Elon Musk’s Boring Company Is Tunneling Beneath Las Vegas With Little Oversight

Las Vegas’ Vegas Loop is real and operating, yet its private approval pathway avoided some conventional transit review. Here is what records show about permits, groundwater, OSHA, safety reporting and expansion.

The Vegas Loop is operating beneath Las Vegas, but it is not yet the completed 68-mile transit network often implied by promotional material. The Boring Company’s initial convention-center route and several hotel connectors are open, while more tunnels are being built. A January 2025 ProPublica investigation found that the privately financed project avoided some of the planning, environmental review and reporting requirements normally attached to a major publicly funded transit system. It also documented specific permit violations, groundwater incidents, workplace citations and the removal of a county permit that had added inspection and injury-reporting authority.

What the Vegas Loop actually is

Loop uses driver-operated Tesla vehicles in narrow, single-lane tunnels. Rather than trains stopping at every station, vehicles are intended to travel directly between selected stations. The project has three different meanings that should not be confused:

  • LVCC Loop: The original Las Vegas Convention Center route opened in April 2021. The company says its 2024 expansion brought it to 2.1 miles and five stations.
  • Operating connectors: The company lists Resorts World, Westgate and Encore connections as operational on its project pages.
  • Planned Vegas Loop: Clark County and Las Vegas approved a much larger concept of 68 miles and 104 stations. That is an approved or entitled plan, not a completed network.

ProPublica reported roughly five miles completed by early 2025, with fewer miles actually in use. The company continues to describe additional tunnels as under construction. Its long-term map includes Harry Reid International Airport, Allegiant Stadium, downtown Las Vegas and Strip resorts, but the airport connection remains a future or sought link rather than an established passenger station.

The company’s pages also disagree about current usage. One says more than 3 million passengers through eight stations; another says more than 4 million through 11 stations. A separate company FAQ gives a different figure. These are company claims with apparently different update dates or counting methods, not reconciled independent statistics.

Why the project received a different kind of scrutiny

The Loop began as a comparatively small, privately financed convention-center project. It did not receive federal funding, and that meant it did not pass through the same regional transportation-planning and federal environmental processes normally associated with a major public transit investment. The Regional Transportation Commission of Southern Nevada therefore did not have the role it would ordinarily have in a publicly funded regional system.

That distinction does not mean there were no permits or regulators. Clark County, the city, state environmental officials, Nevada OSHA, fire authorities and franchise agreements all imposed requirements. The issue identified by the investigation is that oversight was fragmented and less comprehensive in important areas.

How expansions reached approval

Applications were sometimes filed under limited-liability companies associated with hotels or property owners rather than under an obvious “Vegas Loop” name. ProPublica reported a 2023 approval for roughly 25 miles and 18 stations under a property-company name, alongside earlier approvals involving Caesars and Circus Circus properties.

This structure matters to ordinary residents. A transportation project can have significant effects on streets, emergency access and regional mobility while appearing in public agendas as a private property or zoning matter. Officials also voted on expansions while only a small portion of the proposed network had been built.

The documented environmental and construction record

Groundwater discharges

Excavation can encounter groundwater near an area contaminated with tetrachloroethylene, or PCE. The available record does not establish that every discharge was contaminated, but it does show repeated concerns about permits and treatment:

  • In 2019, the company settled with the state over groundwater discharged to storm drains without a permit and paid a $90,000 fine.
  • State officials sent a cease-and-desist letter in 2021 over possible unpermitted discharges.
  • Local officials cited an unauthorized sewer connection in 2022.
  • In 2023, state environmental regulators documented untreated groundwater entering the sewer system. One official wrote that company staff were unsure how long a treatment system had been bypassed.
  • Local officials said they investigated the 2023 event and found no evidence warranting further action.

Work in public rights of way

In 2023, the company tunneled on county property without the required permits. A county Public Works director described that as a violation of the franchise agreement. The permits were later filed and approved retroactively, reportedly at $900 per permit.

Muck, gravel and roadway spills

Reporting described mud spilling from a worksite truck onto public streets and a truck carrying gravel, rock and sand spilling material onto Interstate 15, disrupting rush-hour traffic for more than four hours. A driver received a $75 fine for an unsafe or unsecured load. A contractor also stored tunnel muck near apartments and a shopping center while relying on a permit held by another county contractor; the county reportedly issued a $1,549 fine.

Those records involve the company, contractors or hauling operations. They do not establish that Musk personally directed each event.

