The National Labor Relations Board’s Los Angeles regional office reportedly found Amazon jointly employed unionized delivery drivers at a Palmdale, California, delivery operation. The Teamsters said the finding meant Amazon had to recognize the union and bargain. It concerned drivers working for a Delivery Service Partner—not every Amazon driver nationwide—and it was not a final decision on the unfair-labor-practice allegations.
What the labor board reportedly found
On August 22, 2024, the International Brotherhood of Teamsters announced that NLRB Region 31 found Amazon to be a joint employer of drivers working for Battle-Tested Strategies, an Amazon Delivery Service Partner (DSP) in Palmdale. The union said its Local 396 represented the drivers and that 84 workers organized in April 2023. The Teamsters’ announcement described the regional finding as establishing Amazon’s duty to recognize and bargain with the union.
“Joint employer” is the important qualification: the finding described Amazon and the DSP as employers of the drivers together. It did not say that Amazon directly hired every driver, or that all workers delivering Amazon packages share the same employment status.
Did the NLRB say Amazon must bargain?
The Teamsters said yes, characterizing the Region 31 determination as requiring Amazon to recognize the union and bargain. That is the union’s account of the regional finding, not a final nationwide ruling by the NLRB or a court. The available account does not establish a final merits decision resolving the Palmdale unfair-labor-practice case.

The distinction matters because the union also accused Amazon of unfair labor practices, including refusing to recognize the workers’ organizing decision and bargain, threats of job loss, captive-audience meetings, security intimidation, and retaliation. Those are allegations, not established violations simply because a regional office made a joint-employer finding.
What happened after the August 2024 announcement
October 2024: a formal complaint
In October 2024, the Teamsters reported that Region 31 had issued a formal complaint. The union described potential remedies that included offers of reinstatement and workplace notices. Those were proposed remedies in the union’s account, not confirmation that relief had been ordered or carried out. December 2025: proceedings allowed to continue
On December 29, 2025, the Ninth Circuit affirmed the denial of Amazon’s attempt to obtain a preliminary injunction stopping the NLRB administrative proceedings. The court addressed jurisdiction under the Norris-LaGuardia Act; it did not decide whether Amazon committed the charged unfair labor practices. In practical terms, the administrative case could proceed, but the appellate ruling was not a verdict on the underlying allegations. Read the Ninth Circuit opinion.

No. The reported determination was about unionized DSP drivers at one Palmdale operation. It should not be treated as a blanket decision covering all DSPs, all Amazon delivery drivers, or Amazon Flex workers. The Teamsters said in its 2024 release that nearly 280,000 DSP drivers worked nationwide; that is the union’s figure, not a separately verified agency statistic, and it does not establish that those drivers were covered by the Palmdale finding.

A separate Wisconsin case involved Amazon Flex drivers and eligibility for Wisconsin unemployment insurance. The Wisconsin Supreme Court dismissed review, leaving in place a 2023 state appeals ruling. That was a state-law question about unemployment benefits for Flex drivers, not the federal labor-relations dispute over Palmdale DSP drivers.
