Are Canadian Imports Facing a 35% U.S. Tariff Starting October 5, 2026?

The 35% figure refers to an earlier tariff on non-CUSMA-compliant Canadian goods that Finance Canada says was invalidated in February 2026. Current U.S. duties depend on product, origin, entry date and separate trade measures.

No general 35% U.S. tariff on Canadian imports is scheduled to start October 5, 2026, according to the Canadian government’s current tariff summaries. The 35% figure refers to an earlier U.S. tariff on Canadian goods that did not qualify under the Canada–United States–Mexico Agreement (CUSMA, also called USMCA); Finance Canada says that measure was invalidated in February 2026. Current duties depend on the product, its origin, the date it enters the United States, and any applicable exemptions or separate trade measures.

Are Canadian imports facing a 35% U.S. tariff starting tomorrow?

No. The headline’s rate and timing are not supported by the official Canadian summaries available as of October 4, 2026. The 35% tariff was part of an earlier U.S. measure on Canadian goods that did not meet CUSMA rules of origin. Finance Canada says the U.S. Supreme Court invalidated the IEEPA tariffs on February 20, 2026, after which the administration rescinded the related executive orders. Finance Canada’s 2026 briefing binder describes that history.

The broad measures that followed changed over the year. Finance Canada says a 10% Section 122 tariff took effect February 24, 2026, with a carve-out for CUSMA-compliant goods and additional product exemptions. The Canadian Trade Commissioner Service says that measure expired July 24 and was replaced by a 10% Section 301 tariff on most goods, including goods from Canada. Its guidance also describes exclusions and a CUSMA exemption for qualifying goods. Neither summary supports a blanket 35% tariff starting October 5. These rates describe different legal measures and periods; they are not a calculation of the average tariff paid on Canadian imports. The FAQ reports further changes to specific product duties in September, so a shipment’s treatment must be checked against the rules in force for its product and entry date.

Does USMCA status make a Canadian product tariff-free?

No—not automatically, and not against every trade measure. CUSMA qualification can matter substantially: under the broad Section 301 measure described by the Canadian government, goods qualifying for preferential duty-free treatment under CUSMA remain exempt. But the FAQ says some Section 338 tariffs apply without an exemption for CUSMA-origin goods. A product may also face a separate duty or import restriction, depending on its classification and the applicable measure.

In practice, “made in Canada” and “qualifies for CUSMA treatment” are not interchangeable. Preferential treatment depends on the agreement’s rules and the product’s circumstances. Importers should confirm both the origin determination and the specific tariff classification rather than assume that a Canadian shipping address or supplier establishes eligibility.

Which U.S. tariff measures may affect Canadian goods?

The official summaries identify several authorities with different scopes. The table separates them by what the sources say; it does not determine the duty on a particular shipment.

An August proclamation temporarily shifted the effective date of selected July Section 338 duties from August 19 to August 22 after a three-day suspension. That is historical context; the later September modifications are the more relevant update for current product checks. The White House proclamation describes that temporary change.

What is the status of USMCA after the 2026 joint review?

The parties held the agreement’s joint review on July 1, 2026. The U.S. Trade Representative said the United States did not agree to renew USMCA in its current form, but also stated that the agreement remains in force pending resolution of the issues or termination. That statement means the agreement had not expired as of July 1; it does not guarantee its future status. Read the USTR statement on the joint review.

How to check the tariff on a specific Canadian shipment

For a business or individual arranging an import, use the shipment details—not a headline—to identify the applicable treatment. The Canadian government summaries explain policy but are not rulings for a particular entry.

  1. Identify the product’s HTSUS classification. The Harmonized Tariff Schedule of the United States classifies goods for duty purposes. A broad product description may not be enough to identify the relevant tariff provision.
  2. Establish country of origin and CUSMA eligibility. Determine whether the good meets the agreement’s origin rules and qualifies for preferential treatment. Do not assume that shipment from Canada proves either point.
  3. Check the entry date. Measures and effective dates changed during 2026, including a September modification to the scope of some Section 338 duties.
  4. Check every relevant authority and exclusion. Review whether Sections 301, 338, or 232 apply, whether an exclusion covers the product, whether an import ban applies, and whether duties can stack.
  5. Confirm the current treatment before entry. Consult current U.S. tariff schedules and Customs and Border Protection notices, or ask a qualified customs professional to assess the shipment’s facts.

The Canadian Trade Commissioner Service FAQ is a useful summary of the reported measures, but tariff schedules and implementation notices govern shipment-level decisions. Rates can change, and the summaries do not calculate duties for a specific HTSUS code.
