The City refused the application in May 2025, but after the State Administrative Tribunal invited it to reconsider an amended proposal, councillors unanimously supported approval at their 7 October 2025 meeting.
Why did the City initially refuse La Mortazza’s application?
La Mortazza, at 500 Fitzgerald Street in North Perth, applied to change its approved use from restaurant/cafe to restaurant/cafe and small bar. The change was intended to allow alcohol service with smaller, snack-style meals. In May 2025, the City of Vincent refused the application, focusing on noise from extended trading and whether the proposed use suited the surrounding residential area.
PerthNow reported that the refusal involved a proposed evening noise level of 54 dB against a City evening limit of 49 dB. Those figures are the news report’s account of the original refusal, not independently verified acoustic measurements. The central issue was how later trading could be managed without harming residential amenity.
After the refusal, La Mortazza director Raffaella D’Alonzo told PerthNow: “We are very upset,” adding, “Any business owner wants to grow. We’ve outgrown the daytime service and just wanted to try.”

What changed before the application was approved?
La Mortazza sought a review at the State Administrative Tribunal (SAT). The Tribunal invited the City to reconsider its decision, and the amended proposal included a revised acoustic assessment, a venue management plan and a seating plan. The City then assessed the revised material and proposed conditions intended to make the operating limits enforceable.
At the 2 October briefing, an unnamed City officer was reported as saying: “We’re satisfied that the measures that are in place are suitable for approval in perpetuity because they are very tangible in nature and enforceable.”

What did the reported approval allow?
At its 7 October 2025 meeting, the City unanimously supported its officer recommendation to approve the amended application. PerthNow reported a maximum of 32 people on site, including staff, with no more than 16 seated in the outdoor dining area. It also reported six additional event days per year, subject to the City’s satisfaction.
The published accounts do not give a consistent summary of the later-trading days: one describes later trading through Saturday, while another says Thursday through Sunday. Check the written decision and approved plans for the precise day-by-day hours rather than relying on those summaries as a definitive weekly schedule.

What concerns did residents raise?
During the October 2 briefing, residents raised concerns about parking, traffic, noise, amenity and alleged prior non-compliance. These were concerns raised by residents, not findings established by the reported decision.
The officer recommendation described parking and bicycle provisions: eight on-site parking bays marked “cafe parking” and at least two bicycle bays. Alongside the revised acoustic assessment and venue management plan, those provisions formed part of the amended proposal considered by the City.