Workplace complaints and OSHA enforcement

Workers complained to Nevada OSHA about “ankle-deep” water in tunnels, muck spills, severe chemical burns and other conditions. After a 2023 investigation, Nevada OSHA fined the company more than $112,000. The complaints and the agency’s enforcement should be distinguished: not every allegation was necessarily substantiated at the same level, but the fine is an official enforcement outcome.

The permit that was removed

The clearest oversight issue concerned a county “amusement and transportation system” permit. It required operators of certain private transportation systems to report serious injuries and fatalities and gave the county additional inspection authority. County inspections under that framework identified issues including speeding drivers and unauthorized vehicles entering stations.

The Boring Company argued that Loop did not fit the ordinance and that the permit complicated operations. It proposed structural, civil, fire, electrical and plumbing studies plus emergency plans. According to the investigation, the replacement proposal did not clearly explain what would substitute for the former permit’s inspection powers and immediate injury-reporting requirements.

Removing that layer did not eliminate every safety rule. It did, however, create a specific accountability gap: the public question is who independently inspects an expanding private network and who receives prompt, mandatory reports when serious events occur.

Tunnel breaches and the company’s safety claims

Earlier Fortune coverage and county inspection records cited by ProPublica counted at least 67 tunnel breaches since 2022. The incidents included outside vehicles, a skateboarder and a pedestrian. This is a count of breaches, not a count of crashes, injuries or system failures, and it does not by itself prove passenger harm.

The company says its system has emergency exits, fire detection and suppression, fire-rated first-responder communications, a 24/7 operations control center, Blue Light Stations, LTE and Wi-Fi, full lighting and camera coverage, and no electrified third rail. It also says it has tested jointly with local police and fire departments. Boring’s materials say the LVCC Loop received the Transportation Security Administration’s Gold Standard Award in 2025 and a 99.51% score across 17 categories. Those are company-reported claims, not proof that TSA operates or certifies the entire transit system.

Engineering equipment and regulatory governance answer different questions. Cameras, ventilation and emergency exits do not by themselves establish independent inspection, public incident reporting, emergency-drill validation or accountability as new corridors open.

Tourism authorities, hotels and public money

The Las Vegas Convention and Visitors Authority backed the initial project and pushed for expansion. Its mission is tourism and conventions rather than conventional regional transit, and its governing board includes substantial gaming-industry representation.

According to the ProPublica investigation, the authority funded the original 0.8-mile route with $52.5 million in bonds, paid Boring about $4.5 million per year to operate it, and spent $24.5 million to purchase the Las Vegas Monorail out of bankruptcy. The purchase gave Boring access to the monorail’s former noncompete territory. These arrangements do not establish improper conduct; they show how tourism agencies and hotel interests became central actors in a project with metropolitan transportation consequences.

Why the airport connection raises a separate issue

A route to Harry Reid International Airport would involve Federal Aviation Administration requirements and federal environmental review, according to the investigation. The company’s current Vegas Loop page presents the airport as a future destination. Passenger service there should therefore be treated as planned unless an independent current source confirms an opening.

What remains unknown

  • How frequently independent government agencies inspect the operating tunnels after removal of the special permit.
  • Whether the replacement oversight plan provides equivalent immediate reporting of serious injuries and fatalities.
  • A reconciled, independently verified passenger total and station count.
  • Public data on injuries, serious incidents, emergency drills, service reliability and maintenance.
  • Which agency has final responsibility when a system using public rights of way expands into a new corridor.

Why this matters beyond Las Vegas

Private financing can make a small project faster and avoid delays associated with large public capital programs. The trade-off is that a private operator may enter the transportation system through zoning, hotel agreements and franchise approvals rather than a single transparent regional process.

Las Vegas therefore presents a policy test for other cities: if a privately financed network carries tourists and residents beneath public streets, should it meet public-transit standards for environmental review, accessibility, fare oversight, independent safety analysis, inspections, emergency responsibility and disclosure? The practical importance of the Loop may exceed its legal label as a private development.

Bottom line

Vegas Loop is neither an entirely unregulated project nor a conventionally scrutinized public-transit system. It is a real operating network with additional construction underway, documented permits and agency enforcement, and company-designed safety systems. But its private funding and development pathway bypassed or reduced some layers of regional review, and the county’s removal of a special inspection and reporting permit left important accountability questions. “Little oversight” is most accurate as a description of those gaps—not as a claim that no government oversight exists or that the entire system has been proven unsafe.
