Apple employees at the company’s Short Hills, New Jersey, store—not the separate Short Pump Town Center store in Richmond, Virginia—voted 57–41 against representation by the Communications Workers of America (CWA). The National Labor Relations Board (NLRB) recorded 105 eligible voters and 98 ballots counted. The tally was issued May 11, 2024, and the NLRB certified the result on May 20.
Location correction: The election took place at Apple Short Hills, 1200 Morris Turnpike, Short Hills, New Jersey. Apple’s store directory lists Short Hills under New Jersey and Short Pump Town Center under Virginia: Apple’s official store directory.

What the NLRB tally shows
The representation election was docketed as NLRB case 22-RC-339531. The petition was filed April 8, 2024. The NLRB’s case page reports:

CWA therefore lost by 16 votes among counted ballots. The 98 counted ballots represent about 93.3% of the 105 eligible voters. Because there were no challenged ballots, none could have changed the certified outcome. The figures show that 57 of 98 counted ballots opposed CWA representation; they do not establish that 57 of every employee at the store opposed unions generally.

Contemporaneous records refer to the election as occurring around May 10–11. The NLRB lists May 11 as the tally date, so “workers voted 57–41” or “the election concluded on May 11” is more precise than asserting an unsupported single-day schedule.
Which employees were in the proposed bargaining unit?
The proposed unit covered full-time and regular part-time retail employees at the 1200 Morris Turnpike store. Listed roles included Specialists, Experts, Creative Pros, Operations employees, Genius employees, Leads, Product Specialists, Sales Specialists, Technical Specialists, Business employees and related positions.

Managers and supervisors were excluded, as were seasonal and temporary workers, office clerical employees, guards and other categories excluded under labor law. The vote consequently concerned the defined bargaining unit, not every person who might work in or around the store.
What CWA’s campaign sought
CWA organized the campaign with employee organizers, including operations lead John Nagy, identified in contemporaneous campaign coverage. Organizers presented union representation as a way to seek improvements in respect and treatment, pay and benefits, working conditions, employee input and bargaining power. Those are campaign positions attributed to CWA and participating workers, not independent NLRB findings about conditions throughout the store.

The election petition followed the organizing effort and put one legal question to the unit: whether CWA should represent these employees in collective bargaining. A “no” vote rejected CWA representation in this election; it was not a vote on every possible union or a finding that employee concerns did not exist.
What was alleged about Apple?
CWA filed an unfair-labor-practice charge against Apple on May 7, 2024, in NLRB case 22-CA-342134. The docket identifies an allegation involving changes in terms and conditions of employment under Section 8(a)(3) of the National Labor Relations Act. CWA and contemporaneous reports described the allegation as retaliation against an organizing leader, including meetings with managers and denial of a time-off request.

A charge is an accusation that prompts an NLRB process; it is not the same as an NLRB complaint or a finding that the employer violated the law. The available docket shows a letter approving a withdrawal request on August 30, 2024, after which the case was closed. It does not establish that Apple’s alleged conduct was proven. A separate NLRB case involving Apple’s Kansas City store concerned different allegations and should not be treated as evidence about Short Hills: case 18-CA-311790.

Available contemporaneous coverage did not include a detailed statement from Apple specifically addressing the Short Hills election. One report said Apple, CWA and the NLRB had not immediately responded to requests for comment. Broader statements or labor disputes involving other Apple stores cannot be presented as Apple’s response to this vote.

How the vote fit Apple’s retail organizing activity in 2024
The Short Hills election was part of a wider effort to organize Apple’s U.S. retail workforce. At the time, AppleInsider described it as the third unsuccessful Apple Store unionization vote, following campaigns in Atlanta and St. Louis, while Apple Penn Square in Oklahoma City had voted to unionize. That was a contemporaneous 2024 snapshot, not a current count of Apple stores.
Reporting on the result included a headline that said “Short Pump” while describing the New Jersey store as Short Hills. That mismatch can lead to the wrong store photo, social preview or location attribution. Apple’s official pages confirm that Short Pump Town Center is in Richmond, Virginia: Apple Short Pump Town Center.
What happened after certification?
The NLRB representation case closed after the agency certified the May result on May 20, 2024. The related unfair-labor-practice case later closed after approval of CWA’s withdrawal request. The available records do not show that the Short Hills store subsequently unionized or that the election was overturned. Certification resolves that election; it does not, by itself, settle every future labor dispute or prevent a later organizing effort under applicable labor law.
Bottom line on the location and result
The accurate account is specific: employees in the defined bargaining unit at Apple Short Hills in Short Hills, New Jersey, voted 57–41 against CWA representation, with 98 ballots counted from 105 eligible voters. “Short Pump” refers to a different Apple store in Richmond, Virginia.
