Credit Unions’ Legal Battles With Fiserv Continue: What the Lawsuits Allege

Several U.S. credit unions have active, separate lawsuits alleging cybersecurity and contract failures by Fiserv. The cases remain unresolved and are at different stages.

Several U.S. credit unions are pursuing separate, related lawsuits against Fiserv, Inc. and Fiserv Solutions, LLC over alleged cybersecurity failures and what Fiserv represented about the security of its online-banking services. As of October 1, 2026, the cases remain active, but they are at different stages. No final finding of liability, damages award, or settlement is established in the available case information.

What is the Fiserv credit union lawsuit about?

There is not one nationwide class action identified here. The litigation consists of separate disputes, with plaintiffs alleging that Fiserv failed to provide promised cybersecurity protections or misrepresented its security capabilities in agreements and related materials for online-banking and other services.

The allegations concern matters such as security controls, authentication, and breach handling. They are claims made by credit unions in court filings, not established findings that Fiserv did anything wrong.

Which credit unions are suing Fiserv?

Self-Help Credit Union

Self-Help, based in North Carolina, filed its case in 2025; the docket shows a filing on December 4, 2025. In March 2026, the court ordered mediation. The parties subsequently litigated discovery and protective-order matters, and Fiserv filed a motion to dismiss on March 23, 2026. The docket also lists discovery motions in April. The case is therefore in active litigation, not resolved.

FiCare Federal Credit Union

FiCare filed in Florida on January 27, 2026. It filed a second amended complaint on July 2. On July 6, the court denied Fiserv’s earlier motion to dismiss as moot because the amended complaint had replaced the earlier pleading. That procedural decision did not decide whether the allegations are true.

The court’s case-management schedule sets May 7, 2027 as the discovery deadline and June 4, 2027 as the deadline for dispositive motions.

Polam Federal Credit Union

In a June 23, 2026 report, Payments Dive said a California judge denied Fiserv’s motion to dismiss and allowed all eight claims in Polam’s case to proceed. The judge indicated that the issues would be better addressed at summary judgment, after evidence is developed. That ruling allowed the case to continue; it was not a final decision on liability.

Other related matters

Payments Dive also identified related cases in New York and Indiana. Dockets were located for Midwest Family Federal Credit Union and Educational & Governmental Employees Federal Credit Union. The available information does not establish the filing dates, current procedural status, or specific allegations for those matters, so they should not be treated as having the same posture as the three cases described above.

What cybersecurity conduct do the plaintiffs allege?

A complaint in a related credit-union dispute alleges that “Fiserv promised world-class cybersecurity but delivered insecurity and dangerous deception.” That is the plaintiff’s characterization in a pleading, not a court’s finding.

The same complaint alleges that Fiserv’s Virtual Branch online-banking platform and Client360 portal had longstanding security problems and “routinely exposed over 9,000 credit union members to fraud, identify [sic] theft, and compromise.” The figure is an allegation in a complaint filed in 2025; it is not an independently verified count or a judicially established fact.

Payments Dive summarized Polam’s claim as alleging that deficient and misrepresented cybersecurity practices left systems and member information vulnerable to unauthorized access. Across the disputes, the central question is whether Fiserv’s actual security practices met the obligations and representations alleged in the relevant contracts and materials.

Is the Fiserv lawsuit still going on, and did a judge rule against Fiserv?

Yes. As of October 1, 2026, the identified cases are ongoing, with different schedules and procedural events. Self-Help is handling discovery and motions; FiCare has a schedule extending into 2027; and Polam’s claims survived a motion to dismiss.

Surviving a motion to dismiss means a case or claim may proceed past that stage; it does not establish that the defendant is liable. Likewise, FiCare’s earlier dismissal motion being denied as moot because of an amended complaint is not a ruling on the underlying allegations. The available information identifies no final merits judgment, damages award, or settlement.

What the cases could mean for credit unions and members

The lawsuits may clarify how courts assess cybersecurity promises and vendor responsibilities in financial-technology contracts. For now, they do not establish that every Fiserv client experienced a security failure, nor do they establish an individual member’s entitlement to compensation. The eventual outcomes will depend on evidence and rulings in the separate cases.
