ESMA Sets MiCA Wind-Down Limits for Unauthorised EU Crypto Providers

ESMA’s 2026 wind-down guidance applies to crypto providers unable to continue under MiCA; separate 2025 guidance addressed non-compliant stablecoins.

Not automatically. ESMA says a crypto-asset service provider (CASP) that cannot continue under MiCA should restrict services to actions needed for an orderly exit; custody may continue only as long as strictly necessary to complete that exit. This 2026 guidance concerns providers’ authorisation status, not a new blanket ban on holding or transferring stablecoins. A separate ESMA statement in January 2025 addressed services involving certain non-compliant stablecoins.

Two different MiCA issues are often confused

MiCA is the EU’s uniform framework for crypto-assets. The stablecoin rules and the authorisation rules for crypto service providers can affect the same platform, but they address different problems and have different timelines.

A stablecoin may be non-compliant even when a provider is authorised; a provider may lack MiCA authorisation even when it offers compliant tokens. A platform can also face both issues. Check which one its notice actually identifies.

What the end of the transition means for a platform

ESMA’s MiCA overview describes a transitional allowance for certain providers already operating under applicable national law before 30 December 2024. The general endpoint was 1 July 2026, unless authorisation was granted or refused earlier. The transition was not available to every provider: eligibility depended on the applicable transitional rules and the provider’s circumstances. ESMA’s MiCA overview.

Where a provider cannot continue lawfully, ESMA says it should stop onboarding new EU clients and limit its services to actions necessary to sell or transfer crypto-assets, reallocate assets, or close positions. This is a controlled exit, not permission to carry on ordinary business without authorisation. ESMA’s June 2026 statement.

Can the platform keep custody or process a transfer?

ESMA’s position is not that custody and transfers must end at the same instant for every customer. A provider may retain custody only for the period strictly necessary to complete an orderly wind-down. The statement does not set one universal final custody date for every provider; the timing depends on the exit process.

ESMA’s April 2026 statement says wind-down plans should avoid undue economic harm to clients and may include arranging for clients’ assets to be transferred to another authorised CASP or to a self-hosted wallet. ESMA put the principle this way: “Wind-down plans enable an orderly exit without causing undue economic harm to clients”. ESMA’s April 2026 statement.

That does not guarantee that every requested transfer will be available immediately or that a platform must support every destination or asset. The allowed service is bounded by what is necessary to wind down; ask the provider for its process and deadlines rather than assuming normal withdrawals or trading remain available.

What to do if your platform says it is winding down

  1. Identify the reason. Check whether the notice refers to the stablecoin’s MiCA compliance, the provider’s authorisation, or both. The restrictions and relevant dates differ.
  2. Check the provider’s status. Use ESMA’s official MiCA information and authorisation resources to confirm whether the provider is authorised and whether a transition applied. ESMA’s MiCA overview.
  3. Read the wind-down instructions promptly. Look for deadlines, supported assets and networks, fees, transfer steps, and whether the platform proposes a transfer to an authorised CASP or a self-hosted wallet.
  4. Ask how custody and access will work during exit. Request clear information about the timing and steps for moving or closing your position. France’s AMF says providers should communicate clearly with clients and maintain effective anti-money-laundering and counter-terrorist-financing controls during wind-down. AMF’s summary.
  5. Keep records. Save the provider’s notices, account statements, transaction history, and any withdrawal confirmations for your own records and any later account or tax questions.

MiCA also restricts delegation of custody to unauthorised CASPs, as noted in the AMF summary. A platform’s proposed destination should therefore be checked rather than treated as authorised merely because the platform recommends it. AMF’s summary.

ESMA’s later review proposals are not the same as rules already in force

On 30 September 2026, ESMA responded to the European Commission’s MiCA review consultation with recommendations that include changes touching non-compliant stablecoins. Those are proposals, not proof that MiCA has been amended or that a new restriction has taken effect. ESMA’s 30 September 2026 response.

For a decision about a particular account, rely on the applicable MiCA rules, the provider’s authorisation and wind-down notices, and current official information. The September response alone does not establish the later legislative outcome.
