Iowa Wind-Turbine Lawsuit Tests Utilities Board’s Authority Over Tenant Disputes

The Iowa Utilities Board found MidAmerican Energy trespassed on leased farmland, prompting a challenge over the Board’s authority. Public updates record a district-court ruling but do not disclose its result.

A dispute over turbines built on leased Iowa farmland raised a larger question: can the Iowa Utilities Board investigate a utility’s business practices when a tenant says construction proceeded without permission? The Board said it could and found MidAmerican Energy’s conduct amounted to trespass and an inappropriate business practice. MidAmerican challenged the Board’s authority. The agency later recorded a Polk County District Court ruling on December 15, 2022, but its public update does not describe the ruling, so the ultimate court outcome is not established by the available record.

How the dispute began

Curt Beane, a tenant farmer in Adair County, complained to the Iowa Utilities Board in 2019 after MidAmerican Energy began constructing wind turbines on farmland he rented. The landowner had signed a wind-turbine agreement with MidAmerican. The company asked Beane to sign a tenant subordination agreement, but he declined.

In its March 14, 2022 final order, the Board found that MidAmerican knew the Beanes were tenants, knew they had not signed the subordination agreement, and had not received their permission before construction began. The Board concluded that construction on the leased property was trespass and an inappropriate business practice. These were the agency’s findings in the complaint proceeding, not a verified account of the eventual court ruling. Read the Board’s final order.

Why the Board’s authority was contested

The case was not a general proceeding to approve or site wind projects. It was judicial review of the Board’s final order in the Beanes’ complaint. The legal issue was whether the Board could investigate and rule on the utility’s conduct in this particular property dispute.

Issue Iowa Utilities Board’s position MidAmerican Energy’s position
Authority under Iowa Code chapter 476 The Board read several chapter 476 provisions together as authority to investigate a rate-regulated utility’s business practices in response to a complaint. MidAmerican argued that authority over utility rates and services does not create broad complaint or enforcement jurisdiction over general business practices.
Tenant’s interest in the land The Board concluded the Beanes had possessory rights under their leases and that MidAmerican entered without their permission. MidAmerican relied on easements granted by the landowner and argued that any conflict over the tenant’s use of the property belonged between tenant and landlord.
Role in this complaint The Board said it could investigate the allegations and determine whether the utility’s conduct was an inappropriate business practice. MidAmerican maintained that the Board’s role did not extend to this landlord-tenant and property dispute.

The dispute therefore turned on more than whether the landowner had signed an agreement. It also concerned the tenant’s leasehold rights and whether the Board’s utility-regulatory powers reached the company’s actions on that leased land. What the Board ordered—and what the court record establishes

The Board’s March 14, 2022 order stated: “The Board determines that MidAmerican trespassed on the Beanes’ leased property when it began constructing wind turbines without obtaining the Beanes’ permission to do so.” The order also required MidAmerican to file updates describing changes to its business practices and required the company and the Beanes to report on outstanding damage issues. Those requirements describe the agency’s order; they do not establish what a court later upheld or changed.

MidAmerican petitioned the Polk County District Court for judicial review. The Board’s August 2022 litigation update listed a September 23, 2022 hearing as scheduled. Its January 2023 update records that the court issued a ruling on December 15, 2022, and lists January 14, 2023, as the appeal deadline. The update does not state what the court decided or whether an appeal followed. See the January 2023 litigation update and the August 2022 update.

What the lawsuit could mean for wind projects on leased land

The Board’s order treated the tenant’s leasehold interest and lack of permission as relevant even though the landowner had granted easements to MidAmerican. Its reasoning also asserted a role for the Board in examining a regulated utility’s business practices. MidAmerican’s challenge put both aspects in dispute: the agency’s jurisdiction and the significance of the tenant’s rights in this case.

That makes the case relevant to questions about utility conduct on leased property, but the available procedural updates do not show whether the district court adopted the Board’s interpretation, rejected it, or addressed the dispute on another basis. They also do not establish any later appellate disposition. It would therefore be inaccurate to describe the lawsuit as having definitively expanded or narrowed the Board’s authority, or as establishing a binding answer for other wind projects.

What tenants and landowners should take from the case

The Board’s findings are specific to the leases, evidence, and conduct it considered in the Beanes’ complaint. They do not, by themselves, establish a universal rule that every tenant must separately approve turbine construction or that a landowner’s easement is always insufficient. Anyone assessing a similar project would need to examine the relevant lease, easement, agreements, construction permissions, and applicable law. The documented agency order and court updates do not supply a final judicial rule for other properties.
