Check requirements for your location, product, kitchen, labels, and delivery method before accepting orders. Then choose a sales channel and fulfillment process that fit those limits.
Start with the rules where you bake
Food-business requirements depend on your product, facility, and jurisdiction. The FDA advises home-based food businesses to learn applicable federal rules and contact state and local health departments. A private residence is not a food facility required to register under the federal food-facility registration rule, but that narrow exemption does not remove other permits, inspections, or requirements that may apply. FDA guidance for starting a food business is a useful starting point, not a substitute for checking with your regulator.
Before listing a product, ask your state and local agencies:
- Is the specific baked good allowed under the rules for home-produced or cottage foods?
- Do you need registration, a permit, training, an inspection, or an approved kitchen?
- Are there limits on where and to whom you may sell?
- Can customers order online, and what pickup, delivery, or shipping methods are allowed?
- What ingredient, allergen, identity, net-quantity, or home-kitchen notices must appear on the product or listing?
Rules can change when you switch products, move, increase production, or change how an order reaches the customer. Shopify’s food-business guide describes state-specific cottage-food rules and uses California to illustrate differing sales categories and permit requirements; treat it as general context and confirm details with the relevant agency.

Online orders, local delivery, and shipping are separate questions
Permission to advertise or accept an order online does not necessarily permit every fulfillment method. Check each part of the transaction: where the order is placed, where the customer is located, who delivers it, and whether a carrier is involved.
Taking orders online
Some rules allow online order intake while restricting fulfillment. Connecticut’s Department of Consumer Protection, for example, says cottage-food producers may advertise and take orders online, but must directly deliver products to consumers within Connecticut. Its guidance does not allow mail, UPS, FedEx, or delivery through mobile food-ordering companies. This is a Connecticut example, not a national rule. Pickup or direct local delivery
If allowed where you operate, pickup or direct delivery may let you serve a defined local area without shipping parcels. Confirm whether the rules impose boundaries, require the producer to deliver personally, or restrict third-party delivery services. Configure your ordering process so customers cannot select a location or method you are not allowed to serve.
Shipping by carrier
Do not assume that a product permitted for local sale can be mailed or sent across state lines. Verify state rules for both the place you operate and the destination, as well as the carrier’s current restrictions for food. Etsy also advises sellers to check carrier rules before shipping food. The answer to whether you can ship out of state depends on the product, origin, destination, and applicable requirements; a sales platform cannot determine that for you.

Choose a sales channel that matches your business
A marketplace and a standalone storefront solve different problems. A marketplace can put listings within an existing shopping destination; a standalone store gives you more direct control over presentation and the customer’s ordering path. Neither makes an otherwise prohibited sale lawful. Compare options using your actual fulfillment limits and current fee schedules rather than assuming one platform is best for every baker.

For a useful comparison, check discovery, customization, order and pickup/delivery workflow, customer communication, ability to limit service areas, fulfillment tools, and total current costs. Your best fit is the channel that supports the sales and delivery methods your regulators allow and that makes the full cost understandable.

- Ingredients and allergens: provide accurate information and follow applicable labeling rules. FDA guidance says food labels must be truthful and not misleading, and allergen labeling is required for most prepared foods. The precise obligations depend on the product and jurisdiction; review FDA’s food-allergy and labeling guidance and confirm local requirements.
- Required notices: verify whether the product needs an ingredient statement, allergen declaration, net quantity, business identity, home-kitchen notice, or other information on its package, online listing, or both.
- Timing: state order cutoffs, production time, available pickup or delivery windows, and how you will handle a delay or an order you cannot fulfill.
- Service boundaries: specify the areas and fulfillment methods you serve, and configure checkout to prevent orders outside those limits where the platform allows.
- Customer terms: explain how customers can contact you about order details, changes, or problems, and make any cancellation or refund terms clear and consistent with applicable rules.
Plan fulfillment before you publish
For pickup or local delivery, decide how orders will be scheduled and handed over. For carrier shipments, first confirm that the product and route are permitted, then establish a repeatable packing and dispatch process. A package that arrives late, damaged, or in poor condition can undermine a sale, so set realistic processing times and choose packaging suited to the item and route.
Measure and prepare parcels
Weigh the packed shipment and measure its dimensions so you can enter accurate information when arranging postage. Etsy’s shipping-workstation guidance identifies a scale, measuring tape, and printer as useful tools for preparing shipments and labels. Boxes and protective fillers are common supplies; choose materials appropriate for your product and delivery conditions. The sources do not establish a universal packaging or temperature-control method for every baked good.
Set dispatch and tracking expectations
Use a processing-time promise you can meet while accounting for production and packing. Check carrier restrictions and service details before offering a shipping option, then provide tracking when available and communicate promptly if dispatch changes. Do not promise a delivery date the carrier or your production schedule cannot support.
