germany’s Unfair Competition Act. The court focused on whether the carbon compensation behind the claim was secured for long enough—not on whether every carbon credit or Apple climate claim is invalid. The judgment was not final when announced, and its later appeal status is not established here.
What did the Frankfurt court decide?
In case 3-06 O 8/24, the Frankfurt Regional Court ordered Apple to stop the challenged Apple Watch carbon-neutral product advertising. It found the representation misleading under § 5(1) of Germany’s Unfair Competition Act (UWG). The ruling concerned the impression created for consumers considering the product.
The court’s account of the case identifies eucalyptus plantations on leased land in Paraguay as the project Apple relied on for compensation. The ruling was about whether the arrangements presented provided sufficiently durable compensation for the advertising claim, not a general determination that carbon credits cannot compensate for emissions.
Why did the court say the compensation was not secure enough?
The court reasoned that consumers could understand a carbon-neutral claim to mean that compensation would remain secured to around 2050, in light of the Paris Agreement’s temperature goal and the long persistence of carbon dioxide in the atmosphere. That horizon was the court’s assessment of consumer perception in this case, not a statutory deadline that applies to all offset projects.

According to the court, leases covering 75% of the relevant project area ran only until 2029. Apple had not established that all of those leases would be renewed. The court therefore found the project’s continuation beyond that date insufficiently secured for the period consumers could expect.
Why the buffer account did not answer the concern
Apple relied on a Verra buffer account under VCS standards. The court considered an approach that monitored the area after leases expired and activated the buffer mechanism only if the project was lost. It concluded that this was not an equivalent assurance of continued compensation as securing the forest project beyond 2029.

Did the court ban Apple’s “Carbon Neutral” logo too?
No. The separate objection that the “Carbon Neutral” logo could be mistaken for an official quality seal failed. The court treated it as Apple’s own indication of how it classified a product, rather than a seal guaranteeing product quality. That partial result is distinct from the ruling against the challenged product advertising.
Can Apple appeal the Frankfurt ruling?
Yes. The court’s 26 August 2025 announcement said the judgment was not legally final and could be appealed to the Oberlandesgericht Frankfurt am Main. The available court announcement does not establish whether Apple later appealed or what happened afterward, so the trial-level ruling should not be described as the final outcome of the case.

What the ruling means for Apple Watch buyers
This was an advertising-law decision, not a finding about Apple Watch quality or a recommendation about whether to buy one. The court announcement addresses the challenged carbon-neutral product claim; it does not provide a verified, comprehensive list of affected models. Apple’s 2025 Environmental Progress Report includes certification information for an Apple Watch Ultra 2 configuration over a stated period, but that corporate reporting context does not override the court’s finding about the advertising and project-duration evidence it considered.
