Apple’s AirTag-stalking lawsuit survived dismissal—but the court later rejected a nationwide class

Apple’s AirTag-stalking case survived an early dismissal effort, then narrowed and lost nationwide class certification. Discovery and separate lawsuits continue, but no court has found Apple liable.

Apple did not eliminate the AirTag-stalking litigation at the outset. In Hughes et al. v. Apple Inc., a federal judge allowed some California negligence and strict-products-liability claims to proceed in March 2024. But the court later denied certification of the proposed nationwide classes in March 2026. The original case therefore remains a putative, narrower proceeding—not a certified nationwide class action—and separate AirTag-stalking suits were filed afterward.

What the lawsuit alleges

Hughes et al. v. Apple, Inc., case no. 3:22-cv-07668-VC, was filed in the U.S. District Court for the Northern District of California on December 5, 2022. The docket is available from the court.

Dozens of plaintiffs alleged that other people used Apple AirTags to monitor their locations and movements without consent. According to the amended complaint, plaintiffs contended that Apple knew the product could facilitate stalking but failed to provide sufficiently effective safeguards. The complaint sought damages and injunctive relief and proposed classes covering people allegedly tracked by AirTags and people considered at risk of such tracking. A proposed class in a complaint is not a court-approved class.

What the March 2024 ruling decided

On March 15, 2024, Judge Vince Chhabria partially denied Apple’s motion to dismiss. Three California plaintiffs were allowed to continue with negligence and strict-products-liability theories. The court said alleged shortcomings in AirTag safety features could potentially constitute actionable defects at the pleading stage, while emphasizing that the issue was close and could not yet be resolved without evidence. The ruling is in the court’s opinion.

That decision was procedural. It did not find Apple negligent, declare AirTags legally defective, award damages, or certify any class. Other claims were dismissed or required to be amended, as explained in a companion ruling.

  • A motion to dismiss tests whether pleaded facts, assumed true for that motion, state a legally sufficient claim.
  • Surviving that motion allows a case to seek evidence and face later challenges; it is not a finding that the allegations are proven.
  • The ruling applied to the claims and plaintiffs before the court, not automatically to every AirTag user or stalking victim.

How the case was narrowed in November 2024

On November 18, 2024, the court granted Apple’s renewed motion to dismiss in part. The order addressed pleading deficiencies, whether California law could govern claims by people in other states, and the possible effect of a choice-of-law provision in Apple’s iOS Software License Agreement. More than 20 states’ laws could be implicated, making a single nationwide theory difficult. Read the November ruling.

The practical result was a more limited and legally complicated case than early headlines suggested. A California plaintiff’s theory does not automatically apply to someone in Texas, New York, Pennsylvania, or another state.

Why there is no certified nationwide class

In March 2026, the court denied plaintiffs’ request to certify three proposed nationwide classes, according to reported coverage. The reported reasons included differences in state law and the individualized facts of each alleged stalking incident.

Individual facts matter

Cases can differ by who placed the tracker, where it was hidden, how long it operated, what warnings appeared, whether the person used an iPhone or another compatible phone, what injuries were claimed, and what evidence exists. Those differences can affect defect, causation, injury, and damages.

What certification would have meant

Under Federal Rule of Civil Procedure 23, plaintiffs must separately establish requirements such as commonality, typicality, adequacy, predominance, and superiority. A certified class can allow absent members to participate in or be bound by a settlement or judgment. The March 2026 denial means the proposed nationwide classes were not approved. It does not automatically terminate every named plaintiff’s individual claim.

Discovery continued after the early rulings

Later orders show that the litigation remained active while the parties contested what information Apple had to produce.

  • On November 6, 2025, the court rejected Apple’s demand for all communications between plaintiffs and alleged stalkers over a broad period, finding that the request could sweep in unrelated divorce, custody, family, or relationship matters. See the discovery order.
  • On January 12, 2026, the court required broader responses about contacts concerning unwanted AirTag tracking. The information was potentially relevant to the merits of negligence and products-liability claims, not only to class certification. See the order.
  • A February 25, 2026 order addressed the date through which Apple had to collect and produce information about law-enforcement and non-law-enforcement contacts involving unwanted tracking. See the docketed order.

These discovery rulings do not establish how many reports Apple received or prove that any particular safety feature was legally inadequate.

What the litigation means for AirTag safety

The allegations concern whether Apple’s safeguards were adequate in the circumstances claimed—not whether alerts can guarantee safety. Relevant issues include:

  • Delays before an alert or sound occurs.
  • Whether a person uses an iPhone, Android phone, or another compatible device.
  • Whether the tracker is hidden in a vehicle, bag, clothing, or property belonging to someone else.
  • Whether the person who placed it knows how to disable or remove it.

Alerts are mitigation tools, not a promise that tracking will be detected or prevented. Finding an AirTag can also have innocent explanations, such as a family member’s device, an employer’s equipment, a rideshare passenger’s property, or lost property.

If you find an unknown tracker

  1. Put safety first. Do not confront a suspected stalker, particularly a former partner or someone who may be nearby.
  2. Preserve evidence. Photograph the device and record where and when it was found. Avoid actions that could destroy identifying information.
  3. Use tracker-identification tools. Follow the instructions on your phone or the manufacturer’s device-identification feature.
  4. Record identifying details. Save the AirTag serial number and any other information shown by the phone.
  5. Seek help when appropriate. Contact law enforcement if there are threats, stalking concerns, domestic-abuse circumstances, or immediate danger.
  6. Make a safety plan. A domestic-violence or stalking advocate can help assess risk, secure accounts and belongings, and plan next steps.

Removing the tracker does not necessarily end surveillance. The person who placed it could have other access or monitoring methods, and a tracker’s presence alone does not prove criminal conduct.

What happens next

The class-certification denial does not itself decide liability or erase every individual claim. The named plaintiffs’ remaining claims, any later dispositive motions, settlement, appeal, or trial would depend on subsequent docket activity. Separate complaints filed in California in May 2026 are independent proceedings, not a revival of the denied nationwide classes. Reports and case listings include coverage of those filings, as well as separate dockets such as this case listing.

Similar allegations have also been made against other tracker manufacturers. A case involving Tile, for example, is separately described in court materials. An outcome involving Apple would not automatically establish liability for Tile, Google, Samsung, or another manufacturer.

Frequently Asked Questions

Is Apple liable for AirTag stalking?

No liability finding has been reported in the rulings described here. Some claims survived dismissal, but the merits remain unresolved.

Was the AirTag case certified as a class action?

No. In March 2026, the court denied certification of the proposed nationwide classes.

Can someone automatically join the lawsuit?

No. Because no nationwide class was certified, there is no automatic class membership. A person considering a claim should obtain advice about the facts and law in the relevant state.

Does finding an AirTag prove stalking?

No. A tracker may have an innocent explanation. Context, evidence, and safety circumstances matter.

Does this case cover Android users?

The allegations and legal analysis can involve people using different phones, but compatibility and warning details are fact-specific. The case does not create a blanket claim for all Android users.
