How to Get Out of a Car Lease Early Without a Penalty

Most U.S. drivers cannot end a car lease early without cost. Check your contract, get written quotes, and compare permitted options; qualifying servicemembers may have SCRA protections.

For most U.S. drivers, there is no general right to end a car lease early without cost. Your lease sets the rules, and simply returning the car does not necessarily end your payment obligations. The clearest exception is for qualifying servicemembers covered by the Servicemembers Civil Relief Act (SCRA). Otherwise, compare written quotes for an approved transfer, a permitted buyout and sale, a trade-in, or keeping the lease until maturity before choosing.

Start with your lease and a written quote

Before handing over the keys or making a deal with someone else, identify the lessor—the company that owns the vehicle or holds the lease—and review the contract. Federal disclosure rules require a consumer lease to state the conditions for early termination and the amount of a charge or how it is calculated. The Federal Reserve’s early-termination guide explains that charges can reach several thousand dollars; that is general guidance, not an estimate of what you owe.

Ask the lessor for written figures and instructions. Request the current early-termination amount, a purchase payoff if the contract allows you to buy the car, any fees or other amounts due, and the date each quote expires. Ask whether the lessor permits a qualified person to assume the lease or a dealer or other third party to buy the vehicle. Get return requirements and deadlines in writing as well.

Check the scheduled maturity date, remaining payments, purchase option, mileage allowance, wear obligations, transfer restrictions, and any taxes or fees. Compare the total cost of each available route with the cost of keeping the car through maturity—not just the monthly payment. State law can affect your rights, and the applicable rules cannot be determined without your location and contract.

Check whether SCRA protections apply

The SCRA provides a route to terminate certain motor-vehicle leases without an early-termination charge for servicemembers who meet specific conditions. It is not a general military hardship cancellation right. The CFPB summarizes the qualifying circumstances in its military auto-lease guidance.

Which leases may qualify

  • The lease was made before the servicemember entered qualifying military service under orders for at least 180 days, including a qualifying extension.
  • The lease was made during service and the servicemember later received qualifying permanent change of station (PCS) orders: from a location in the continental United States (CONUS) to a location outside CONUS, or from a location outside CONUS to a location outside that state.
  • The lease was made during service and the servicemember later received orders for a deployment of at least 180 days.

The cited statutory text is available at 50 U.S.C. § 3955 on GovInfo. Not every military move meets the test: for example, a CONUS-to-CONUS PCS after a lease was signed during service is not one of the described qualifying PCS situations. Check the current law, your lease date, service status, and the exact orders rather than relying on the fact of a move alone.

How to complete the termination

  1. Send the lessor, or its agent, written notice of termination and a copy of the qualifying orders.
  2. Deliver the notice through an authorized channel: hand delivery, private carrier, certified mail with return receipt, or an electronic channel designated by the lessor.
  3. Return the vehicle within 15 days after delivering the notice. Keep copies of the notice and orders, proof of delivery, and evidence of the vehicle’s return.
  4. Confirm with the lessor that it received the notice and vehicle and has processed the termination.

The lease ends only after the required steps, including returning the vehicle, are completed. If the lessor disputes eligibility or demands an early-termination charge, the CFPB recommends contacting a JAG or legal-assistance office; a state attorney general may also be an option.

What can still be owed under SCRA

Waiving an early-termination charge does not necessarily erase every obligation. Contractual amounts already owed, unpaid taxes or listed fees, and reasonable charges for excess mileage or wear may remain due. Qualifying advance payments for time after termination must be refunded within 30 days. The CFPB’s guidance explains the distinction between an early-termination charge and other amounts that may still be payable.

Compare the non-SCRA options

If SCRA does not apply, the lessor’s contract and current figures determine which alternatives are available. Use written amounts for the same date where possible, and include any new debt or continuing liability in your comparison.

Assumption or transfer

Ask the lessor whether it allows another qualified person to assume the existing lease and whether the original lessee is released in writing. The Federal Reserve’s vehicle-leasing FAQ describes transfer considerations, but the lessor’s policy and your contract control. A private agreement in which someone else promises to make your payments is not the same as the lessor approving a transfer and releasing you. Avoid informal subleasing or arrangements that conceal the driver from the lessor.

Buyout and sale

If the contract provides a purchase option, get the lessor’s payoff and compare it with firm offers to buy the car, accounting for taxes, fees, and transaction rules. The payoff and offers can change, so confirm their validity dates before acting. A sale price below the payoff leaves a deficiency you must address; a buyout is not automatically penalty-free or profitable. The CFPB’s leasing-versus-buying guidance explains the basic distinction between leasing and ownership.

Dealer trade-in

Ask the dealer to show the car’s trade value and the lease payoff as separate figures. If the trade value is less than the payoff, the difference is negative equity. The FTC’s car financing and leasing guidance warns that negative equity can be carried into a new financing or lease arrangement, increasing what you finance, the term, or the payment. A lower advertised monthly payment does not by itself show that the deal costs less.

Keep paying until maturity

Keeping the vehicle and making scheduled payments may avoid a separate early-termination calculation, but it does not make the remaining payments disappear. Compare the total scheduled payments and expected lease-end obligations with each written alternative. The Federal Reserve guide notes that ending a lease earlier can cost more because of the way depreciation and the termination calculation interact.

Compare total cost and responsibility—not just the payment

For each route the lessor permits, put these items side by side:

  • Total dollars due now and through the scheduled maturity date.
  • Whether the lessor permits the route and what paperwork or deadlines apply.
  • Whether you are fully released from responsibility, confirmed in writing.
  • Any remaining mileage, wear, taxes, fees, or other contract charges.
  • Any shortfall, deficiency, or negative equity—and whether it becomes new debt.

Do not rely on a verbal estimate, an informal promise from a new driver, or a payment comparison that leaves the payoff and trade value hidden. The lease, lessor approval, and written transaction figures determine what you will owe and whether your obligation actually ends.
