AI regulation is moving toward layered, risk-based governance—not one universal global rulebook. The 2023 debate correctly anticipated a decentralized U.S. approach, harder disputes over which harms to regulate, tighter links between AI policy and geopolitical competition, and election-related pressure. Since then, the EU has enacted a binding AI Act, while the United States has continued to rely mainly on executive action, agencies, existing laws, standards and state measures.
This updated assessment treats those four lessons as a forecast to test, not as current fact. It also explains what the changing rules mean for financial firms, businesses that use AI and individuals making decisions about money, privacy and employment.
What happened in 2023?
Several different kinds of policy action converged:
- April: U.S. civil-rights, consumer-protection and competition agencies warned that AI could automate discrimination, perpetuate unlawful bias and create other harms.
- May: OpenAI chief executive Sam Altman’s congressional testimony brought frontier-model safety, testing and oversight into mainstream U.S. policymaking.
- October 30: President Biden signed an executive order directing federal agencies to address AI safety, security, privacy, civil rights, consumer protection, labor and government procurement. The Federal Register order was an executive action, not a comprehensive federal AI statute.
- November 1–2: Countries attending the U.K. AI Safety Summit adopted the Bletchley Declaration, a political commitment to cooperation and safety research rather than directly enforceable law.
- December: EU negotiators reached political agreement on the AI Act after disputes over foundation and general-purpose models.
Export controls, semiconductor competition, copyright disputes, model releases, election concerns and state-level proposals made clear that AI policy was also economic and geopolitical policy.

The original January 2024 framework identified these developments as four lessons. By August 16, 2026, the broad direction is clearer: different instruments are forming a connected governance system.
Lesson one: The United States chose a patchwork—and that patchwork is the policy
The United States did not create one comprehensive federal AI code equivalent to the EU AI Act in the 2023 framework. Instead, it combined several layers:
- Executive-branch priorities and procurement requirements.
- Agency rulemaking and enforcement under existing consumer-protection, civil-rights, privacy, securities, employment and sectoral laws.
- Voluntary technical standards and risk-management guidance.
- State legislation and litigation.
- Sector-specific oversight in finance, health care, employment, education and critical infrastructure.
The Biden order directed agencies to develop model testing and red-teaming practices, address frontier-model safety, protect privacy and civil rights, reduce discriminatory outcomes, protect workers and consumers, and cooperate internationally. It did not establish a general federal AI regulator.
That distinction matters to financial institutions and consumers. A bank using an AI credit, fraud or customer-service system may already face obligations under fair-lending, consumer-protection, privacy and recordkeeping rules even when no rule is titled “AI law.” Regulation can attach to the use case rather than the model itself.

Why the U.S. model is flexible but difficult
Distributed oversight can adapt existing expertise to particular sectors. It can also produce overlapping requirements, different state standards and uncertainty about who is responsible when a vendor’s model causes harm. Companies must distinguish developer obligations from deployer obligations, federal rules from state rules, and mandatory requirements from voluntary guidance.
Lesson two: “AI risk” is not one problem
The 2023 debate often placed immediate consumer harms and speculative frontier risks in the same conversation. They are related, but they require different evidence, controls and responsible parties.
Immediate or demonstrated harms
- Discriminatory decisions in hiring, lending, insurance or public benefits.
- Fraud, impersonation and voice cloning.
- Privacy violations and misuse of personal data.
- Fabricated information and unreliable financial, medical or employment recommendations.
- Copyright and data-provenance disputes.
- Deceptive synthetic media and manipulation.
Frontier or systemic risks
- Cybersecurity misuse.
- Biological misuse.
- Rapid capability escalation and concentration of compute or model power.
- Loss-of-control scenarios.
- Large-scale disinformation.
The Bletchley Declaration specifically called for cooperation on frontier risks including deceptive content, cybersecurity, biotechnology and control problems, alongside safety testing, evaluations, transparency and scientific research. It is a declaration, not an enforceable statute.
The hard question is responsibility
Regulators must decide which harms require immediate intervention, which systems need pre-deployment testing and whether responsibility belongs to the model developer, cloud provider, deployer, employer or end user. A general-purpose model may be low risk as a writing assistant but become high risk when integrated into credit decisions, hiring, health care, education or law enforcement.

