A proposed class action accuses Tesla of recording more miles than its vehicles travel, but the allegations are not a finding that Tesla falsified odometers. The complaint’s claimed overcount, its proposed technical explanation and the case’s reported procedural status all need to be read with that distinction in mind.
What the Tesla odometer lawsuit alleges
Nyree Hinton sued Tesla, Inc. and Tesla Finance LLC in a proposed consumer class action. The complaint alleges that Tesla odometers register more distance than the vehicles actually travel, potentially causing mileage-based warranties to expire sooner, triggering lease mileage charges and reducing resale value. Those are claims made by the plaintiff, not established effects or court findings. Read the complaint.
The complaint says Hinton’s Tesla readings were 15% to 117% higher than mileage recorded by her other vehicles. That range is an allegation based on the plaintiff’s comparisons; it is not an independently verified error rate for Tesla vehicles. A separate report describes Hinton as the owner of a used 2020 Model Y and says the complaint attributed 13,228 miles to the vehicle over a six-month period. How the complaint says the odometer works
The plaintiffs’ proposed theory is that Tesla’s odometer system uses predictive algorithms, energy-consumption metrics and driver-behavior multipliers. The complaint points to patent US8054038B2 as part of its argument. This describes the plaintiffs’ interpretation of the patent and vehicle system; the cited patent does not, by itself, establish that production Teslas use the alleged method or that their odometers overstate distance. The complaint frames the alleged consequences as financial incentives for Tesla, asserting: “By tying warranty limits and lease mileage caps to inflated ‘odometer’ readings, Tesla increases repair revenue, reduces warranty obligations, and compels consumers to purchase extended warranties prematurely.” That is the plaintiff’s accusation, not an adjudicated conclusion. The available material does not establish that Tesla pushed a software update to inflate readings or provide an independently verified explanation of how production vehicles calculate odometer mileage.
Where the case stands
Hinton filed the action in Los Angeles County Superior Court. It was removed to the U.S. District Court for the Central District of California on April 2, 2025, as case 2:25-cv-02877-MEMF-AJR.

A June 23, 2026 report by LegalClarity says a judge granted Tesla’s motion to dismiss. The report does not include the court’s order, and the current docket and any later proceedings have not been verified here. Treat the dismissal as a reported ruling, not a definitive account of the case’s present status. The case was proposed as a class action; the available sources do not establish that a class was certified. Nor do they report a court or regulator finding that Tesla odometers are inaccurate, intentional manipulation, or an independent study establishing an error rate.

What Tesla owners can take from the allegations
The lawsuit is relevant to owners concerned about warranty limits, lease mileage caps or a vehicle’s recorded distance, but it does not prove that any particular Tesla has an odometer problem. If you are documenting a mileage concern, keep records that show what you observed and when; they can help preserve a history, but they do not diagnose the odometer or establish the lawsuit’s merits.
