India online casinos that offer money games are prohibited under the central framework in force since 1 May 2026. The Government says the prohibition covers games of chance, skill, or a mix of both, and also restricts their promotion and facilitation. It applies to covered services offered in India or operated from abroad, so an offshore address or foreign licence does not by itself make a casino lawful for people in India.
Are online casinos legal in India?
For an online casino or other game where a user pays or stakes money expecting monetary winnings, the practical answer is no under the current central framework. The Government describes online money games as prohibited regardless of whether chance, skill, or both determine the outcome. The restrictions also cover advertising, promotion, facilitation, and bank or payment-system processing of transactions linked to prohibited games. The Promotion and Regulation of Online Gaming Act, 2025 (Act 32 of 2025) received enactment on 22 August 2025. The Act and the Promotion and Regulation of Online Gaming Rules, 2026 came into force on 1 May 2026. The Act extends across India and expressly covers online money gaming services offered within India or operated from outside India; its text is available at India Code.
This is a description of the central online-money-game framework, not a determination about every game, website, or person. Whether a particular offering falls within a statutory category depends on its features and the relevant determination. Do not treat a platform’s own claim of legality as an official ruling.

Does an offshore casino or foreign licence change the answer?
No, not on its own. The Act’s reach includes covered online money gaming services operated from outside India as well as those offered within India. A site’s offshore hosting, rupee deposits, or foreign licence does not override that scope. The Government also describes restrictions on facilitating prohibited games and processing related transactions through banks and payment systems.
These points do not establish whether every offshore site or specific transaction has been assessed by the authorities. A platform-specific legal answer requires checking current Authority determinations and notices, applicable legislation and court orders, and advice from qualified Indian counsel.

How does the law distinguish online money games, social games, and e-sports?
The framework distinguishes prohibited online money games from online social games and e-sports. Classification is not resolved simply by a site calling something “skill-based,” “social,” or “e-sports.” The Rules provide for the Online Gaming Authority of India under MeitY to make determinations based on the game and provider.

The factors in the table are part of a determination process, not a standalone checklist that lets a user certify a game’s status. Registration is also required where the Central Government notifies a category. Neither registration nor the existence of a social-game or e-sports category is a route to authorise a game that is prohibited as an online money game. What should players know about safeguards and complaints?
The Rules identify user-safety features for covered online social games and e-sports, including age verification and age-gating, time restrictions, parental controls, reporting tools, counselling support, and fair-play and integrity monitoring. Providers offering those categories must maintain a grievance mechanism.
- Raise the issue through the provider’s grievance mechanism.
- If the provider does not resolve it, or no resolution is provided, a user may appeal to the Online Gaming Authority of India.
- A second appeal may be made to the Appellate Authority, the Secretary of MeitY.
These safeguards and appeal routes apply to the specified categories; they do not make a prohibited online money game lawful.

What do the reported market figures tell you—and what do they not?
The Government’s 30 April 2026 explainer reports that the Indian online gaming market generated INR 232 billion in revenue in 2024, with transaction-based games accounting for 77% of that market revenue. It projects 11% compound annual growth and an INR 316 billion market in 2027. These are Government-reported, market-wide figures, not casino-specific measurements or evidence that a game is lawful.
The same explainer estimates that around 45 crore people were affected by online money-game platforms and that losses exceeded Rs. 20,000 crore. The explainer does not identify the underlying study in the reviewed text, and neither figure is casino-only; they should be understood as Government estimates, not independently verified counts of casino users or casino losses.

Does this settle the law for physical casinos or every state?
No. The central framework discussed here concerns online gaming, and it does not determine the legality of land-based casinos or resolve every state-specific rule. Nor does the general framework settle every edge case involving a particular game, operator, or offshore service. For an individual platform, consult current Authority determinations and notices, legislation and court orders, and qualified Indian legal advice. Because the framework is recent, later amendments or judicial orders may change its application.
