Elon Musk’s Email Threat to Federal Employees Falls Flat

Elon Musk’s five-bullet-point email ultimatum produced conflicting agency instructions, legal challenges and security concerns—not a uniform, enforceable rule for federal employees.

Elon Musk’s demand that federal employees list their recent accomplishments failed as a government-wide enforcement mechanism. Musk publicly threatened that employees who did not respond would be treated as having resigned, and later said a second failure could lead to termination. But the Office of Personnel Management (OPM) reportedly told agency leaders that employees were not required to answer by the stated deadline, while agencies issued sharply different instructions.

The result was confusion, litigation and competing chains of command—not a single enforceable personnel rule. That narrow failure does not mean the administration abandoned its broader effort to reduce the federal workforce.

What Musk asked federal employees to do

Musk announced that federal employees would receive an email asking them to explain what they had accomplished during the previous week. His public message said that failing to respond would be treated as a resignation. In a later post, he said employees would receive another opportunity at the president’s discretion and that failing to respond a second time would result in termination.

The subsequent OPM message asked employees to submit approximately five bullet points describing their accomplishments and to copy their manager. The reported deadline was 11:59 p.m. Eastern on Monday, February 24, 2025. The OPM email itself reportedly did not say that noncompliance would result in firing. (Associated Press; FedScoop)

Why the ultimatum fell flat

No single chain of command

The federal government is not one ordinary private-sector employer. Departments and agencies operate under different statutes, personnel systems, supervisors, security rules and appeal procedures. A message associated with OPM or Musk could not automatically replace each agency’s own instructions.

Contradictory guidance

Some employees were told to respond, some were told responding was optional, and others were told not to answer. That contradiction weakened the idea that silence could uniformly be interpreted as a resignation.

OPM undercut the deadline’s mandatory character

According to AP reporting, OPM told agency leaders that employees were not required to respond by the 11:59 p.m. Monday deadline. That reportedly conflicted directly with Musk’s public threats. It is more precise to say OPM qualified the deadline than to say it permanently declared the entire initiative voluntary or that a court invalidated it.

Security and logistics problems

Workers in law enforcement, defense, diplomacy, intelligence, health and litigation-related roles may not be able to describe their work safely in a generic email. Employees could also be on leave, away from secure systems or unable to access work email. A process aimed at as many as roughly 2 million workers raised basic questions: Who would review the submissions, what rubric would be used, how would sensitive information be protected, and what would the review cost? How agencies responded

Agency or department Reported guidance
FBI Employees were told to pause responses because the bureau already had its own review procedures.
Justice Department Employees generally did not need to respond because of confidential and sensitive work; some U.S. attorneys were told to answer only in general terms.
Health and Human Services Staff were told there was no expectation that they respond. Anyone choosing to do so was told to remain vague and assume foreign actors could read the message.
Education Department Employees were told the email was legitimate and should respond; supervisors would evaluate responses and nonresponses.
State Department, Homeland Security and Pentagon AP reported that employees were instructed not to respond.
OPM Acting Director Charles Ezell suggested weekly accomplishment bullets might become a future expectation, but that is different from establishing that the original deadline was an immediately enforceable termination rule.

These instructions show why claims that “all federal agencies rejected Musk” are inaccurate. The response was fragmented, with at least one department directing compliance while several others prohibited or discouraged replies. (Associated Press)

Did Musk have authority to fire federal employees?

The reporting does not establish that Musk personally possessed ordinary hiring-and-firing authority over the entire federal workforce. He was leading the administration’s Department of Government Efficiency (DOGE) effort, but influence over policy is not the same as statutory authority to issue adverse personnel actions across unrelated agencies.

Federal employees are generally covered by agency-specific procedures, civil-service protections, performance requirements and, in many cases, due-process and appeal rights. A public post by a White House adviser or DOGE official is not automatically a formal dismissal action. The administration could still pursue workforce reductions through separate mechanisms, including agency decisions, probationary dismissals and resignation incentives. What litigation and lawmakers challenged

Attorneys for unions, businesses, veterans and conservation organizations filed an updated federal lawsuit in California arguing that Musk violated the law by threatening mass firings. The litigation also raised concerns about OPM’s use of a system capable of sending mass messages to the federal workforce.

More than 100 House Democrats separately asked agency heads to tell employees that they were not required to respond and that nonresponse could not constitute resignation. Those filings and letters show the seriousness of the legal dispute, but the cited reports do not establish a final merits ruling resolving every issue. Trump backed the demand

President Donald Trump publicly supported Musk’s request and described it as a way to determine whether federal employees were actually working. Trump also said DOGE had found “hundreds of billions of dollars in fraud,” but AP reported that he did not provide evidence for that claim. His support matters because the episode was not simply a rogue Musk initiative; it had presidential backing even as agencies received opposing operational instructions. (Associated Press)

What “fell flat” means here

The phrase should be understood narrowly. The email initiative:

  • did not produce uniform compliance across agencies;
  • did not establish a clear government-wide personnel rule;
  • ran into legitimate confidentiality and security constraints;
  • created practical problems for employees on leave or without secure access;
  • prompted resistance from agencies, lawmakers and unions; and
  • triggered litigation over the threatened mass firings.

It therefore performed poorly against four basic tests for a government-wide accountability system: legal enforceability, administrative clarity, operational usefulness and information security. A short output report may be workable in a private company, but federal employment requires defined authority, supervisors, classification rules, security controls and appeal mechanisms.

That conclusion is narrower than saying Musk lost all influence or that the administration’s workforce-reduction campaign ended. It means this particular ultimatum did not become a coherent, automatically enforceable order for the federal government.

What federal employees should do when instructions conflict

This article is not individualized legal advice. As a general precaution, an employee facing conflicting messages should:

  • follow the latest instruction from the employee’s own agency, supervisor and designated personnel office;
  • avoid putting classified, privileged, investigative or otherwise sensitive information in a general email;
  • preserve the original message and any contradictory agency guidance;
  • contact a union representative, agency ethics or personnel office, or a qualified employment lawyer if retaliation is threatened; and
  • not assume that a public statement by Musk overrides the employee’s agency procedures.
