Congress has enacted a targeted restriction on certain data-broker transactions with foreign adversaries, but Americans still lack a single federal system to see, correct, delete, or broadly stop the sale of personal information. Federal watchdogs and privacy experts say lawmakers should address that gap because data brokers can combine public records, purchases, app activity, location signals and other sources into profiles that consumers rarely see or control.
What data brokers collect
A data broker is generally a company that collects, combines, analyzes, licenses, sells or otherwise provides access to personal information about people who may have no direct relationship with it. The industry is broader than familiar people-search websites.

Legal treatment depends on the information, buyer and purpose. Sector laws such as the FCRA, HIPAA and the Gramm-Leach-Bliley Act cover particular activities; they do not create one comprehensive rule for the entire market. How information enters the broker ecosystem
- Public, property, voter-registration and professional-license records where legally available.
- Retail loyalty programs, purchases and information supplied by companies with which you do business.
- Websites, mobile apps, cookies, pixels and advertising identifiers.
- Public social-media profiles and online directories.
- Data bought from other brokers and inferences generated by combining many records.
Removing a profile from one people-search site does not necessarily remove the underlying government record, a marketing database, another broker’s copy or a private database. Information can be refreshed, repackaged and resold.

Why exposure can be dangerous
Exposure is not limited to unwanted calls. A home address linked to relatives, workplaces, financial indicators or a location trail can increase risks of identity theft, account takeover, stalking, harassment and physical harm. Judges, prosecutors, police officers, journalists, elected officials, military personnel, health-care workers, executives and domestic-abuse or stalking survivors may face unusually serious consequences.
Commercial profiles can also reveal visits to medical, reproductive-health, religious, addiction-treatment or domestic-violence facilities; support discriminatory targeting or eligibility decisions; and produce inaccurate risk scores. Exposure does not by itself prove misuse or identity theft, but it can make those harms easier. Why federal protections remain incomplete
A patchwork of laws
The United States has sector-specific federal rules and a growing set of state laws, but no generally applicable federal privacy law governing most private-sector collection and sale of personal data. The GAO and CRS have documented that gap.

The burden falls on each consumer
Most people must find each broker, submit a request, verify identity and repeat the process when records return. A 2026 study found inconsistent compliance, intrusive verification demands and unreliable handling of requests: study of opt-out and deletion compliance.

Brokers typically know the sources, inferences and buyers while the person being profiled may not know what was collected or where it went. The FTC’s May 2014 recommendation called for greater transparency, access, correction and opt-out rights: FTC recommendation.
Verification can create another risk
Proof of identity is sensible, but demanding a driver’s license, Social Security number or unnecessary personal details can expand the information a broker holds. A federal process should favor data-minimizing authentication.

What Congress has done—and has not done
In April 2024, Congress enacted the Protecting Americans’ Data from Foreign Adversaries Act as part of P.L. 118-50. It restricts certain transactions involving sensitive U.S. personal data and foreign adversaries. That is a national-security measure, not a general right for every consumer to inspect or delete data held by domestic companies.
The 119th Congress has introduced the DELETE Act in both chambers. H.R. 2612 and S. 1287 are proposals, not enacted consumer rights. They would establish stronger disclosure and deletion mechanisms, including standardized information about collection and sources. The CFPB also describes a proposed Regulation V concerning sensitive information sold by data brokers; it should be called proposed, not final: CFPB proposal page.

Policy options lawmakers could combine
Comprehensive federal rights
- Know what information is held and its sources.
- Access a copy and correct inaccuracies.
- Delete data, subject to defined exceptions.
- Opt out of sale, sharing, targeted advertising and profiling.
- Limit sensitive-data use and appeal denied requests.
- Learn categories of buyers and retention practices.
A national broker registry
A registry could require brokers to identify themselves, describe data categories, sources, purposes and buyer categories, and report request metrics. It would improve visibility and enforcement, but a registry is not a ban on collection or sale. The DELETE Act texts and a Senate hearing illustrate this approach.

One authenticated deletion and opt-out channel
A federal platform could provide standardized requests, deadlines, status tracking, authorized-agent rules, secure verification, recurring suppression and correction procedures. California’s eligible residents can use the CPPA’s DROP platform. A national version would need broader coverage, auditing and expedited protection for people facing credible threats.
Stricter rules for sensitive information
Congress could prohibit or sharply limit commercial sale, licensing, renting, trading, sharing and API access involving Social Security numbers and government identifiers, precise location, biometric or genetic data, health and reproductive information, financial information, minors’ data and visits to sensitive facilities.
Rules for government purchases
Lawmakers could clarify when agencies may buy commercially available sensitive data rather than obtain it through a warrant, subpoena or another legal process. The answer may depend on the agency, source, data and purpose, so this is a policy question rather than a settled universal prohibition.

Stronger enforcement
- FTC rulemaking and investigative authority.
- Civil penalties for knowing or repeated violations.
- Audits, documentation and buyer-disclosure requirements.
- Remedies for materially inaccurate profiles that cause legally recognized harm.
- A carefully limited private right of action and whistleblower protection.
Objections and necessary safeguards
Compliance costs and innovation
Broad obligations could burden small businesses and organizations using data for fraud prevention, research, public safety or customer service. A workable law can use proportional duties, clear definitions and assistance for smaller entities. Industry concerns about efficiency and innovation are discussed in the GAO information-reseller report.
Federal uniformity versus state protections
A national rule could simplify compliance but might preempt stronger state laws. Congress would need to decide whether states may retain stricter protections; CRS examines that issue in its preemption analysis.
Deletion and public interest
Exceptions may be needed for fraud prevention, tax and legal records, journalism, public records, research, security, law enforcement, contractual obligations and protecting another person’s rights. Opt-out and opt-in are different: opt-out leaves collection lawful unless a person acts, while opt-in requires affirmative permission and could affect advertising, discounts or fraud screening.
What consumers can do now
- Search major people-search sites using current and former names, addresses, phone numbers and relatives.
- Use each site’s official opt-out or deletion process.
- Provide only the verification information reasonably necessary.
- Save confirmation emails, screenshots and request dates.
- Recheck periodically because records can be refreshed or republished.
- Use state privacy portals if eligible; California residents can start with DROP.
- Remove a home address from public-facing professional or business pages when lawful and practical.
- After a breach or suspicious activity, freeze credit where appropriate, secure accounts and monitor for identity theft.
Should you pay for a removal service?
Paid services can save time and repeat requests, but they cannot guarantee deletion from the internet, original public records, breach dumps or every downstream buyer. Coverage counts are not standardized, so compare the actual broker list, scan and resubmission frequency, removal evidence, difficult-site handling, custom-request fees, information required, refund terms and cancellation rules. Consumer Reports found substantial variation in effectiveness: study.

Manual opt-outs cost less money but more time. A paid service may be reasonable for someone with a large public footprint, repeated harassment, limited time or a need for recurring monitoring. It is not an emergency-response system or a substitute for specialized safety, legal or victim-services support.
The Bottom Line
Congress can make privacy protection practical by requiring broker transparency, standardized access and deletion rights, limits on sensitive-data transactions, controls on government purchases and meaningful enforcement. Until that happens, consumers must combine free opt-outs, security precautions and recurring checks—and treat commercial removal as convenience, not a guarantee.
