The ruling applies to New York residents who bought subscriptions online; it does not establish that every SiriusXM cancellation practice or every retention offer is illegal.
What the courts ruled
In November 2024, New York Supreme Court Justice Lyle Frank granted summary judgment to the State on its claim under the federal Restore Online Shoppers’ Confidence Act (ROSCA). The court found that SiriusXM’s online-subscription cancellation procedure did not provide the “simple mechanism” the law requires. On November 6, 2025, the Appellate Division, First Department, unanimously affirmed that disposition. Read the First Department’s decision; view the trial-court ruling.
The appellate court said the “multi-tiered script, multiple save offers, and pressure tactics to opt into a new plan” made cancellation “not simple, convenient, or even straightforward.” It described “simple” in this context as straightforward and convenient. The finding concerns that particular procedure and ROSCA’s cancellation requirement; it is not a blanket ban on retention offers.
Which claims and consumers are covered
The State won on the ROSCA claim, but the trial court dismissed its other claims, including those under New York fraud, deceptive-practices and service-offer laws. The First Department also held that the State could not base its claims or seek recovery on behalf of consumers outside New York because the relevant communications occurred outside the state. The affirmed ROSCA ruling concerns New York consumers who purchased their SiriusXM subscriptions online.

The reach of relief to out-of-state consumers remained contested in SiriusXM’s June 30, 2026 SEC filing: the company reported that the Attorney General’s appeal on that issue was pending after leave to appeal was granted in May 2026. See the company’s filing.
What the April 2026 order requires
On April 1, 2026, Justice Frank granted the State’s request for an injunction and an accounting. The injunction bars SiriusXM from violating ROSCA by using a cancellation method for New York consumers who bought online that relies on a multitiered script, multiple save offers and pressure to move to another plan.

The accounting must cover online subscriptions sold from January 1, 2019 through November 27, 2024, and include purchase dates, cancellations or attempted cancellations, subscription charges and the last date of service use. The order did not determine a consumer-damages amount or itself award restitution; it required information relevant to a possible damages hearing. Read the April 1 order.
What SiriusXM says about online cancellation
In its June 30, 2026 SEC filing, SiriusXM said that as of November 27, 2024, it allowed New York residents who had purchased subscriptions online to cancel those subscriptions online. That is the company’s description of its practice, not independent verification of the current cancellation interface.

What this means for subscribers
The court ruling is a legal finding about a specific cancellation process, not a step-by-step guide to the company’s current cancellation options. It also does not establish whether an individual subscriber is entitled to a refund or other payment. The accounting and any later damages proceedings are separate from the finding that the challenged procedure failed ROSCA’s standard.
