Apple and OpenAI Must Face Musk-Backed Antitrust Lawsuit, but Merits Remain Undecided

A judge denied Apple’s and OpenAI’s motions to dismiss Musk-backed companies’ antitrust lawsuit. The case can proceed, but its allegations remain unproven.

A federal judge declined to dismiss X Corp. and xAI’s antitrust lawsuit against Apple and OpenAI on November 13, 2025. That lets the case proceed beyond the initial pleading stage; it does not mean the judge found that the companies colluded or broke the law. The word “baseless” is an opinion, not a conclusion in the court’s ruling.

Who sued Apple and OpenAI?

X Corp. and xAI LLC, companies controlled by Elon Musk, filed the case on August 25, 2025, in the U.S. District Court for the Northern District of Texas, Fort Worth Division. The defendants are Apple Inc. and multiple OpenAI entities. The case number is 4:25-cv-00914-P. The complaint and case docket identify both X Corp. and xAI as plaintiffs.

What do Musk’s companies allege?

The complaint’s theory goes beyond a claim that Grok ranked below ChatGPT. X and xAI allege that Apple’s partnership with OpenAI and Apple’s control over iPhone distribution together gave ChatGPT an unfair advantage over competing AI services.

  • System-level integration: The plaintiffs say ChatGPT’s connection to Apple Intelligence and Siri-related functions gives it access that a rival app must work harder to reach.
  • App Store presentation: They allege that Apple favored ChatGPT in discovery and “Must-Have Apps” placement while disadvantaging Grok and X.
  • Competitive impact: They argue those practices reinforce OpenAI’s position and make it harder for rival services to reach users.

These are allegations in the complaint, not established findings. The Associated Press account describes the complaint’s claims about Apple’s integration and app distribution.

Why does built-in access matter?

A person can download Grok from the App Store or use it through a browser. That is different from asking Siri for help and having ChatGPT available through Apple’s built-in AI features. The plaintiffs argue that this system-level route gives ChatGPT a distribution advantage beyond ordinary app availability. Apple’s position is that access to an integrated partner does not prevent consumers from choosing other chatbots.

The legal question is not simply whether ChatGPT is easier to invoke. It is whether Apple and OpenAI used an arrangement that unlawfully excluded rivals, rather than making a product partnership that consumers can use alongside competing apps.

What are Apple and OpenAI’s responses?

Apple says the partnership is nonexclusive

Apple has argued that its arrangement with OpenAI is not exclusive, that other chatbots remain available through apps or browsers, and that selecting an initial partner is not automatically unlawful. Apple has also pointed to occasions when X and Grok ranked highly in the App Store, arguing that this conflicts with a claim of categorical suppression. Its dismissal arguments also characterize App Store curation as editorial judgment, not necessarily anticompetitive conduct. Reuters summarized those arguments in its report on the dismissal motions and later report on the ruling.

OpenAI disputes the claims

OpenAI has denied the allegations and described Musk’s actions as “lawfare,” placing the case in the context of his separate dispute with OpenAI and its leadership. It has also argued that xAI has not shown a sufficiently direct, non-speculative antitrust injury caused by ChatGPT’s Apple integration. Those are OpenAI’s positions, not findings by the court.

What did the judge decide—and what does “must face” mean?

On November 13, 2025, U.S. District Judge Mark Pittman denied Apple’s and OpenAI’s motions to dismiss under Rule 12(b)(6). In practical terms, the defendants could not end the lawsuit at that early stage, so litigation could continue. The court’s order, recorded on the docket, expressly does not amount to a judgment or prejudgment on the merits.

A motion to dismiss tests whether a complaint can proceed under the applicable legal standard. It is not a trial: the judge did not determine that the alleged conduct happened or that it violated antitrust law. The ruling did not find that the partnership is exclusive, that Apple manipulated rankings, or that Apple must integrate Grok. Nor did it award damages or decide that the plaintiffs have proved legally compensable harm.

What happens next?

After a case survives dismissal, the usual path may include defendants’ answers, discovery, further motions and, if the dispute is not resolved earlier, a trial. The judge could later narrow or dismiss particular claims; the parties could settle; or the case could proceed toward trial. The November ruling does not establish that a trial will happen.

The docket shows later litigation activity, including discovery-related filings and a January 5, 2026 motion by X Corp. and xAI seeking discovery from OpenAI. That is not the end of the procedural story, and the available record here does not establish the case’s complete status as of August 18, 2026. The docket is the place to check for later orders and filings.

What evidence could matter to the antitrust claims?

The dispute raises questions about how Apple’s product integration and app distribution operate in practice. Evidence that could matter includes how ChatGPT’s system-level access compares with rival services, how App Store rankings and featured placements are determined, and whether Apple treated comparable apps differently. The plaintiffs would also need to connect any alleged advantage to a legally recognizable competitive injury; a lower ranking by itself does not establish manipulation or an antitrust violation.

Apple’s reported argument that Grok and X have sometimes ranked highly bears on its response, but the significance of rankings depends on how they were produced and whether they reflect comparable treatment. The court has not resolved those factual questions.

Why the case matters beyond Grok

The broader issue is whether operating-system-level access to an AI assistant can become a decisive distribution channel—and when a platform’s decision to partner with one provider crosses the line from product design or curation into unlawful exclusion. The case also tests how claims about app-store promotion fit into an antitrust theory when rival apps remain available.

Those questions affect the way consumers encounter AI tools, but the November 2025 order answered only a procedural question: the complaint was not dismissed at the outset. It did not decide whether Apple or OpenAI violated the law.
