The European Commission fined Meta €797.72 million on November 14, 2024, over two alleged abuses of dominance involving Facebook Marketplace: tying the service to Facebook and imposing terms that let Meta use advertising-related data from rival classified-ad providers. Meta appealed the decision. The fine is not compensation for users or competitors, and it does not itself shut down Marketplace.
What the Commission says Meta did
The Commission’s decision concerns competition in the European market. It found that Meta abused dominant positions in personal social networking and online display advertising on social-media platforms, in breach of Article 102 of the Treaty on the Functioning of the European Union (TFEU). Being dominant is not illegal by itself; the legal question is whether a company used that position abusively. The Commission opened formal proceedings in June 2021 under case AT.40684. Its investigation notice and November 2024 decision announcement describe the case.
1. Marketplace’s connection to Facebook
The Commission’s tying theory was that Marketplace was automatically available to Facebook users, giving it access to Facebook’s large user base and a distribution advantage over standalone classified-ad services. In plain terms, the Commission said Meta used the reach of its social network to strengthen a separate service competing with those rivals.
This was not a ruling that every integration of Meta products is illegal, nor does the finding necessarily require Marketplace to become a wholly separate product. The Commission’s concern was the particular integration, Meta’s positions in the relevant markets, and the competitive advantage it said that combination created.

2. Terms and advertising-related data
The Commission also objected to contractual terms affecting rival online classified-ad providers that advertised on Facebook or Instagram. It said those terms gave Meta broad rights over advertising-related data and could allow Meta to use information connected with rivals’ advertising activity to benefit Marketplace. The Commission viewed this as an unfair competitive asymmetry: classified-ad rivals bought advertising from Meta while Meta could use related data in support of its competing service.
This part of the case concerns commercial and advertising-related data and the terms governing its use. It is not a finding that Meta took users’ private messages or Marketplace listings, and it is not a GDPR privacy ruling.

Why the fine was €797.72 million
The Commission set the fine under its 2006 fining guidelines, taking account of matters including the seriousness and duration of the infringement. The precise amount is €797.72 million; €798 million is the rounded figure often used in headlines. The penalty is a public-law fine paid into the general EU budget, not a damages award or a fund distributed to Facebook users or competing classified-ad companies.
Meta’s response
Meta rejected the Commission’s reasoning and said it would appeal. In its response, Meta argued that Marketplace grew from users’ existing buying-and-selling activity in Facebook groups, and that integrating the service with Facebook made it easier to discover and use. Meta also disputed that the Commission had shown sufficient harm to consumers or competitors. Those are Meta’s arguments, not findings established by the Commission.

Meta also announced a program under which qualifying third-party classified-ad services could list consumer-to-consumer inventory on Marketplace. That was Meta’s proposed response; the announcement alone does not establish that the Commission approved it as full compliance with its order. Meta’s account is available in its response to the decision.
What this means for Facebook users and sellers
- Users do not have to pay any part of the fine, and the decision does not create an automatic compensation scheme.
- The fine does not itself close Marketplace or require users to delete Facebook, move listings, or take another specific action.
- Possible practical changes could concern how Marketplace is integrated with Facebook or whether rival classified services can list inventory there. The exact user experience depends on Meta’s compliance measures and subsequent enforcement or court proceedings; the decision does not establish a particular new button, menu, or layout for every country.
Meta’s antitrust appeal: what is known
Meta filed an action seeking annulment of the Commission’s antitrust decision on January 28, 2025. The EU Official Journal’s notice of the action identifies challenges involving the tying theory, data-use theory, and fine.

The available procedural information confirms the appeal filing, but does not establish a final merits judgment on the Article 102 fine as of August 18, 2026. Filing an appeal is not the same as winning or losing it. The fine should not be described as finally upheld, annulled, paid, or otherwise resolved without a later official ruling specifically addressing this antitrust decision.

A separate proceeding concerned whether Facebook Marketplace qualified for designation as a gatekeeper service under the Digital Markets Act (DMA). The Commission concluded in April 2025 that Marketplace should no longer be designated under the DMA after finding it had fewer than 10,000 business users in 2024. In a separate case, the General Court annulled the DMA designation in a judgment dated June 3, 2026. Neither development decided Meta’s appeal against the Article 102 antitrust fine.

The Commission’s DMA announcement and the General Court’s Case T-1078/23 judgment concern that separate designation question. The two proceedings involve different legal rules and questions; the DMA outcome is not an appeal ruling on the antitrust fine.
