No. Report the transaction accurately. A false purchase price can lead to a tax adjustment or other consequences, but the applicable rules depend on your state and the type of transaction. Do not assume that a penalty described by one state applies nationwide.
Why the purchase price matters
States may use the reported price to assess tax or fees, and their forms can require the buyer to certify that the information is correct. California’s title and registration application asks for the purchase price and includes a certification that the information is “true and correct” under penalty of perjury. The form also distinguishes purchases from gifts and trades, which have separate reporting requirements. California Application for Title or Registration
Report the actual transaction under the rules for your state. A genuine gift, trade, discount, or other arrangement may be treated differently from an ordinary sale; use the relevant state form and instructions rather than changing the stated amount to reduce tax.
What can happen if the amount is inaccurate?
California: a discrepancy may affect use tax
California DMV says an application subject to use tax must show the purchase price on the title application or include a bill of sale. If the stated price differs from the amount DMV uses, the applicant must explain the discrepancy on a Statement of Facts; otherwise, use tax is based on the higher amount. California also requires acceptable documentation to substantiate a reported price for vehicle license fee purposes. Its recordkeeping guidance lists a purchase invoice among acceptable cost documents; unsupported prices may result in a higher vehicle license fee classification. New York: false statements may carry legal consequences
New York DMV warns that a false statement in an application or supporting proof may be punishable as a misdemeanor and may result in license suspension or revocation. If you already reported the wrong price
- Do not compound the error. Do not make additional false statements or create altered or backdated paperwork.
- Keep the records. Preserve the purchase contract or bill of sale, payment records, title documents, and messages that show what was actually exchanged.
- Ask the relevant agency how to correct the record. Contact the DMV or tax authority in the state where the vehicle is titled and ask how to amend the reported price or tax information. Procedures vary by state and transaction.
- Get qualified advice when the stakes are significant. If the understatement was intentional, tax may have been avoided, or an agency has contacted you, consult a licensed attorney or tax professional in that jurisdiction.
California’s correction process is state-specific
For an under-reported vehicle value, California DMV describes submitting a REG 256 Statement of Facts with the correct value and acquisition date, explaining that incorrect value information was provided when the vehicle was registered, and providing title-related documentation. For a currently registered vehicle, DMV says its headquarters may bill additional fees based on the newly reported value. This is California’s procedure, not a universal form or safe-harbor process. Use documentation that reflects what was paid or transferred, and follow your state’s requirements for the transaction type.
