Yes, election event contracts have been available in the United States, but that does not mean election betting is settled law or accessible everywhere. A 2024 court development allowed Kalshi’s congressional-control contracts to proceed at that point in the case. In 2026, federal and state authorities are still contesting who can regulate prediction markets, and a major appellate ruling sent the separate question of Kalshi’s election contracts back for further consideration. Check your state and the specific contract before assuming you can trade.
What does “betting on elections” mean?
In this context, the phrase usually refers to an event contract: a financial contract tied to whether a defined event occurs. The Commodity Futures Trading Commission (CFTC) says event contracts are commonly structured as swaps. Many use a yes-or-no format, have a fixed payout, and expire at a specified time, although contracts can also use multiple outcomes or ranges.
A contract’s price reflects traders’ market-implied expectation of an outcome; it is not a guarantee that the outcome will happen or a measure of certain accuracy. A winning position may pay out, while a losing one can lose the money invested. Fees and taxes can also affect returns. The CFTC says contracts with multiple outcomes or ranges may have lower liquidity, which can make trading more difficult.
Before taking a position, read the contract’s own rules. Check exactly what event counts, which source determines the result, when the contract expires, and how delayed or disputed results are handled. The wording and settlement terms matter: a political result that seems obvious to a trader may not satisfy a contract’s stated resolution criteria.

What changed in 2024?
Kalshi challenged the CFTC’s 2023 decision to disapprove its “Congressional Control Contracts,” which concerned which party would control the House or Senate after the November 2024 elections. In September 2024, the U.S. District Court for the District of Columbia vacated the agency’s decision. On October 2, 2024, the D.C. Circuit declined to pause that judgment while the CFTC’s appeal proceeded. That allowed Kalshi’s contracts to move forward at that stage; it was not a permanent ruling that all election contracts are lawful nationwide.
The dispute included the CFTC’s argument that the contracts involved gaming and conduct unlawful in many states. The court’s October decision concerned the request to stay the district court’s judgment and the record before it. It was not a state-by-state guide to current consumer eligibility.

Is election betting legal where you live in 2026?
There is no basis in the cited court and agency developments to treat access as a simple nationwide yes or no. In a February 17, 2026 press release, the CFTC asserted that it has exclusive jurisdiction over U.S. commodity-derivatives markets, including prediction markets. That is the agency’s position in active litigation, not a final resolution of every state dispute. The CFTC also says it first officially recognized event contracts in 1992 through the University of Iowa’s Iowa Electronic Markets.
State challenges remain part of the picture. An Associated Press report dated April 10, 2026, said a federal judge temporarily barred Arizona from enforcing its gambling laws against prediction-market operators and paused the state’s criminal case against Kalshi. The report said Arizona prosecutors had charged Kalshi with 20 misdemeanor counts; those are allegations, not a finding of guilt. A separate March 2026 AP report described federal suits challenging state actions in Connecticut, Arizona, and Illinois, with the CFTC and state officials taking opposing positions.

In August 2026, the Ninth Circuit rejected Kalshi’s broad federal-preemption argument as applied to its sports contracts at the preliminary-injunction stage. It remanded the distinct election-contract question for further consideration by the district court. The decision therefore did not finally prohibit or approve election markets nationwide.
The CFTC published a proposed rule titled “Event Contracts” in June 2024, but a proposal is not a final resolution of the legal questions. The court cases and agency positions described above remain important to understanding why present-day availability may depend on location, contract, provider terms, and current court orders.

How to check whether you can trade a particular contract
- Confirm your location. Check the provider’s current eligibility terms for your state rather than relying on a general claim that election contracts are available in the United States.
- Read the contract rules. Identify the precise event, resolution source, expiration date, and treatment of delayed or disputed outcomes.
- Understand the position’s economics. Review the quoted price, payout, fees, and any applicable tax considerations. A market price is an implied expectation, not a promise of return.
- Consider liquidity and loss exposure. Check whether the contract has enough trading activity for you to enter or exit at a reasonable price, and decide whether you can afford to lose the amount at risk.
The sources cited here do not establish a reliable current figure for U.S. election-contract trading volume, users, market accuracy, or total election-betting activity. Nor do they provide a current state-by-state access map. Do not treat an operator’s listing or a market price as proof that a contract is lawful or available to every reader.
What the CFTC says event contracts are for
CFTC Chairman Michael S. Selig said in the agency’s February 17, 2026 release: “Event contracts allow businesses and individuals to hedge event-driven risks, enable investors to manage portfolio exposure, and provide the public with information about the outcome of future events.” That is the agency’s advocacy position in active litigation, not a judicial finding about the legality or merits of every election contract.
