Why Apple Removed Musi From the App Store—and What Its Lawsuit Actually Said

Apple cited intellectual-property infringement when it removed Musi in September 2024. The court later dismissed Musi’s claims against Apple, but did not find that YouTube lied.

Apple removed Musi from the App Store on September 24, 2024, citing intellectual-property infringement after complaints from YouTube. Musi disputed the complaints and sued Apple, but a federal district court did not find that YouTube lied. In March 2026, the court dismissed Musi’s claims against Apple with prejudice, relying primarily on the app-distribution agreement’s termination provisions.

Why was Musi removed from the App Store?

Musi Inc. operated an app that streamed publicly available content from YouTube. Apple had distributed it through the App Store for years before removing it in September 2024.

According to the court’s March 2026 account, Apple told Musi on August 8, 2024, that it had received a July 29 complaint from YouTube alleging infringement and violations of YouTube’s Terms of Service. Apple urged Musi to respond to YouTube or otherwise resolve the dispute. YouTube later told Apple that Musi had not contacted it and requested removal. Musi contacted YouTube on September 6 and maintained that it believed the app complied with YouTube’s terms. Apple warned Musi on September 18 that the app could be removed if the dispute was not resolved soon. Apple removed it on September 24, stating intellectual-property infringement as the basis.

The court order also describes earlier complaints that Musi allegedly accessed non-public interfaces, used YouTube commercially, and sold advertising over YouTube content. Those are allegations and complaints recounted in the order, not independent findings that every alleged violation occurred.

What did the “YouTube lie” claim mean?

The phrase in the headline characterizes the dispute, not a court finding. Musi disputed YouTube’s complaint and alleged Apple acted improperly, but the district court did not decide that YouTube lied or issue a general finding that YouTube’s allegations were true. It resolved Musi’s claims against Apple on contract and implied-covenant grounds.

The parties’ positions should be kept distinct: YouTube complained about Musi’s use of content and alleged terms violations; Musi said it believed its app complied; Apple said it removed the app for intellectual-property infringement. The March 2026 ruling addressed whether Musi had a viable claim against Apple under their agreement and related legal duties.

Did Musi sue Apple or YouTube?

Musi sued Apple on October 2, 2024—not YouTube. It alleged that Apple breached the Developer Program License Agreement (DPLA) and the implied covenant of good faith and fair dealing. Musi asked the court for a preliminary injunction requiring Apple to continue listing the app.

What did the court decide?

January 2025: no preliminary injunction

On January 30, 2025, the district court denied Musi’s request for interim relief. It concluded that Musi had not shown serious questions on the merits based on the record then before it. This was not the final judgment in the lawsuit.

March 2026: complaint dismissed with prejudice

On March 16, 2026, the court granted Apple’s motion to dismiss and dismissed Musi’s complaint with prejudice. The court concluded that the DPLA gave both Apple and developers the right to terminate App Store distribution upon notice. It rejected Musi’s argument that the implied covenant placed an additional limit on Apple’s termination right and found that Musi had not plausibly alleged bad faith.

The ruling was issued by the U.S. District Court for the Northern District of California. The court put the agreement’s mutual termination rights this way: “Apple assumed no contractual obligation to continue distributing an application, and developers assumed no contractual obligation to continue offering an application.” The materials available here do not establish whether Musi appealed or pursued a later post-judgment proceeding.

Is Musi coming back to the App Store?

The court orders establish that Apple removed Musi and that the district court dismissed Musi’s claims against Apple. They do not establish whether Apple will relist the app or whether Musi will return to the App Store. A ruling on the contract claims is not itself an announcement about future availability.

What this case means for App Store developers

The dispute turned on the language of the DPLA and the specific claims Musi pleaded. The January 2025 order described Apple’s discretion under the agreement as broad, including the ability to remove applications “at any time, with or without cause.” The March 2026 decision applied the agreement’s termination provisions to reject Musi’s claims. It is a district-court decision about this dispute, not a ruling that resolves every possible App Store removal or every complaint involving third-party content.
