Arm’s Qualcomm Case Is Not Awaiting a Verdict—A New Trial Is Set for October

Arm is not awaiting a verdict in its original Qualcomm lawsuit. Qualcomm won the 2024 trial and 2025 judgment; the next major test is Qualcomm’s October 2026 case against Arm.

Arm is not waiting for a jury verdict in its original licensing lawsuit against Qualcomm and Nuvia. That Delaware trial ended in December 2024, and the court entered judgment for Qualcomm and Nuvia on September 30, 2025. Arm has appealed that result.

The next jury verdict in this dispute is expected to come from a separate Qualcomm lawsuit against Arm. As of August 18, 2026, jury selection is scheduled for October 2 and a five-day trial is scheduled to begin October 5, 2026.

The two lawsuits are separate

The headline can refer to two related proceedings, but they have different plaintiffs, claims and procedural status.

Arm filed the first case against Qualcomm and Nuvia on August 31, 2022. Qualcomm filed its separate action against Arm on April 18, 2024. Arm’s original complaint is described in Arm’s filing announcement; the later case and schedule are described in Qualcomm’s SEC filing and the Delaware docket.

Why Nuvia triggered the original fight

Qualcomm acquired Nuvia in March 2021. Nuvia held an Arm Architecture License Agreement (ALA) that allowed custom CPU development. Arm argued that the agreement could not be transferred through the acquisition without Arm’s consent and said it had terminated Nuvia’s license in March 2022.

Qualcomm’s position was that its own ALA, signed with Arm on May 30, 2013, independently covered the relevant CPU designs and products acquired from Nuvia. The practical dispute was whether Qualcomm could continue using Nuvia’s custom CPU work without renegotiating the commercial terms Arm sought. The court’s license analysis is available in the district-court opinion.

What the December 2024 jury decided

The jury found that Qualcomm did not breach Nuvia’s ALA and that Qualcomm CPUs incorporating the acquired designs were licensed under Qualcomm’s own ALA. The jury did not reach a verdict on whether Nuvia itself breached its agreement.

The district court later granted Qualcomm judgment as a matter of law on the unresolved Nuvia-breach issue and entered final judgment for Qualcomm and Nuvia on September 30, 2025. The judgment and related filings are available through GovInfo and Qualcomm’s SEC report.

This was a civil contract dispute, not a criminal proceeding. Saying the jury found Qualcomm “innocent” would misstate the result. The decision also does not grant Qualcomm unrestricted rights to every design associated with Nuvia; it addresses the CPUs and licensing questions presented in that case.

What Arm is appealing

Arm appealed the September 30, 2025 judgment to the U.S. Court of Appeals for the Third Circuit. The appeal challenges the district court’s treatment of the jury findings and its post-trial judgment. It is appellate review, not a retrial or a pending jury verdict. The appeal docket is 25-2923.

Arm’s corporate disclosure continues to identify both the appeal and Qualcomm’s separate action as pending matters: Arm’s filing.

What Qualcomm’s pending case alleges

Qualcomm’s later lawsuit concerns different contractual duties. Qualcomm alleges that Arm:

  • failed to provide deliverables required under Qualcomm’s ALA;
  • improperly sought to terminate, or threatened to terminate, that ALA;
  • publicized the attempted termination; and
  • failed to offer licenses under Qualcomm’s Technology License Agreement (TLA) at commercially reasonable prices and terms.

Arm disputes those allegations and has moved to dismiss the amended complaint. Qualcomm amended its complaint on June 3, 2025 to add the TLA pricing claim. Qualcomm then filed a substantially identical action against Arm Ltd. on January 8, 2026 after a motion to add Arm Ltd. to the earlier case was denied; the matters were later consolidated. The January action appears on the Delaware docket.

Arm issued a breach notice in October 2024 concerning Qualcomm’s use of technology and code that Arm attributed to Nuvia employees. Qualcomm disputed the allegations, and Qualcomm later reported that Arm withdrew the notice in January 2025 while reserving its rights. That is not the same as an established termination of Qualcomm’s license.

Why the October 2026 trial matters

License portability after acquisitions

The central commercial question is whether a large company acquiring an Arm architecture-license holder can rely on its own pre-existing ALA to use the acquired company’s CPU work, or whether Arm can require renegotiation, higher royalties or other restrictions. The first judgment may influence that debate, but it does not automatically decide every future acquisition.

Custom CPU competition

Qualcomm’s Nuvia-derived custom CPU program is associated commercially with its Oryon cores and Snapdragon products. The court decided the licensing status of the relevant CPUs in the original case; it did not rule that every current or future Snapdragon product is legally cleared. Qualcomm’s ability to continue developing and shipping products based on the acquired technology is therefore a commercial implication, not a blanket holding about all products.

Pricing and bargaining leverage

A ruling on delivery duties, attempted termination or commercially reasonable TLA terms could change negotiating leverage between Arm and licensees. The practical effect will depend on which claims reach the jury, the remedy awarded and any appeal. It will not by itself determine Arm’s entire licensing business.

Deal terms for the wider ecosystem

Chip companies and startups may reassess assignment clauses, confidentiality provisions, royalty structures and change-of-control language in acquisition agreements. Those are likely industry consequences of the contractual rulings, not guaranteed results required by either case.

What to watch next

  1. Pretrial rulings: Motions may narrow the claims or determine which evidence and remedies the jury will hear.
  2. October 2, 2026: Scheduled jury selection in Qualcomm’s case.
  3. October 5, 2026: Scheduled start of the five-day jury trial.
  4. The remedy: Possible outcomes include damages, contractual performance, declaratory relief or no material monetary remedy.
  5. The Third Circuit appeal: The losing side in the original case may obtain further appellate review, delaying final resolution.
  6. Sealed material: Royalty rates, delivery terms and technical details may remain confidential or heavily redacted.
  7. Schedule changes or settlement: The October date could move, and either case could settle before a final appellate decision.

Bottom line

Qualcomm already prevailed on the principal issues in Arm’s original Nuvia licensing lawsuit, and Arm is appealing rather than awaiting a new verdict. The next major courtroom event is Qualcomm’s case against Arm, scheduled for October 2026. That trial could clarify Arm’s obligations as a licensor and Qualcomm’s access to commercially reasonable terms, but its effect on Oryon products, royalties and future acquisitions will depend on the precise claims, remedy and appeals.
