On July 29, 2024, the U.S. Consumer Product Safety Commission (CPSC) determined that Amazon acted as a “distributor” under the Consumer Product Safety Act for certain hazardous products sold by third-party merchants and shipped through Fulfilled by Amazon (FBA). The decision covered more than 400,000 products in three categories—not every defective item sold on Amazon—and addressed recall remedies, not automatic compensation for injuries.
A January 2025 remediation order described notices, disposal instructions and full purchase-price refunds, but that order was stayed while Amazon pursued federal-court review. The latest status should therefore be checked against the CPSC adjudicative-proceedings docket.
What the CPSC actually decided
The CPSC—not the Federal Trade Commission, Food and Drug Administration or a trial court—held that Amazon was a distributor for the products at issue because its FBA operations included receiving, storing and delivering them. The Commission adopted the administrative law judge’s finding in its July 29, 2024 decision. The CPSC announcement was issued July 30.
This was an administrative adjudication under the Consumer Product Safety Act. It was not a civil judgment awarding damages, a finding that Amazon manufactured the goods, or a ruling that Amazon is automatically liable for every third-party product sold on its website. It concerned the CPSC’s authority to require recall-related notification and corrective action for products presenting a substantial product hazard or violating federal safety requirements.

Which products were covered?
The proceeding identified specific products and ASINs sold by third-party merchants on Amazon.com and handled through FBA. It did not cover every product in these broad categories.

The CPSC and its January 2025 announcement describe the total as more than 400,000 products. That figure should not be read as every carbon-monoxide detector, hair dryer or children’s pajama set sold on Amazon.
Why Fulfilled by Amazon mattered
FBA was the central factual issue. Depending on the seller’s enrollment and service arrangement, Amazon can receive inventory, store it in its facilities, pick and pack orders, ship them, handle returns, provide customer service and process refunds. The CPSC concluded that this operational role placed Amazon within the CPSA’s distributor framework for the identified products.

FBA orders
With FBA, a third-party merchant generally owns or lists the goods, while Amazon performs the physical fulfillment and much of the post-sale operation. That combination was the basis for the CPSC’s finding in this case.
Seller-fulfilled orders
A merchant that stores and ships its own inventory presents a different factual and legal posture. The decision does not automatically establish that Amazon is a distributor whenever a seller-fulfilled listing appears on the marketplace.
Amazon-sold products and listings only
Products sold directly by Amazon were not the central issue in this proceeding. Nor does a marketplace listing alone prove that Amazon received, stored or delivered the product.
What “responsible” means here—and what it does not
Amazon was found responsible for recall-related remedies under the CPSA: notifying people about the hazard and taking steps designed to remove the products from consumers’ possession and commerce. The finding does not decide whether Amazon owes damages for a particular injury, death, property loss or warranty claim.

- An injured consumer may have separate state-law product-liability, negligence or warranty claims, depending on the facts and applicable law.
- A CPSC recall remedy is not automatically payment for medical bills, lost wages, pain and suffering or other consequential losses.
What the January 2025 remedy order required
On January 16, 2025, the Commission approved notification and action plans. The order described the following measures:
- Post the recall releases on Amazon.com.
- Email original purchasers directly.
- Display recall information in purchasers’ Your Orders pages.
- Notify FBA participants that sold the affected products.
- Offer a full purchase-price refund to consumers who provide proof that they destroyed or disposed of an affected product, following the applicable instructions.
- Keep recall releases on Amazon’s Recalls and Product Safety Alerts page for at least five years.
- Submit monthly progress reports and keep compliance records for five years.
The order and announcement are at cpsc.gov. Amazon sought a stay, and the stay order is available at this CPSC PDF. Because the final order was stayed pending federal district-court judgment, readers should not assume every planned remedy is currently operating nationwide.
Amazon’s position
Amazon argued that third-party sellers set prices and offer the goods, while manufacturers, importers or sellers generally bear primary responsibility for compliance. It characterized itself as a marketplace and logistics intermediary and said treating its services as distributor activity could expand marketplace obligations beyond traditional fulfillment. Amazon said it was disappointed and intended to seek judicial review. Its response is available in its filed response.
The CPSC’s contrasting view was that Amazon’s control over inventory, delivery, returns, refunds and customer communications was extensive enough to trigger distributor responsibilities for these products. Whether that reasoning controls other marketplaces or service models remains fact-specific and subject to further judicial proceedings.

- Check Amazon’s Recalls and Product Safety Alerts page and search the CPSC recall database.
- Review your Amazon order history, including the product model, ASIN, seller and fulfillment details.
- Stop using a product identified in an official recall.
- Follow that recall’s specific instructions for return, destruction, replacement or refund.
- Do not destroy an item unless the official notice authorizes or requires destruction.
- Save the order record, photographs, model number, ASIN, seller information and communications.
- If anyone was injured or property was damaged, consult a qualified lawyer rather than assuming the CPSC order provides injury compensation.
Gift recipients may not be the original purchasers, which is why public notice matters. Second-hand buyers may not appear in Amazon’s order records and should use the public recall notice. The cited proceeding concerns U.S. CPSC authority and American consumers; purchases made outside the United States may be governed by different agencies and remedies.
What sellers and other marketplaces should take from it
FBA sellers should treat fulfillment as no substitute for product testing, certification, labeling, traceability and a recall plan. The ruling does not relieve a manufacturer, importer or merchant of responsibility, but it signals that a marketplace with physical custody and post-sale control may face its own recall obligations.
For other platforms, the decision is a regulatory signal rather than a universal rule. The relevant facts may include who stores inventory, controls shipping, handles returns, communicates with buyers and possesses purchaser data. The CPSC has not thereby established that every platform or every seller-fulfilled transaction has the same legal status.

Frequently Asked Questions
Does the ruling cover every defective product sold on Amazon?
No. It covers identified products in three categories that third-party merchants sold and Amazon handled through FBA. It is not a blanket finding about every marketplace listing or ordinary defective purchase.
Does this mean Amazon must pay for an injury?
Not automatically. The CPSC order concerns recall notification and remediation. Personal-injury, wrongful-death, property-damage and warranty claims require separate legal analysis.
Does it apply to seller-fulfilled orders?
The decision turned on Amazon’s receipt, storage and delivery of the products through FBA. A seller-fulfilled transaction presents different facts and is not automatically covered.
Must I destroy an affected product?
Only if the official recall notice or Amazon/CPSC instructions require or authorize destruction. Keep proof if the instructions require it for a refund.
