Yes—but “illegal database” is shorthand, not a single worldwide court judgment. Clearview AI scraped publicly accessible photographs, converted detected faces into searchable biometric vectors, and sold investigative search access. Privacy regulators in Canada, France, Italy, Greece, the Netherlands and the United Kingdom found that this processing breached local data-protection rules and issued fines, deletion orders, collection bans or other restrictions. The company still operates, while several legal consequences remain jurisdiction-specific or under appeal.
What Clearview AI does
Clearview is a reverse facial-search service. A customer uploads a photograph, and the system compares the face with vectors stored in Clearview’s database. Results can include visually similar images and links or other context associated with the pages where those images appeared. Clearview describes the product as a post-event investigative tool rather than continuous real-time surveillance; that is the company’s characterization, not a finding that removes civil-liberties concerns. How the database was built
- Automated crawlers located publicly accessible images.
- Software detected faces in those images.
- The system extracted mathematical facial vectors, also called faceprints.
- Vectors were stored with the image and source-page information in a searchable index.
- A customer could submit another image and search for similar vectors.
The UK Upper Tribunal described a system containing “tens of billions” of mapped images. Clearview’s current FAQ claims more than 70 billion public images; that larger figure is a company-reported claim, not an independently verified count. See the Upper Tribunal judgment and Clearview FAQ.
Why regulators treated public photos as a privacy problem
Making a photograph viewable online is different from turning it into a biometric identifier and indexing it for identity searches. Regulators focused on the complete processing chain:

No adequate lawful basis
Authorities generally rejected the idea that a photograph’s public visibility, by itself, authorized mass biometric collection and investigative use.
Biometric extraction changes the risk
A face vector is machine-readable identity information. It can be searched against a new image, unlike an ordinary photograph that someone merely views or links to.
People were not given meaningful notice
Most people whose images were collected were not told that their pictures would be harvested into a facial-recognition service supplied to investigators.

The purpose was changed
A photograph posted for a personal, professional or social purpose was repurposed for identity-searching and law-enforcement investigations. Regulators considered that use incompatible with the original context.
Rights were difficult or impossible to exercise
Investigations cited failures involving information duties, access, objection and deletion requests. Canada’s joint privacy investigation described billions of collected images and derived biometric vectors as an indiscriminate and major privacy risk: Canadian investigation.

These actions should not be added together as though every amount were final, paid or equally enforceable. They arise under different laws, and appeals, jurisdictional limits and enforcement proceedings matter.

Why the UK case is still unresolved
The ICO’s 2022 penalty was not simply “upheld” in full. On October 6, 2025, the Upper Tribunal held that Clearview’s processing could relate to monitoring UK residents and that the company could not avoid UK GDPR coverage merely because its customers included foreign government agencies. It found that the First-tier Tribunal had applied the GDPR’s scope incorrectly and remitted the substantive dispute over the fine and enforcement notice. The ICO later reported that Clearview had permission to appeal to the Court of Appeal. The jurisdiction ruling therefore matters, but it is not the final word on the amount or enforceability of the UK penalty.
What happened in Illinois
The ACLU and allied groups sued under Illinois’ Biometric Information Privacy Act on May 28, 2020. A state court entered a consent order on May 11, 2022. It is a settlement, not a merits judgment declaring the entire database unlawful, and Clearview admitted no wrongdoing.

- It could not provide database access to Illinois state or local police for five years.
- Illinois residents received an opt-out mechanism intended to block search results containing their images and, where technically possible, prevent future collection.
- The order did not create general damages payments for everyone whose image may have been collected. The settlement agreement included a $50,000 notice-program payment, not a universal compensation fund.
The consent order distinguishes access to the faceprint database from possible licensing of an algorithm without that database; it did not ban facial-recognition technology generally. Documents are available from the ACLU case page and the signed consent order.

Is Clearview banned?
Not worldwide. Orders in several countries address residents or processing within the relevant jurisdiction. The Illinois settlement limits private database access nationwide and imposes a time-limited Illinois police restriction, but it did not shut down Clearview or prohibit all government use.
Clearview’s current materials say it does not offer the database service in the European Union, United Kingdom, Australia or Canada and limits access to selected law-enforcement, military, federal-government and other government officials. Those are company statements, not independent certification that every order has been fully satisfied. Its public signup page is aimed at eligible officials rather than consumers: go.clearview.ai/sign-up.
What “illegal database” does—and does not—mean
- It means regulators in named jurisdictions found particular collection, biometric processing or uses unlawful under their laws.
- It does not mean a single worldwide judgment has invalidated every Clearview operation.
- It does not mean every facial-recognition algorithm is prohibited; the Illinois order focused especially on access to the faceprint database.
- It does not prove that all deletion orders removed a global copy of every image. Orders generally concern residents and processing within the authority’s legal reach.
- It does not make “publicly visible” equivalent to consent. The legal question is the purpose, biometric extraction, notice, lawful basis and safeguards.
What affected people can realistically do
- Identify your jurisdiction. Rights and deadlines depend on where you live and which law applies.
- Use the relevant regulator or company request channel. Ask whether data is held, request access where available, and seek deletion or objection under the applicable law.
- Use any applicable opt-out mechanism. An opt-out may affect search results or future collection without removing the original web photograph, every derived vector or copies held elsewhere.
- Preserve evidence. Keep screenshots, URLs, dates and details of a suspected Clearview match or law-enforcement use.
- Get qualified advice for a legal claim. A privacy lawyer or nonprofit rights organization can assess state biometric-privacy statutes and procedural requirements.
Deleting a social-media post does not necessarily erase a copy or vector already created, and an opt-out in one country should not be assumed to apply globally.

Is Clearview still operating?
Yes, according to its current public materials. The company presents a narrower, government-focused customer model rather than an open consumer service. That operating claim coexists with continuing disputes over past collection, deletion, territorial scope and compliance. A government-only customer policy also does not by itself prevent misuse by an authorized customer.
Frequently Asked Questions
Can I assume a normal people-search removal service will remove my Clearview faceprint?
No. Unless the service explicitly covers Clearview’s biometric-search requests and explains the applicable jurisdiction and process, ordinary data-broker removal should not be treated as a Clearview solution.
Can law enforcement still use facial recognition after these actions?
Potentially. The restrictions target particular databases, customers, jurisdictions or processing practices; they do not create a universal ban on every facial-recognition system.
The Bottom Line
Clearview’s core practice—scraping public images, generating face vectors and making them searchable—has repeatedly been found unlawful under specific privacy laws. The company continues in a more restricted, government-oriented model, while fines and deletion orders remain fragmented by jurisdiction and, in the UK, procedurally unresolved.
