The reported $20.5 million CVS settlement concerns alleged disclosures of information from CVS digital properties—not the separate CVS data-breach case. People who accessed CVS websites or the app in the United States before July 27, 2026, may be eligible to claim up to $5 without documentation or up to $10 with proof. The settlement is proposed, not finally approved, so payments are not yet guaranteed.

Which CVS settlement is this?

This is the proposed settlement in Brewer et al. v. CVS Pharmacy, Inc. and Criteo Corp., Case No. CACE-26-008094. The lawsuit alleges that technology embedded in CVS digital properties disclosed user data. The settlement resolves allegations; it is not a court finding that CVS or Criteo violated the law. The $20.5 million figure is the reported settlement fund, not an amount payable to each person. ClassAction.org’s case report describes the allegations and proposed settlement.

This case is distinct from the CVS data-breach litigation, which has different terms and deadlines. The data-breach settlement FAQ is for that separate case.

Who may qualify?

Reports describe the proposed class as people who were living individuals and accessed CVS digital properties in the United States before July 27, 2026. Examples include cvs.com, cvshealth.com, and the CVS app. A purchase made at a physical CVS store, by itself, is not the reported eligibility criterion. See the reported class description in NBC Chicago’s coverage.

Because the settlement website’s current eligibility instructions could not be independently confirmed, check the official settlement site or contact its administrator before filing. Confirm that your particular use of a CVS digital property fits the class definition.

How much could a claim pay?

Settlement reporting describes two claim options. The amounts are maximums, not guaranteed payments; the amount paid may be reduced pro rata based on valid claims and the net fund remaining after settlement expenses. ClassActionTracker’s terms summary reports the following options:

Claim without documentation Up to $5 No supporting document reported as required
Claim with documentation Up to $10 Proof of class membership; examples reported include dated browser history, screenshots, or email receipts for online orders

Before choosing, review the administrator’s current instructions for what proof is accepted and how to submit it. Do not assume the higher maximum means a guaranteed $10 payment.

How to check eligibility and submit a claim

  1. Find the official settlement website. Use the case name and case number, CACE-26-008094, to distinguish it from other CVS settlements. Confirm that you are on the digital privacy settlement site.
  2. Read the current class definition and claim instructions. Check the applicable dates, geographic requirement, accepted proof, filing method, and any required form details directly with the administrator.
  3. Choose the claim option that fits your records. The reported no-documentation option has a maximum of $5; the documented option has a maximum of $10. Follow the official directions rather than sending records in an unrequested format.
  4. Submit by the reported deadline. Settlement coverage lists November 16, 2026, as the claim deadline. Verify the date and submission requirements with the administrator before filing.
  5. Keep a copy of what you submit. Save the confirmation or mailing records and check the settlement site for updates about approval and payment.

The official website and FAQ were inaccessible when checked, so the exact form fields, mailing address, and payment methods are not established here. For current operational details, rely on the official settlement website or its administrator, not a different CVS settlement page.

When could payments arrive?

Reports list a final approval hearing for December 1, 2026. Payment depends on court approval and resolution of any appeals; filing a claim does not mean a payment will be sent immediately. The reported schedule and case status should be checked with the settlement administrator because dates or procedures can change. ClaimDepot’s settlement listing reports the claim deadline and hearing date.