The durable regulatory issue is therefore allocation of responsibility across the AI supply chain—not a single verdict that a model is simply “safe” or “unsafe.”
Lesson three: AI regulation is industrial policy as well as consumer protection
Rules affect who controls advanced chips, cloud capacity, data, talent, standards and access to markets. Export controls and national-security measures can shape AI development as directly as safety requirements.
The EU AI Act illustrates this combination. Regulation (EU) 2024/1689 was adopted June 13, 2024, published July 12, 2024 and is in force. Its harmonized framework addresses prohibited practices, high-risk systems, general-purpose AI, transparency, governance and enforcement while also seeking to support innovation and the EU internal market. The EUR-Lex page identifies a consolidated version current as of July 27, 2026.
The United States, European Union, China and other governments are therefore pursuing different combinations of safety, rights protection, competitiveness and strategic autonomy. Shared principles do not mean identical legal mechanisms.

Influence is not convergence
EU market access may encourage global companies to build to EU expectations. U.S. agencies, standards bodies, cloud providers and frontier-model developers may shape technical practice. China’s approach is tied more closely to state security, content controls and industrial strategy. International declarations can create common vocabulary without creating common penalties or procedures.
For a company serving customers across borders, the practical result is a compliance map rather than one global rulebook.
Lesson four: Elections turned AI governance into a legitimacy test
Generative tools make deepfakes, cloned voices, synthetic campaign advertisements, candidate impersonation and targeted political persuasion cheaper. Foreign influence operations and platform labels add further complexity.
Election-related AI is not only a technical problem. It involves free-expression rights, electoral law, platform governance, authentication, provenance and public trust. A false audio clip can cause damage before a correction reaches the same audience; a label may disappear when content is copied or screenshotted.

Platform policies are not government regulation, and election rules differ by jurisdiction. Emergency measures also carry a risk of suppressing satire, legitimate political speech or journalism. AI may amplify deception, but attributing an election result to AI requires specific evidence about an identified incident, actor and effect.

Practical implications for companies and financial consumers
For companies deploying AI
- Maintain an inventory of models, vendors, datasets, agents and business uses.
- Record each system’s purpose, affected people, jurisdiction and risk classification.
- Test accuracy, bias, security, privacy, drift and failure modes before deployment and after material changes.
- Assign an accountable owner and define when human review can override the system.
- Keep contracts, documentation, incident records and evidence that controls operated.
- Check obligations in every market where the system is offered or its outputs affect people.
NIST’s AI Risk Management Framework offers a public starting point for identifying, measuring and managing risks. NIST says it is voluntary and intended to promote trustworthy development and use; it does not itself establish compliance with the EU AI Act or another law. Its FAQ explains that status.
For ordinary users and investors
- Ask whether an AI-generated financial recommendation has human accountability and a way to challenge errors.
- Do not treat a chatbot’s confident answer as verified tax, investment, credit or legal advice.
- Limit the personal and account information entered into public AI tools.
- Be skeptical of urgent investment messages, cloned voices and images that demand payment or credentials.
- Check original documents and official channels before acting on synthetic political or financial content.
Where governance software fits
Enterprise tools can help maintain inventories, approvals, risk assessments, monitoring and audit evidence, but buying software is not itself a legal requirement or proof of compliance. OneTrust describes those capabilities on its AI Governance page; the page presents pricing through demos and sales contact rather than a standard public per-seat price. It may suit a large organization already using OneTrust, but can be excessive for a small team with a few low-risk uses.
What comes next
Expect more sector-specific assessments, documentation and audit requirements; closer scrutiny of general-purpose and frontier models; continued reliance on standards and third-party assurance; and divergence between jurisdictions. Organizations that can show what systems they use, why they use them, how they tested them and what happens after failure will be better positioned than those treating AI governance as a one-time policy document.
