Anthropic’s $1.5 Billion Authors’ Settlement: Who Qualifies and When Payments May Arrive

The court approved Anthropic’s $1.5 billion settlement over books downloaded from LibGen and PiLiMi. The claim deadline has passed; check JND for payment updates.

Anthropic’s $1.5 billion settlement with authors and publishers received final court approval on July 20, 2026. The often-repeated figure of “potentially $1 trillion” was a hypothetical maximum-damages scenario discussed before the settlement—not the amount Anthropic agreed to pay or a damages award. The claim deadline has passed, and although claimant notices were reported sent in September, a current payment start date has not been verified.

What the settlement pays—and what the $1 trillion figure meant

The U.S. District Court for the Northern District of California approved a settlement fund of $1.5 billion plus interest. The court described the estimated gross amount as approximately $3,000 per covered work before costs and fees. That is not a promise that every author will receive $3,000: the fund also covers administration and other approved costs, and a work’s proceeds may be divided among rights holders.

The larger headline number came from a hypothetical statutory-damages calculation reported before settlement. Ars Technica described a scenario using up to $150,000 per work for willful infringement and a very large early estimate of works or downloads. Statutory maximum damages are discretionary, depend on legal findings, and are not automatically awarded. The case settled without a trial establishing a damages total.

The court’s final order lists 482,460 works. That is a different measure from the roughly seven million downloaded copies estimated by the Authors Guild in 2025: copies can be duplicates, and the final class was limited by eligibility criteria. The final order reports 440,490 works, or 91.3% of the list, had been claimed as of April 16, 2026; that dated processing figure is not a final count of paid claims.

What the lawsuit was about

Authors Andrea Bartz, Charles Graeber, and Kirk Wallace Johnson brought the class action over books Anthropic downloaded from the shadow libraries Library Genesis (LibGen) and Pirate Library Mirror (PiLiMi). An earlier ruling distinguished how books were obtained: it found training on lawfully acquired copyrighted works to be fair use, while leaving claims over downloads from the shadow libraries for trial. The parties settled those claims before trial.

The settlement resolves covered past claims in this case. It does not release claims about AI output, establish that all AI training on copyrighted books is lawful or unlawful, or decide lawsuits involving other AI companies. Anthropic denied wrongdoing in the court-authorized notice. In approving the deal, Judge Araceli Martínez-Olguín wrote that the fund “provides meaningful relief to the Settlement Class given the reasonable range of Class Members’ possible recoveries.” That was the court’s assessment of the compromise, not a finding that the maximum theoretical damages were owed.

Which books and rights holders are covered

Eligibility is tied to the official Works List, not simply to whether an author suspects a book appeared in an online library. The court-authorized notice describes a qualifying work as one Anthropic downloaded from LibGen or PiLiMi, that has an ISBN or ASIN, and that meets the specified U.S. Copyright Office registration timing rules. A claimant must be a legal or beneficial owner of the covered reproduction rights.

That distinction matters in publishing. A publisher may hold legal rights while an author has a beneficial interest through royalties, and contracts, reversions, or other rights arrangements can affect allocation. The claim form and administrator’s determination govern work-specific eligibility and allocation.

The gap between millions of estimated downloads and the final list reflects the limits of the class definition. The Authors Guild identifies exclusions such as foreign editions, books without ISBNs or ASINs, works not registered with the Copyright Office, and works that missed registration timing requirements. The seven-million estimate counts downloaded copies or files, not seven million eligible authors or unique covered titles.

Deadlines and payment status

JND Legal Administration lists March 30, 2026 as the claim deadline and February 9, 2026 as the opt-out and objection deadline; all have passed. A person who did not submit a claim by the deadline should not assume that a work’s presence on the Works List alone creates a payable claim.

The settlement landing page’s search result reports claimant information notices were sent September 2–4, 2026 to claimants with a valid email address on file. That confirms notices, not that payments have been issued. The Authors Guild’s July 21 approval update said no specific payout start date had then been announced; that dated statement does not establish the status as of October 8, 2026. Check JND’s current settlement page or contact the administrator for the latest schedule rather than relying on an assumed payment date.

What to check if you filed a claim

  1. Look up the work. Use the official settlement site’s Works List or lookup to confirm the title is included.
  2. Review your rights documents. Check your publishing agreement, any rights reversion, and related records to see who owns the covered reproduction rights and whether proceeds may be shared.
  3. Check administrator communications. Use the contact details on JND’s official settlement pages for claim-specific notices, status, or allocation questions. A general notice does not itself confirm a payment amount or date.
  4. Address disagreements through the administrator. If multiple rightsholders claim a work or dispute who is entitled to proceeds, allocation is determined under the approved plan by the administrator and special master.
